THE CONSTITUTION 1i
PART 1: PRELIMJNARY
1.1 NAME
The name of this incorporated Association shall be TOWHID ASSOCIATION INC..
1.2 DEFINITION
TOWHID ASSOCIATION INC. ("the Association") is a non~profit cultural and reli-
gious association of West em Australian Shja Muslims. who believe in and endorse the
faith and ideology of Twclver Shia Muslim.
1.3 MISSION
The miss on of the Association is to serve the interests and values of the Australian
Shia Muslim community with their cuhure and religion beliefas Shia Muslim in order to promote their status, build bridges with all other Australians and live in harmony with people of various ethnic and religious backgrounds.
1.4 AIMS & OBJECTIVES
1.4.) To establish facilities for the Afghan community of Westem Australia providing cul- tural activities. \vorship services. educational centres and social functions in order to
preserve and promote the community’s cultural. social and religious values and needs.
1.4..2 To encourage the youth and women \\’itbin tbis community to be .involved .

activities by providing facil ies and support for them and to communicate with other
communities to achieve a common cause.
) .4.3 To communicate with government and non-government organisations to obtain sup- port and facilities to meet the various needs of this community.
1.4.4 To observe and celebrate all major the community cultural events and in the Islamic calendar (e.g. Eid Fetr. Eid Qurban, birth & martyrdom of {he prophet Mohammad
(S.A) and the imams. etc in accordance with the Islamic rules.
104.5 The property and income of the Association shall be applied solely towards the pro- motion of the objects of the Association and no part of that property or income may be paid or otberv"’ se distributed. directly or indirectly. to members. except in good faith in the promotion of those objects.

1.5 THE PRINCIPLES OF ASSOCIATION
t .5.1 The Association does not sponsor~ support or endorse any extreme religious beliefs~ vi01ent or racist behaviour.
1.5.2 The Association all means and ideas that promote the integration of the Shia commu-
nity within the wider Australian community and the achievement of peace and har-
mony through cultural difference.
1.5.3 To establish an education centre and library of reading materials on general informa- tion interests and on Islam and rclevant subjects of interest to Islamic propagation and
knowledge.
1.5.4 To publish a newsletter covering the activities of tbe Association and other matters for the religious and cultural interest on a regular basis.
1.5.5 To maintain a register of marriages, births and deaths of members.
1.5.6 To provide marriage celebration and services for its members and other Muslims ac-
cording to Islamic law.
1.5.7 To provide full funeral arrangements and services for its members and any other Mus-
lims in need of this service.
1.5.8 To offer hospitality and every humanitarian assistance where possible and appropriate to all in need in Australia.
1.5.9 The property and income of the association shall not be linked with any political par- ties, whatsoever and shall be free to seek and receive donations from aJl legitimate sources being real or legal persons for the development and promotion of the Associa- tion’s objectives.
PART 2: POLITICAL LINKS
2. t In order to preserve its non-political status, the Association shall not be linked with
any political parties~ whatsoever and sball be free to seek and receive donations from all legitimate sources being real or legal persons for the development and promotion of the Association’s objectives.
PART 3: POWERS OF THE ASSOCIATION

3.1 The powers conferred on the Association are the same as those conferred by section 13 of the Association Incorporation Act 1987 ("the Act") so that subject to the Act and any additions, exclusions or modifications inserted below, the Association may do all things necessary or convenient for carrying out its objects and purposes and in par- ticular may:
a) Acquire, hold, deal with and dispose of any real or personal property; b) Open and operate bank accounts; c) Invest its money in a security in which trust monies may lawfully be invested or
in any other manner authorised by the Constitution of the Association; d) Borrow money upon such tenus and conditions as the Association thinks fit;
e) Give such security for the discharge ofliabilities incurred by the Association as the Association thinks fit~

