The purpose of this District Classification is to establish a zone where property may be usedfor general business and commercial uses and designated industrial purposes of a characterinvolving outdoor storage and operations, as well as fully enclosed storage and operations which donot emanate noise, odors, smoke or light to such an extent as to be a nuisance to, or objectionableto, owners or occupants of surrounding properties and which do not necessarily require large buildingor land area.

In this regard, no building or premises shall be used and no building shall be hereafter erectedor altered in the 'D' Commercial and Industrial District, unless otherwise provided in this Ordinanceexcept for one or more of the following uses:

Any use permitted in the 'LD' Light Industrial District, 'C-2' Local Shopping CenterDistrict, 'C-1' Local Business District and 'P' Parking District. Earth removal, quarrying, gravel processing, mining and related mineral extractionbusinesses; concrete and asphalt crushing operations in accordance with Section11.5.A.7 of this Ordinance.Governmental activities, structures and uses of an essential or seasonal nature limitedto animal control shelters, equipment and vehicle maintenance and minor repair,buildings and grounds servicing shop and county fairgrounds, together with similaraccessory, incidental or related activities or facilities subject, however, to the specificstandards and conditions set forth for such uses under subsection 4 [20.175] of theSpecial Exception Use provisions of Section 4. "B" RESIDENCE DISTRICT of thisordinance and also subject to the standards and conditions applicable to specialexception uses in general.Automobile or vehicle impoundment lots when used in connection with and accessory toa towing service, subject to the following conditions:

The lot shall be surfaced with asphalt, concrete, or other suitable material, theminimum acceptable material being stabilized gravel, and shall be graded anddrained to dispose of all surface water away from adjoining properties.The lot shall be effectively screened on any side which adjoins or faces anyexisting residence, any land situated in any residentially zoned district, or any

fence. Barbed wire strands may be used to provide additional security. Thestrands shall be limited to the upper most portion of the fence and shall notextend lower than eight (8) feet from the nearest ground level. The lot shall belocked at all times other than to allow necessary access.The lot shall be illuminated. The lighting shall be installed in a manner which willnot cause direct illumination on adjacent properties. Lighting shall be completelyshielded from the view of vehicular traffic using the road or roads abutting the lot.The sale, repair and dismantling of vehicles or parts of vehicles stored in the lotshall not be permitted. (This shall not prohibit the sale of vehicles by auction asrequired by law.)Storage of vehicles or portions of vehicles shall not be permitted for more than six(6) months, except when mandated by court order or statute.An impoundment lot must be served by an office located on the same site or asite immediately adjoining the impoundment lot.

Metal recycling operations and salvage yards subject to the following additionalconditions:

The lot or parcel on which the operation is located shall be a minimum of fifty (50)acres.All outdoor storage of inoperable machinery and vehicles or parts thereof shallbe located within an area not closer than one hundred (100) feet from any streetright-of-way line. All outdoor storage shall not be less than twenty (20) feet fromany interior lot line, and a roadway shall be provided, graded, surfaced, andmaintained from the street to the rear of the property to permit free access toemergency vehicles at all times.Any metal crushing operation conducted on the site must be conducted in amanner which is not visible to persons traveling upon a public right-of-way orpersons upon the premises of any adjoining property.All activities connected with the recycling operation, including the distribution ofmaterials, shall be in accordance with the Noise Ordinance of the CharterTownship of Kalamazoo.All activities shall be enclosed by an eight (8) foot solid fence maintained in goodcondition (good repair, free of graffiti, and consistent with the character of thearea, free of handbills, signs, or advertising other than the name of the businesswhich shall be in accordance with Section 12 [20.980] of this Ordinance.)All entrances shall have gates which, when closed, shield the view of theoperation to the same extent as required for the remainder of the fence.The premises shall be maintained in an environmentally safe manner, includingthe proper disposal and storage of hazardous materials.

Concrete and asphalt crushing operations within a gravel mining operation inaccordance with Section 11.5.A.7. of this Ordinance.Composting Facilities and support facilities in accordance with the standards in Section5.5.4.6 [20.515 6.].
