1215 – 1345 SESSION SEVEN

The rise of the whistleblower: an inside guideThe role of the whistleblower can polarise us – are they forces of good, unearthing corruption and illegal conduct to be praised or are they malcontented individuals out to grind an axe and publicise ill-founded allegations in order to extract revenge on a company or colleagues who spurned them? Whistleblowers play an essential role in detecting and reporting corrupt conduct yet they are rarely praised and more often, they are ostracised and humiliated, scorned and rejected. This session explores how the role of the whistleblower has developed, the role they play, their value to regulators, how regulators treat them and how they should be rewarded. Their complex story is highlighted by understanding the dynamics of social behaviour and the experiences of the whistleblower in the Australian banknote printing corruption scandal.

International Bar Associationthe global voice of the legal profession

The International Bar Association (IBA), established in 1947, is the world’s leading organisation of international legal

practitioners, bar associations and law societies. The IBA influences the development of international law reform and shapes the

future of the legal profession throughout the world. It has a membership of more than 50,000 individual legal professionals and

205 bar associations and law societies spanning all continents and has considerable expertise in providing assistance to the global

legal community.

Grouped into two divisions – the Legal Practice Division and the Public and Professional Interest Division – the IBA covers all

practice areas and professional interests, providing members with access to leading experts and up-to-date information. Through

the various committees of the divisions, the IBA enables an interchange of information and views among its members as to laws,

practices and professional responsibilities relating to the practice of law around the globe. Additionally, the IBA’s world-class

conferences provide unrivalled professional development and network-building opportunities for international legal practitioners,

senior business professionals, regulators and government officials.

IBA Anti-Corruption Committee overviewIBA Anti-Corruption Committee Overview Building on the good work of the Anti-Corruption Working Group, the Anti-Corruption

Committee was formed in 2007 to provide assistance to private practitioners in the fast-developing area of anti-corruptionlaw.

An active committee is vital as more and more private practitioners are being asked to advise on anti-corruption issues and

investigations, with corporations and their in-house counsel seeking to deal with a growing range of anti-corruption legal issues

and devise creative new compliance programmes. The committee not only brings together lawyers and judges who have a common

interest in this rapidly expanding area of the law, but also seeks to become a source of current information on investigations, cases,

governmental initiatives, literature, and other developments in anti-corruption law and practice. As the committee expands, it will

be exploring a variety of mechanisms through which committee members can access, and can contribute to information about

anticorruption law.

In April 2010, the IBA, in cooperation with the Organisation for Economic Co-operation and Development (OECD) and the UN

Office on Drugs and Crime (UNODC), proudly launched the Anti-Corruption Strategy for the Legal Profession, a project which

focuses on the role lawyers play in international corruption and on how international instruments and extraterritorial legislation

apply to the legal practice.
