The largest county in the U.S. by geographic area and the 12thlargest by population, San Bernardino County enjoyed a robust economypriortothecollapseofthehousingandfinancialmarket.Withthedeclineoftraditionalrevenuestreamssuchaspropertyandsalestax,theCountywasforcedtomakedifficultbudgetdecisions.Forthecurrentyear,theCountyhasadoptedabalancedbudgetthatavoidedutilizingone-timemoniestofinanceongoingcostandavoidedtheuseofCountygeneralreservestofundongoingoperations.Nevertheless,laggingrevenuesandrisingcostscoupledwiththeuncertaintyoftheState’sfiscalconditionhasthepotentialtofurtherjeopardizetheCounty’sfiscalwellbeing.InorderfortheCountytocontinuetoprovidequality services, assistance from the State and continued partnership withthedelegation is imperative. In thisplatform, youwill findSanBernardinoCounty’sStatelegislativeprioritiesfor2012.
Based on principles of fiscal stability, preservation of local control,efficientservicedeliveryandoperations,and thepromotionof inter-agencycooperation, the San Bernardino County Board of Supervisors providesspecificdirectionandoverallpolicyguidancebyadoptingalegislativeplatformannually.
The2012StateLegislativePlatformwasdevelopedincoordinationwiththeBoardofSupervisors,Countydepartments,andregionalstakeholders.TheLegislativePlatformisanexpressionoftheBoard’sdirectionforcomprehensiveCountylegislativepolicyonarangeofissuesandneedsfacingtheCounty.ThePlatformisarrangedbyLegislativePriorities,CountySponsoredProposals,LegislativePositions,andPolicyStatements.TheLegislativePrioritiessectiondescribes theCounty’s legislativegoalsandoutlines the legislativeagendaforthecurrentyear,whiletheCountySponsoredProposalssectionprovidesasummaryofspecificstatutorychangestheCountyisseekinginthecurrentlegislativesession,andtheLegislativePositionsandPolicyStatementsprovidegeneralpolicydirectionwhendevelopingapositiononpendinglegislation.Thisdocumentisbrokenintoareasincludinggovernance,financeandoperations,healthandhumanservices,publicsafetyandfirstresponders,housing,landuse and transportation, flood control, water resources and environmentalquality,andcultural,educationalandrecreationalservices.Eachitemcontainsabriefbackgroundandlegislativeaction.

Legislative Priorities
ThelegislativeprioritiessectionestablishestheCounty’sgoals,andoutlinesthelegislativeagendaforthecurrentyear
STATE BUDGET, CONSTITUTIONAL PROTECTIONS AND PROSPECTIVE REALIGNMENT PROPOSALS
OnNovember16,2011,theLegislativeAnalyst’sOfficereportedthattheLegislatureandtheGovernorwillneedtoaddressa$12.8billionbudgetshortfallbythetimetheStateadoptsa2012-13budgetplan.Thedeclineoftraditionalrevenuestreams,suchaspropertytaxandsalestax,coupledwiththeuncertaintyoftheState’sfiscalconditionhasthepotentialtofurtherjeopardizetheCounty’sfiscalwell-being
TheCountywillworkwiththedelegation,statewideassociationsandlocalagenciestomitigateanypotentialimpactsoftheStateBudgettotheCounty.
Aspartofthe2011-12StateBudget,theLegislatureenactedamajorrealignmentofStateprogramresponsibilitiesandrevenuestolocalgovernments.Intotal,therealignmentplanprovides$6.3billiontolocalgovernmentstofundvariouscriminaljustice,mentalhealth,andsocialservicesprograms.TheseprogramsarefundedbyaportionoftheexistingsalestaxandVehicleLicenseFeerevenue,howeverthebudgetplandidnotincludeaconstitutionalamendmenttoguaranteecountiesaprotected,ongoingsourceoffundingtopayforthedeliveryoftheseprograms.
TheCountywilladvocateforaconstitutionalamendmentthatincludesadedicatedandprotectedrevenuesourceoutofexistingStatefundstosupportthedeliveryofpublicsafetyandhealthandhumanservicesthatwererecentlyrealignedfromtheStatetotheCounty.
IthasyettobedeterminediftheAdministrationwillpursuethesecondphaseofrealignmentproposedbytheGovernorlastJanuary.AccordingtotheAdministration,PhaseIIassumesthattheStatewillbecomeresponsibleforcostsassociatedwithhealthcareprograms,includingCaliforniaChildren’sServicesandIn-HomeSupportiveServices,whilethecountiesassumeresponsibilityforCalWORKs,FoodStampadministration,andChildSupport.
TheCountywilladvocateforanypotentialrealignmentproposal,aspartofRealignmentPhaseII,toprovideguaranteedandadequatefundingandnecessaryflexibilitytoadministertheprograms.
INCREASE OR MAINTAIN THE PUBLIC SAFETY REALIGNMENT FORMULA ALLOCATION
OnJune30,2011,GovernorBrownsignedAB118,thelegislativevehiclethatestablishedthefiscalstructurefortherealignmentofpublicsafetyandhealthandhumanservicesprogramsthatwererealignedfromtheStatetocounties.Thisstructure,inplacefiscalyear2011-12only,isfundedbyaportionofstatesalestaxandVehicleLicenseFeeandcontainsthecounty-by-countyallocationformulaforAB109(CriminalJusticeAlignment).ThisformulaisbasedondailypopulationofoffendersmeetingAB109eligibilityrequirements(60percent),countypopulationrangingfrom18to64years(30percent)andSB678(10percent),andresultedintheCountyreceivingapproximately$26milliontoimplementAB109.Theformulaallocationforfiscalyear2012-13andsubsequentyearsaresubjecttochangethroughthelegislativeprocess.
TheCountywillaggressivelyadvocatefor:1)fundingthatreflectscomplete,accurateandtotalcaseloadcost;2)adequate,securedandongoingfundingfortheincarceration,supervision,treatment,rehabilitationandothercostsnecessarytosuccessfullyimplementAB109,and3)flexibilityandlocaldiscretioninhowthefundingisallocatedandprogramsareadministered.

