The amounts listed in this schedule are not security release amounts or security release deposit amounts for purposes of, and do not affect security release procedures under, ORS 135.265 . Except for parking offenses, the amounts established in this schedule include moneys for purposes of the unitary assessment established by ORS 137.290 and the county assessment established by ORS 137.309 in addition to moneys for the fine or bail forfeiture. The amounts under this schedule do not include any moneys for restitution or costs. The UBS does not establish any “bail” amounts for misdemeanors or felonies except for major traffic offenses. B. Minimum fines. Some statutes create minimum fines or bails for certain offenses and limit the ability of courts tosuspend, waive, or reduce fine amounts or bails below those minimum amounts. The following are statutes thatcontain provisions of this type and are set out here for the convenience of the user:

1. Courts may not set bail amounts below what is established by the UBS, ORS 1.520,but may lower the actual fine imposed according to their violations bureau’sschedules, ORS 153.800(5)

2. The minimum fines for offenses committed in a “highway work zone” or posted schoolzone. SECTION 6 - GAME AND COMMERCIAL FISHING. Applies to offenses under wildlife laws, ORS chapters 496-501,and commercial fishing laws, ORS chapters 506-513.

The bail amounts for fish and wildlife violation level offenses are set by statute under ORS496.951 and 496.992(2) not as bails established by the Supreme Court under the UBS. They are included in this schedule for the convenience of the user.

The amount which shall be placed on a citation issued by a law enforcement official, is asfollows (neither the Supreme Court nor any other court is allowed by statute to establish abail amount for a violation of an offense in the following other than the amount listed):

NOTE: A change was made in 1997 by 1997 SB 30 to

increase bail amounts for nonresident

licensing provisions of ORS 997.121.

activities, or, except in designated receptacles, leaving, depositing (includingburying or abandoning), dumping, or failure to remove litter, bottles, cans, ashes,waste, paper, garbage, sewage, refuse, scrap, trash.

b. Failure to use developed toilet facilities where provided or to bury all human wasteand toilet paper at least six inches below the surface of ground and the distancefrom the edge of river set by rule when toilets not provided.

3. Vandalism including any picking, cutting, defacing, damaging, removing, or mutilationof any flowers, shrubs, foliage trees, or plant life or structure or facility of any kind witha value of less than $250.

4. Removal of flowers, shrubs, foliage trees, or plant life from any park area withoutpermission from the appropriate authority; digging up, defacing, or removing any dirt,stones, or other substances without written permission of the appropriate authority;laying or setting off any blast without written permission of the appropriate authority;cutting living or standing trees or plants for any purpose; cutting, gathering, ordamaging any dead, living, standing, or down trees or brush.

5. Violating any rule in a manner that endangers persons or property.

6. Hunting, pursuing, trapping, killing, injuring, or molesting any wildlife or disturbing theirhabitats, hunting out of season or in prohibited locations.

7. Use of motor vehicles in prohibited area or without permit when required.

D. Violation of any provision of ORS chapter 390 or rule adopted thereunder described in thissubsection, Class A park infraction.

This subsection applies to rules concerning the following:

1. Engaging in construction or sand or log removal on an ocean beach without a validpark permit.

2. Discharging a firearm.

3. Vandalism or any destruction, picking, cutting, defacing, damaging, removing, ormutilation of plants or property in a value in excess of $250.

4. Building a fire in an undesignated location when extreme fire danger has beendesignated and posted.

E. Violating ORS 390.851, Class B park infraction $100

SECTION 8 - FOREST MANAGEMENT INFRACTIONS. Applies to infractions relating to recreational use of stateforest lands under ORS chapter 530.

A. Violation of any provision of a rule or order adopted under ORS chapter 530 not otherwisedescribed in this section. Class A forest management infraction. $61

B. Violation of any provision of a rule or order adopted under ORS chapter 530 described inthis subsection. Class A forest management infraction.

This subsection applies to rules concerning the following:

1. Disposal of trash and garbage; sewage or petroleum products; household,commercial, or industrial refuse; pollution or contamination of water supplies used forhuman consumption; or improper use of a refuse container or disposal facility.

2. Failure to use toilet or sewage facilities where provided or to dispose of human wasteas specified in the rule when toilets are not provided.

3. Vandalism of any public property, structures, or resources, including plants, with avalue of less than $250.

4. Violating any rule in a manner that endangers persons or property.

5. Hunting, pursuing, trapping, killing, injuring, molesting, or disturbing the habitat of anybird or animal.

6. Operation of motorized off-road vehicles.

C. Violation of any rule or order adopted under ORS chapter 530 described in this section. Class A forest management infraction.

1. Discharging a firearm.

2. Vandalism of any public property, structures, or resources, including plants, with avalue of more than $250.

3. Building a fire in an unauthorized location or in an unpermitted manner during closedfire season.

SECTION 9 - OTHER OFFENSES. The following formula establishes bail amounts for offenses for which theSupreme Court is required by ORS 1.520 to establish bail that are not otherwise described in this schedule.

A. For offenses NOT causing an accident or endangering others: Bail = 40 percent of the maximum fineestablished for the offense by statute added to the amount of statutory assessments, under ORS 137.290 and137.309, appropriate to that base amount.

B. For offenses CAUSING an accident or endangering others: Bail = 60 percent of the maximum fine establishedfor the offense by statute added to the amount of statutory assessments, under ORS 137.290 and 137.309,appropriate to that base amount.

C. For any subject offense where there is a statutory minimum fine that is higher than the percent of statutorymaximum fine used for a base amount under A. or B. above: Bail = the statutory minimum fine established forthe offense by statute added to the amount of statutory assessments, under ORS 137.290 and 137.309,appropriate to that base amount.

WORKSHEETS USED FOR 1997 UBS BAIL AMOUNTS

GENERAL. The Uniform Bail Schedule (UBS) is a formula adopted by the Oregon Supreme Court under ORS1.520. The order requires that the Office of the State Court Administrator send out information from time to time thatreflects the minimum bails as determined by the formula under the order. These worksheets are the basis for thechanges that result in minimum bails under the UBS as a result of 1997 legislation and are being provided along witha UBS Summary to show what amounts of bail result from those changes.

The bail amounts shown in these worksheets and on the UBS Summary are the amount an officer writes on the frontof a citation when issuing the citation, but, except as noted in the UBS summary, do not necessarily determine theamount that a court will impose.

Amounts imposed as sanctions upon a person when conviction for an offense occurs constitute a single assessment,see ORS 137.293.

The UBS does not apply to or establish bail amounts for misdemeanors and felonies except for major traffic offenses. For these major traffic offenses, the “bail” amount is not a security release amount and cannot be posted and forfeitedas “bail” can for an infraction. The sole purpose for creating UBS bail amounts for major traffic offenses is becauseit is required by statute, and certain statutory minimum fines for those offenses are based on the “bail” amounts underthe UBS.

This is the primary cause ofincreased bail amounts for the UBS in 1997.

10-4-97 Creates increased bail amounts and minimum fines for traffic offenses committedin a appropriately posted school zone.
