Taylor Law Fact Sheet
1. THE TAYLOR LAW – WHAT IS IT? Passed in 1967, the Public Employees Fair Employment Act, commonly known as the Taylor Law (after University of Pennsylvania professor George Taylor) provides that employees have a right to be represented by employee organizations or unions that can negotiate collectively with public employers to determine terms and conditions of employment as well as for the purpose of administering grievances that arise under the negotiated contract.
The law also specifies (1) procedures for recognizing and certifying employee organizations, (2) the rights of the union once it has been recognized, (3) a means of resolution of disputes dur-ing negotiations, (4) improper practices by either the employer or union, and (5) prohibition of strikes. The Taylor Law also created the Public Employment Relations Board (PERB), which is charged with developing procedures to resolve disputes over the representation status of unions and prevent improper employer and employee organization practices. The Taylor Law also gives PERB the authority to hire appropriate staff to help perform its duties.
2. THE TAYLOR LAW AND RECOGNITION AND/OR CERTIFICATION PROCEDURES Recognition is a formal acknowledgment by an employer that a specific union has the right to represent its employees in a given bargaining unit. Recognition may be granted only by the legisla-tive branch of government. The Board of Education is the legislative body of a school district. Recognition is a process by which the Board of Education (1) groups together certain job titles into a unit appropriate for bargaining, (2) determines that the union seeking recognition is the choice of the majority of employees in that unit, and (3) adopts a resolution designating the union as the negotiating agent for those employees.
Certification is a process that comes into play if (a) the union is unhappy with the employer’s offer of recognition or (b) if the employer makes no offer at all. PERB will then define an appropri-ate unit, ascertain the union’s majority status and determine whether the union should be designated as the employees’ representative.
3. THE TAYLOR LAW AND THE SCOPE OF NEGOTIATIONSOnce the parties have sat down at the bargaining table, what do they negotiate? PERB has established three categories of demands which, depending on the category, must be, may be or may not be negotiated. The three categories are (1) mandatory, which must be negotiated, (2) permissive, which may be negotiated, and (3) prohibited, which may not be negotiated.
Mandatory subjects can be summarized as those determining the “terms and conditions of employment.” Examples of mandatory subjects of bargaining, which must be discussed if either party brings the issue to the table, are salary, longevity pay, overtime pay, severance pay, method of payment, health, dental and optical insurance, leaves, jury duty, grievance procedures, evaluation procedures, work load, work day, attendance, among many others.
Permissive subjects are those neither mandatory nor prohibited, sort of a catchall category including subject matter not directly related to salary or other “terms and conditions of employment.” These are topics that the employer need not bargain over and, in fact may flatly refuse to do so. However, once agreed to, the employer is bound by them during the term of the contract. An ex-ample of a permissive subject is an employee demand for a preamble to be included in the contract. PERB has held that a demand that does not create any duties or merely duplicates a statutory requirement is permissive in nature.
Prohibited subjects of negotiations are those topics over which bargaining are ineffectual and/or illegal. The Taylor Law, for example, prohibits bargaining over retirement benefits provided by the retirement system, delegation of school district power to grant or deny tenure as well as racial and sexual discriminatory contract clauses.

There are two types. A union may charge an employer with an “improper employer practice” and the employer can charge the union with an “improper employee organization practice.” The Taylor Law has determined the following to be “improper employer practices”: (1) Interfering with, restraining or coercing employees in the exercise of their right to organize, (2) dominating or interfering with the formation or administration of a union, (3) refusing to negotiate in good faith, and (4) refusing to continue all the terms of an expired contract until a new contract is negotiated provided the union has not engaged in a strike during negotiations. The Taylor Law has determined the following to be “improper employee organization practices”: (1) Deliberately interfering with, restraining or coercing employees in the exercise of organization rights, and (2) refusing to negotiate in good faith.
5. WHAT CONSTITUTES “BARGAINING IN GOOD FAITH”?Basically, the duty to bargain in good faith means that both parties approach the bargaining table with a sincere desire to reach an agreement. This is in contrast to when a party goes through the motions of negotiating without actually intending to reach final agreement.
Examples of violation of good faith bargaining are (1) refusal to meet for extended periods of time, without explanation, (2) withdrawal of concessions, (3) refusal to explain its bargaining posi-tions, (4) issuance of threats to, for example, “throw a mediator out,” (5) refusing to discuss retroactivity, (6) merely listening to proposals without reacting to them, and (7) failing to delegate sufficient authority to enable negotiators to make concessions or counter proposals, (8) among others.
6. WHAT IS “IMPASSE”?An impasse is a situation where two negotiating parties have reached a deadlock and there is no foreseeable way to reach agreement. Under the Taylor Law, an impasse is deemed to exist if the parties fail to achieve agreement at least one hundred twenty days prior to the end of the fiscal year of the public employer. The parties may request PERB to provide mediation and fact-finding to resolve the impasse.
7. TRIBOROUGH AMENDMENT TO THE TAYLOR LAWPassed by the legislature in 1982, the Triborough Amendment established that it is an improper practice for a public employer to refuse to continue all the terms of an expired agreement until a new agreement is negotiated. Of particular significance is a PERB ruling that requires a school district to advance teachers on the salary scale of an expired agreement. An employee organiza-tion, however, may waive its Triborough rights by including express language, known as a “sunset clause,” in the agreement.
The amendment does not apply, and an employer need not abide by an expired agreement if the employee organization causes, instigates, encourages or condones a strike in violation of the Taylor Law.
8. THE TAYLOR LAW AND STRIKESThe Taylor Law states, “No public employee or employee organization shall engage in a strike and no employee or employee organization shall cause, instigate, encourage or condone a strike.” The law defines the prohibited activity as “any strike or other concerted stoppage of work or slowdown by public employees.” While “job actions” such as sick-outs, blue flue and work to rule are not defined under the law, PERB views them as a joint refusal by a group of employees to perform all or part of their duties which may equate to a strike.
9. WHAT ARE THE PENALTIES FOR ENGAGING IN A STRIKE?Violation of the no strike provisions of the law incur the following penalties: (1) Deduction from the employee’s pay of an amount equal to twice the employee’s daily pay for each day on strike, (2) forfeiture of union rights to have membership dues and agency shop fees deducted by the employer, and (3) an employee “may be subject to removal or other disciplinary action.”
