Newsletter 2010-50 December 30, 2010 2011 LEGISLATIVE NETWORK The 2011 legislative session begins Wednesday, January 12. There will be 18 new House members and six new senators. With Sen. Earl Ray Tomblin serving as acting governor, there will be a new acting senate president. The CAWV Legislative Committee is developing the association’s Legislative Network for this session. The committee would like to know what legislators CAWV members have a personal relationship with. When a crucial issue arises this session, the Legislative Committee will contact CAWV members and ask them to contact their delegate or senator. The committee will provide members with background on the issue and talking points to be shared with their legislator. Members are asked to please contact the CAWV at (304) 342-1166 or [email protected] to indicate which legislators they are willing to contact when an issue arises affecting the construction industry. SENATE LEADERSHIP APPEARS SETTLED Based on various news media accounts, it appears the battle over who will control the state Senate once the 2011 Legislative Session begins next month has been decided. According to MetroNews, Marshall County Senator Jeff Kessler announced Monday he has enough votes to change the rules of the Senate to create the position of Acting Senate President and be elected to that post. When the caucus met earlier this month, the vote was 16-12 to create the Acting Senate President position. That was not enough to make the change with Republicans poised to vote against it. But it appears other senators have reconsidered. "It wasn't about personalities. It wasn't about people, It wasn't about power. It's truthfully about the principle of the [Acting] Governor is downstairs and these are very unique times." Sen. Kessler says he now has 19 votes in the Democratic Caucus with more on the way. "It takes 18 votes perhaps to get elected. It takes a lot more than that to govern effectively. I would like to come out of this Senate like we have over the years with a 34-0 vote and that would be my hope." Sen. Kessler says there are key issues facing the Senate in the upcoming session that begins January 12. The budget, energy and the OPEB debt are just a few, according to Sen. Kessler, that need the body's full attention. Meanwhile briefs have been filed in the state Supreme Court of Appeals relating to “when” the election for governor should be held – either in 2012 or earlier. With information received December 27 from the Acting Governor and Senate President Earl Ray Tomblin, House Speaker Rick Thompson and Secretary of State Natalie Tennant, justices can now decide what happens next. The lawsuit calls on the Court to order a Special Gubernatorial Election for early 2011. Earlier this year, the state Supreme Court combined the two Special Election lawsuits that were filed into one. Those filings came from South Charleston Attorney Thornton Cooper and the West Virginia Citizen Action Group. The Court could opt to completely reject the case outright, schedule full arguments or issue an opinion without hearing full arguments. Earlier in the month state Auditor Glen Gainer said the state Constitution overrides state law in a brief in support of the lawsuit by West Virginia Citizens Action Group and Mr. Cooper. Other parties having entered briefs include AFT-West Virginia and the West Virginia Education Association. Both groups support a gubernatorial election prior to 2012. 2011 LEGISLATIVE NETWORK

The 2011 legislative session begins Wednesday, January 12. There will be 18 new House members andsix new senators. With Sen. NO ACTION ON S. 1005: WATER INFRASTRUCTURE FINANCING ACT

The U.S. House of Representatives has agreed with the Senate to approve another continuing resolution(CR) regarding the Wastewater and Drinking Water State Revolving Fund (SRF) construction program. This CR extends funding, at the FY10 level, until March 4, 2011. S. 1005, the Water InfrastructureFinancing Act, will not be approved, however, during this Congress. Both houses adjourned withouttaking action on the bill. S. 1005 would have authorized $39.191 billion over five years for drinkingwater and wastewater infrastructure and other water quality improvements, $20 billion for the CleanWater State Revolving Fund Program, $15 billion for the Drinking Water State Revolving Fund Programand $1.85 billion for Sewer Overflow Grants. A new strategy will be developed for the next Congress.

SAFETY AS A PROFIT CENTER FOR THE COMPANY

The number one goal of safety is to prevent injury or loss of health. The number one goal of anybusiness is to make a profit. These two are far more closely related than many business peoplethink.

One of the biggest mistakes a business person can make is to fail to recognize that preventinglosses is as important as making profit. Don’t lose sight of the goal....to provide a safe workenvironment and make money. Safety isn’t tangible. Companies can’t add dollars spent on safetyto the estimate for a project and put it in the profit column. Safety can’t really be put into a lineitem of the company operational budget as a profit center. Or can it?

Successful contractors have one thing in common. They recognize that the cost of a progressivesafety program equates to greater profits. How? Very simply, by preventing loss. Prevent anaccident and the injury of an employee and you have just added profit to your bottom line. Thelosses prevented every day can’t be measured on a spread sheet or a budget line item. But incur aloss resulting from a preventable accident and watch the profit shrink.

Successful business people stay engaged in the process of all aspects of the operations of thecompany. A well managed safety process is as important to the profit margin of a company asthe percent of expected profit estimated to complete any project. Top managers who stayinvolved in the safety process and support the concepts of loss prevention know it producesfavorable results.

Some people have said that, “safety costs just too much money.” Yes, a proactive and successfulsafety program will take planning, devotion, commitment and money. But, continuing to viewsafety as a cost and not as a profit center for the company is not good business. Failing toprevent losses associated with accidents and injuries will affect the bottom line and rob profits.

So the question is not how much safety will cost, but rather how much safety will save. Safety ispart of the profit center of a company.

REPUBLICANS PROPOSE RULE CHANGE FOR HIGHWAY FUNDING

The U.S. House Republican Conference will hold an organizational meeting on January 4 to consideramendments to the Rules of the House of Representatives for the 112 Congress. On the agenda is a planth

to treat highway funding as any other line item. Currently, as a result of the 1998 TEA-21reauthorization bill mandating that all user fee revenues collected be invested in system improvements,any House member can raise a point of order against legislation reducing federal highway funding levelsfrom those set in the reauthorization bill.

According to the new proposal, most federal highway spending would now be treated as all other generalspending and therefore be subject to any member attempt to reduce that spending. If approved, this wouldallow Congress to return to the days when highway investment was kept below the level of revenuesflowing into the Highway Trust Fund so that those accumulating balances could be used to offsetspending in other parts of the federal budget.

AGC, AASHTO, ARTBA and the National Sand Stone and Gravel Association (NSSGA) are askingmembers to contact their republican representatives to oppose the rule change. • This change would disrupt the entire concept of the federal gas tax as a user fee by allowingfunding to be withheld and large balances built up in the HTF while the nation’s infrastructureneeds go unmet.

• Unemployment in the American transportation construction sector is double the national average,exceeding 18 percent. This rule change would only add more uncertainty to funding levels andthus prevent large-scale job creating projects from moving forward.

• Instead of a rule change, Congress needs to enact the overdue multi-year surface transportationprogram reauthorization.

HIGHWAY PROGRAM EXTENDED THROUGH MARCH 4

The continuing resolution (CR) signed by President Obama on December 22 extends the surfacetransportation program and Department of Transportation funding through March 4. This extension is thesixth since SAFETEA-LU expired on September 30, 2009. The House passed a CR funding the entiregovernment through the end of FY11 at FY10 levels, but relented to the short-term measure passed by theSenate that was insisted upon by Republicans who wanted more of a say on FY11 spending once the112 Congress convenes. House Transportation and Infrastructure Chairman-designate John Mica (R-th

Fla.) and Senate Environment and Public Works Chairman Barbara Boxer (D-Calif.) have indicated thatthey plan to make a multi-year reauthorization of the highway program a priority agenda item in the 112th

Congress.