f) Appoint agents to transact any business of the Association on its behalf;
g) Enter into any contract it considers necessary or desirable; and
h) Act as trustee and accept and hold real and personal property upon trust. but
does not have power to do any act or things as a trustee that. if done otherwise than as a trustee, would contravene the Act or the Constitution of the Associa-
tion.
PART 4: MEMBERSHIP
There shall be two classes of members namely: Associate Members and Full Members, re-
gardless of the ethnicity, colour or caste. The Executive Committee may require an applicant for membership to present himself or herself in person to the Executive Committee before his
or her application for membership will be approved and confirmed.
4.1 Associate Members:
a) Associate membership is open to all Muslims and non-Muslims, regardless of
their residential status in W.A.
b) Associate Members shall have voting rights at general meetings and other meet-
ings of the Association.
c) Associate Members shall not hold any office on the Executive Committee.
d) Where an Association Member has specialist skills or experience he or she may he invited to join a sub-committee subject to the approval of the Executive
Committee.
e) Associate Members may have access to and inspect the records, documents and
the securities of the Association.
4.2 Full Members:
a) Full membership shall be open to all Associate Members aged 18 & over and shall include those considered practicing as Islarnically mature Muslims ap- proved of by the Executive Committee and who believe in the objectives of the
Association (as specified in this Constitution) and have resided in Western Aus-
tralia for three calendar months.
b) Full members shall have the right to vote at general meeting and special meet-
ings and may nominate for election to the Executive Committee.
c) Honorary membership shall be granted to a person in recognition of his or her
exceptional services to the community on the approval of the Exe.cutive Com-
mittee.
PART 5: THE EXECUTIVE COMMITTEE MEMBERS
5.1 Definition:
The Executive Committee shall consist of seven (7) elected active members and one
(1) Religious Leader appointed by the Trustee Committee~ who wiJI manage the As- sociation’s affairs and perform all matters and issues which are necessary forearrying out the functions and duties referred to in this constitution.

a) The elected otlicers of the Executive Committee shall be practicing Muslims and of good character.
b) The Executive Committee shall have the right to approve or disapprove applica- tions of membership of the Association. In cases of disapproval the Executive

As president of the Serbian Club/Community, I wish to express my support of Towhid Association Inc’s ("your Association") Application for Planning Approval for a Club Premises and Caretaker’s Dwelling for community purposes at 100 (lot 10) Reservoir
Road, Orange Grove.
I am fully aware of your Association’s need for premises of your own to hold your various
social, cultural and training activities, as we have rented (when available) our community centre to your association, since 2002 to hold your functions. We fully understand and
recognise the difficulties your Association has had to face because it has not always been possible for us to rent our premises to your association and you have had to meet
at other less suitable venues. This creates a sense of uncertainty as our community members take precedence over others.
1 understand that the vast majority of your members reside within the suburbs of
Maddington, Gosnells, Kenwick, Beckenham and Southern River. Your average or
regular numbers (including children) at anyone of these meetings range between 150 to 170 members.
I am aware that since 2002 most of your functions/meetings are held mosily over the weekends, though not on every weekend. On rare occasions they were held on a Friday night. The Association may sometimes rent the premises to hold functions for between ,.4-5hours in the late aftemoon on other days of the week. The AssociatiOn has not used
(: the premises for prayers or worship.

Since 2002 till to date, I am not aware of any complaints from our surrounding neighbours as regards noise, traffic or environmental issues associated with your association’s use of our property.
The Serb an Community and I (ully support your association’s application for planning approval and we wish you every success in your application. I fully understand your association’s need for premises of their own as it creates a sense of belonging to and
being part of our adopted country, Australia.
The Serbian Community also felt this need to belong and build community. We then decided to buy a parcel of land, build our community centre and set up a meeting place for members of our Serbian as well as other communities together. This fosters a sense of community for people of various ethnic and religious backgrounds to gather, form
friendships, share food, drink and ethnic jokes.
This would have been impossible if the Gosnells City Council had refused our
development applications, all those many years ago.
