In accordance with sections 39 and 40 of the Election Act (the Act), by order of theLieutenant Governor in Council, Writs of Election were issued by the Chief Electoral Officeron September 29, 2014, and transmitted to the Returning Officers in each of the fourelectoral divisions with a vacancy. The Writs of Election indicated an election date of Monday,October 27, 2014, in all four electoral divisions.

The electoral division boundaries described in the Electoral Divisions Act (in force onMarch 26, 2012) were used during the by-elections.

LEGISLATIVE AMENDMENTS IMPLEMENTED DURING THE BY-ELECTIONSLegislative amendments consequential to the Election Accountability Amendment Act, 2012which received Royal Assent on December 10, 2012 were implemented in the by-elections.Highlights of the Election Act changes are listed below.

� Students studying away from home, within Alberta, were permitted to choose theplace they reside for their studies as their ordinary place of residence for voting purposes(section 1(2.2))

� Nomination day was changed from the 14th to the 10th day after writ (section 39(c))

� Electors were permitted to inspect nomination papers filed by candidates in theirelectoral division on application to the Returning Officer (section 59(5))

� Persons aged sixteen or seventeen were permitted to be appointed as poll clerks(section 73(1.1))

� Returning Officers were permitted to appoint information officers at each pollingplace to assist electors and maintain peace and order (Sections 1(i) and 75.1)

� Scrutineers were no longer required to reside in the electoral division in which theywere appointed; scrutineers were required to comply with a code of conduct established bythe Chief Electoral Officer (section 79)

� Where an elector was unable to access the polling place due to a physical incapacity,the poll clerk and other election officer(s) were authorized to bring the ballot box to someother place on the polling place site. (section 96(1.1))

� The number of days for the Advance Poll was increased from three days to four(section 98(3))

� Political parties, constituency associations and candidates were required to complywith extended advertising rules and new guidelines established by the Chief ElectoralOfficer (section 134)

� Persons or organizations which conducted election surveys during the election periodwere required to comply with new rules and new guidelines established by the ChiefElectoral Officer (section 135.11)

NEW INITIATIVESThe Chief Electoral Officer introduced several new initiatives in the by-elections to improveservices and to assist Returning Officers in the performance of their duties.

� In accordance with section 4.1 of the Election Act, automated vote tabulators wereintroduced at the Advance Polls to allow for faster, more accurate and detailed reporting ofAdvance Poll voting results.

� In accordance with section 4.1 of the Election Act, voter assist terminals wereintroduced at the Advance Polls to provide disabled electors with an accessible,independent voting option.

� Vote tabulator operators were hired to operate and maintain vote tabulators at theAdvance Polls.

� Poll clerks were provided election training.

� Trainer positions were appointed to assist Returning Officers in the scheduling andtraining of all Advance Poll and Polling Day election officers.

� Online training resources were created by Elections Alberta and provided to electionofficers to assist in teaching the proper method of completing Polling Day forms anddocumentation.

� “Where to Vote” cards were mailed to every elector on the Register of Electors and to everyresidential address that had no electors on the Register, in each of the four electoral divisions.

� Barcodes containing elector identification numbers were printed on “Where to Vote” cards thatwere mailed to electors on the Register of Electors, and in the poll books, allowing for thecollection of statistical and demographic information on voter participation.

� Site monitor personnel were provided upon request at polling places located inschools for added safety and security.

THE BY-ELECTIONSCANDIDATE REGISTRATION AND NOMINATIONIn total, 23 candidates registered with the Chief Electoral Officer in accordance withsection 9 of the Election Finances and Contributions Disclosure Act and all 23 registeredcandidates filed candidate nomination papers in accordance with section 61 of the ElectionAct, as follows:

ADVANCE POLLSBy legislation, Advance Polls were held in each of the four electoral divisions from WednesdayOctober 22 to Saturday October 25 from 9:00 am to 8:00 pm daily. Only one of the fourelectoral divisions held the Advance Polls in the returning offices. Each of the four electoraldivisions provided a single Advance Poll location with up to four polling stations to processelectors within each location.

Automated vote tabulators were installed at each Advance Poll location to record votes andstore ballots. Voter assist terminals were also provided in each electoral division.