REINVESTMENT OF REDEVELOPMENT AGENCIES
OnJune30,2011,GovernorBrownsignedAB26x1,whicheliminatedredevelopmentagenciesandAB27x1,whichcreatedanalternativevoluntaryredevelopmentprogramthatrequiredagenciestomakespaymentsinordertocontinue.Lastyear,CaliforniaRedevelopmentAgency(CRA)vs.MatosantoswasfiledintheCaliforniaSupremeCourtbyCRA,theLeagueofCaliforniaCities,andthecitiesofSanJoseandUnionCity,challengingtheconstitutionalityofAB26x1andAB27x1.OnDecember29,2011,thecourtruledthatstatelawmakershavetheauthoritytoeliminatecommunityredevelopmentagenciesbutnotforcethemtoredirecttheirtaxes,throughtheproposedvoluntaryprogram,effectivelyeliminatingredevelopmentagenciesthroughoutthestate.TheestimatedannuallossfromtheeliminationoftheSanBernardinoCountyRedevelopmentAgencyis$11.15million,inadditionto$22millioninunencumberedhousingfundsforatotalone-yearlossof$33.15millionfromthelocaleconomy.
TheCountywillworkwiththeLegislature,statewideassociations,localagenciesandstakeholderstore-establishredevelopmentinamannerthatconformswiththeConstitution,achievesanynecessaryreforms,andcontinuestoassistcommunitiesincreatingjobsandeliminatingblight.
PENSION REFORM
OnOctober27,2011,GovernorBrownpresenteda12-pointplantochangepensionandretireehealthbenefitsforCaliforniastateandlocalgovernmentworkers.Additionally,ajointlegislativeconferencecommitteewasformedtoexaminecurrentpublicpensionsystems,theeffectivenessofrecentreforms,andoptionsgoingforwardtohelpbringfiscalstabilitytothesysteminawaythatisequitabletobothworkersandthecitizensofCalifornia.Inordertoensurethefiscalwell-beingoftheStateandlocalgovernments,changewillneedtobemadetothecurrentstructureofpublicemployeeretirementsystems.
TheCountywillmonitortheGovernor’sandthejointlegislativeconferencecommittee’sproposalsforpotentialimpactsandadvocateforpensionreformthatmaintainspublicemployeeretirementsystems’:1)responsibleandpredictablelevelofinvestment;2)capacityformutualsharingoffinancialresponsibilitybetweentheCountyandtheiremployees;and/or3)flexibilitytoallowcountiestomeettheirlocalneeds.