Forty-nine election officers were recruited, hired and trained for Advance Polls. Each locationhad a supervisory deputy returning officer, registration officer, information officer, votetabulator operator and one deputy returning officer and one poll clerk for each polling station.

Automated Vote Tabulators and Voter Assist TerminalsThe use of automated vote tabulators for the Advance Polls provided fast and accurate votingresults which were released to the public shortly after the close of polls on Polling Day. Forthe first time, poll by poll results were produced from the Advance Polls. In addition, AdvancePoll staff could be re-allocated by the Returning Officer as election officers on Polling Day.

Voter assist terminals provided a private, accessible and independent voting option, givingelectors the ability to mark their ballot using a braille-coded keypad, a touch screen, pressuresensitive paddles or a “sip and puff” method.

The introduction of automated vote tabulators and voter assist terminals at the by-electionswas highly successful. The tabulators and terminals performed flawlessly throughout the fourdays of Advance Poll voting. The vendor provided excellent service and support to ElectionsAlberta and election officers throughout the by-election preparation and Advance Poll electiondelivery phases of the by-elections.

Stakeholders, including registered political parties and media, were invited todemonstrations on the use of the tabulators and terminals prior to their implementation.Positive feedback was received on their use and deployment during the by-elections. TheCNIB provided their endorsement for deployment in future provincial general elections.

MOBILE POLLSBy legislation, mobile polls were held on Polling Day October 27, 2014 in treatment centresand supportive living facilities with ten or more resident inpatients or electors, whereconsultation with facility staff determine the service to be appropriate.

A deputy returning officer and a poll clerk, along with a facility representative, set up astationary poll in a fixed location, went bed to bed, or both, depending on the situation.

Nine mobile polls were held in 17 facilities across the four electoral divisions on Polling Day.A total of 798 valid ballots were cast at mobile polls.

SPECIAL BALLOT POLLSSpecial ballot polls were held at returning offices in each of the four electoral divisionsthroughout the election period, to facilitate voting for electors who were not able to vote at theAdvance Poll or on Polling Day. Special ballots may be mailed out as requested by the electoror may be completed in the returning office. A total of 580 valid special ballots were cast.

POLLING DAYPolling Day was held on Monday, October 27, 2014. There were 313 polling stations in50 polling locations across the four electoral divisions. Eight hundred and fifty four electionofficers were recruited, hired and trained. Fifteen of these positions were site monitors thatwere requested by the schools rented as polling locations. All 50 polling locations opened ontime at 9:00 am.

On Polling Day, a total of 2,742 electors registered to vote by completing a Declaration ofElector at the time of voting. Polling Day registrations are a good measure of the quality of theList of Electors compiled for use by election officers and political participants. Based on thenumber of names on the list after declarations were added, only 2.06% of electors wereadded when compared to the Polling Day list.

There were 49,676 ballots cast in the by-elections. Over 94% of those who voted in theby-elections were already registered at their current address.

Voter turnout is traditionally low in by-elections and this time was no exception. An average of37.28% of eligible electors cast their ballots during the four by-elections as follows:

POST POLLING DAYThe Returning Officer announced the official results on November 6, 2014. The followingcandidates were declared duly elected:

All four successful candidates represented the Progressive Conservative Association of Alberta party.

Official documents including the Writ of Election and the Returning Officers’ Certificate andReturn certifying each candidate’s election were returned to the Chief Electoral Officer. Theby-election results were published in the November 29, 2014 issue of the Alberta Gazette.

No application was made to the Courts for a judicial recount pursuant to sections 144 or 148of the Act.

All registered candidates met the statutory filing deadline of February 27, 2015, therefore allnomination deposits of $500 were refunded to each of the candidates’ campaigns.

The total cost of the four by-elections was $1,102,243. A cost summary is included on page 49of this Report.

FINANCIAL DISCLOSURERegistered by-election candidates were required to file Campaign Period Financial Statementswith Elections Alberta by February 27, 2015. Disclosure of the candidates’ election expensesare available on our website (www.elections.ab.ca) in accordance with section 4(1)(d) of theElection Finances and Contributions Disclosure Act (EFCDA).

Registered political parties that participated in the by-elections must file audited financialstatements by April 27, 2015. These statements will list funds received, campaignexpenditures and transfer of funds and/or materials.

In accordance with section 11 of the EFCDA, all financial statements will be available forinspection in the public files maintained by this Office and will be posted in summary formon the Elections Alberta website.

AGE AND GENDER STATISTICSPoll books contained barcodes of each elector’s unique identifier to enable the tracking ofstatistics on voter age and gender and allows for statistical comparisons between voters andregistered electors. Age and gender statistics are complete for by-election voters, but there isa gap among registered electors as this information is not currently mandatory. Less than 1%of registered electors in the four by-election electoral divisions are of unknown age and justover 1% are of unknown gender.

Table 1-1 below shows the distribution of those who voted by age group and electoral division.Table 1-2 shows the distribution of registered electors (electors that are pre-registered to vote)by age group and electoral division.

Looking at Table 1-1, the proportion of those who voted increased with age. The 18-24 agegroup made up less than 5% of the total number of electors while the over 65 age groupmade up almost 25%. Looking at registered electors in Table 1-2, the proportion increasesuntil age 54, then decreases. Young voter participation (18-24 age group) was lowest inCalgary-Elbow at 3.41% and highest in Calgary-Foothills at 5.58%.

Inthree of the four electoral divisions a slightly higher percentage of women voted (between3.74% and 4.6% higher). In Calgary-Foothills 0.78% more men voted.

RECOMMENDATIONS FOR AMENDMENTSTO THE ELECTION ACTTEST OF NEW EQUIPMENT AND PROCEDURESNew legislation in force at the 2012 Provincial General Election allowed any elector to votein the three days of Advance Polls. As a result, elector volumes increased by almost 200% in2012. After the 2012 provincial general election, legislation was amended to include afourth Advance Poll day. It is anticipated that there will be another significant increase ofelectors choosing the convenience and flexibility offered by the Advance Poll period at thenext general election.

On July 3, 2014, the Chief Electoral Officer sought and received approval from the StandingCommittee on Legislative Offices to test automated vote tabulators and voter assist terminalsat the next by-election in compliance with section 4.1 of the Election Act.

Four by-elections were called on September 29, 2014. The equipment was successfullyimplemented during the Advance Polls.

On December 5, 2014 the Chief Electoral Officer met with the Standing Committee torequest the use of automated vote tabulators and voter assist terminals in future elections,including the next provincial general election. The request was approved. Legislativeamendments were also requested in order to implement the equipment at the next provincialgeneral election.

The By-Election Procedure for the Use of Vote Tabulators and Voter Assist Terminals is postedon the Elections Alberta website and describes in detail the election procedures andequipment tested during the by-elections.

The following recommendations were provided by the Chief Electoral Officer to the StandingCommittee on Legislative Offices on July 3, 2014 and discussed further on September 4, 2014.The Committee passed a motion on September 10, 2014 to transmit the recommendations tothe Minister of Justice and Solicitor General for the preparation of amendments forintroduction in the Assembly.

COMPREHENSIVE REVIEW OF ELECTORAL LEGISLATIONA comprehensive review of electoral legislation to commence within one year of the nextprovincial general election was recommended for the following reasons:

� Current legislation is very prescriptive, needs to be enabling and written in plain languagethat is easily understood and interpreted

� In order to modernize the electoral process and introduce best practices in electoraladministration to Alberta, new procedures and equipment are necessary

� Elections Alberta has, as part of our mandate, the requirement to “embrace partnershipopportunities and innovative ideas by adopting best practices and new technologies fromthe service, business and election communities”

Recommendations for legislative amendments to both the Election Act and the ElectionFinances and Contributions Disclosure Act (EFCDA) were provided for consideration prior tothe next Provincial General Election. These changes will allow for some modernization ofelectoral administration, strengthen the integrity and accuracy of the Register of Electors andincrease transparency. Recommendations for amendments under the EFCDA were publishedin the 2013 Annual Report of the Chief Electoral Officer. The following pages include only therecommendations put forth for the Election Act.