AB94(CriminalJusticeRealignment)Clean-up
ThePublicSafetyandOfficerRehabilitationServiceActof2007(AB900)authorizedupto$1.2billionoffundsforcountyjailconstruction.In2008,theAdelantoDetentionCenterexpansionprojectwasrankedNo.1onthelistofentitiestobeconditionallyawardedAB900funds,withstateagreementsfinalizedinOctober2010.OnMay9,2011,GovernorBrownsignedintolawAB94,ameasurethatmodifiedAB900byreducingthelocalmatchforjailconstructionprojectsfrom25percentofeligiblecostto10percentofeligiblecost.TheCounty’sprojectwasprecludedfrombenefitingfromthelowermatch.Thisresultedinapotential$16millioninequitabledisallowancetotheCounty.
SponsorlegislationorbudgetactionsthatwouldpermittheCountytorecovertheGeneralFundinvestment.
TheCountySponsoredProposalsectionincludesspecificstatutorychangesthattheCountyisseekinginthecurrentlegislativesession.SponsoringbillsprovideaproactiveopportunitytoadvancetheCounty’slegislativegoals
andagenda.Thisisaccomplishedbyworkingwiththelegislativedelegation,statewideassociationsandregionalstakeholders.

CampaignFinanceReform
OnSeptember27,2011,theBoardofSupervisorsdirectedtheCountyAdministrativeOffice,withtheassistanceofCountyCounsel,toprepareanordinanceand/ordraftstatelegislationthatwouldestablishcampaigncontributionlimitsfromindividuals,politicalactioncommittees,andbusinessestoallcandidatesforelectedoffices,setexpenditurelimitsforsuchcandidates,anddisclosurerequirementsforindependentexpenditurecommittees.Additionally,theBoardofSupervisorsprovideddirectiontoresearchmethodsofenforcingsuchanordinanceorstatelawrequirements,includingthefeasibilityofcontractingwiththeCaliforniaFairPoliticalPracticesCommission.
SponsorlegislationthatwouldenabletheCaliforniaFairPoliticalPracticesCommissiontoenforcetheCounty’sCampaignFinanceReformOrdinance.

TheIn-HomeSupportiveServices(IHSS)programprovidesservicestoclientswhoareagedand/ordisabledandrequireassistancewithactivitiesofdailylivingtosafelyremainintheirhome.Substantialandongoingbudgetcutshaveresultedinseverefundingdeficitsforthisprogram.

ThemaintenanceallowanceforpersonalandincidentalneedsforinstitutionalizedMedi-Calbeneficiarieshasremainedat$35since1985.This$35monthlyallowanceisintendedtocoverincidentalssuchasclothing,shoes,socks,undergarments,haircuts,snacksorentertainmentneeds.TheDepartmentofHealthServicesisauthorizedtoincrease,byregulation,thepersonalandincidentalneedsamountasnecessitatedbytheincreasingcostsofpersonalandincidentalneeds.

MoonridgeAnimalParkistheonlyzooinSanBernardinoCounty.InFebruary2009,theMoonridgeZoolostitsleaseatitshistoricallocation.SanBernardinoCountyrecentlyacquired10acresoflandfortheparkinBigBearValley.Thisland,asthenewhomefortheanimals-mostofwhichwereinjured,orphaned,orconsideredapublicnuisanceandcannotbereturnedtothewild-willallowamodernexpandedfacilitytobebuilt.Thecostofanewfacilityisestimatedat$16million.Grantsandlocalcontributiontodatehaveraisedapproximately$8million.Thereistremendouspublicsupportforthisproject.MembershiptotheAnimalParkisworldwide.

CalicoGhostTownandformerminingtownisagloballyrecognizedhistoricalandeducationalsitesetintheheartofSanBernardinoCounty.LocatedintheMojaveDesertnearBarstowandYermo,CalicowasdesignatedtheofficialCaliforniaStateSilverRushGhosttownin2005,andpriortoitspresentstatushadbeendesignatedaStateHistoricLandmark.Theparkdrawsasubstantialnumberofworldwidevisitorsyear-round,andcontinuallyhasasignificantlypositiveeconomicimpactonlocalcommunitiesandtheCounty.Withaginginfrastructure,however,renovationsareneededtopreservecriticalfacilitiesandmaintaintheeconomic,educational,recreational,andhistoricalvalueofthisinternationaltreasure.

SupportlegislationorbudgetactionsthatwillassistwithfundingtowidenGlenHelenParkwaytofourlanes,constructanallweathercrossingoftheCajonCreek,andconstructagradeseparationoverboththeBNSFandUPRRrailroads,withassociatedapproachwallstobeusedtospanthecreekandrailroads.Thisprojectisestimatedtocost$46millionandisfullyfunded.However,localfundscouldbesavedifadditionalStateorFederalfundscouldbeobtained.
