REZONING APPLICANTS RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER

(A) Approval of the proposed rezoning will permit a use that is suitable in view of the use and development of adjacent and nearby properties. The proposed development is a single-family residential neighborhood that will conserve important natural areas. The Property is adjacent to land that is zoned R-100 Modified and is in close proximity to several other single-family residential developments including subdivisions zoned R-75 CSO, OSC, and RZT on Kilgore Road.

(B) The proposed rezoning will not adversely affect the existing use or usability of nearby or adjacent properties. The proposed conservation subdivision is compatible with existing single-family detached residential land uses and surrounding development patterns.

(C) Due to the size, layout, location, and topography of the subject property, the Applicant submits that the subject property does not have reasonable economic use as currently zoned.

(D) The proposed rezoning will not result in an excessive or burdensome use of the infrastructure systems. The subject property is located off of Kilgore Road with access to utilities. As set forth in the Gwinnett County Unified Development Ordinance, one of the main goals of the OSC zoning classification is to "reduce infrastructure maintenance costs as a result of efficient community design."

(E) The proposed rezoning is in conformity with the policy and intent of the Land Use Plan. The Property is within the Established Neighborhoods Character Area for which the 2040 Plan specifically encourages "single-family residential" and "conservation open space subdivisions."

(F) The Applicant submits that the single-family residential nature of the area, the fact that the Property is in close proximity to other conservations subdivisions, and the Property's proximity to Interstate 85, Interstate 985, and the Mall of Georgia provide additional supporting grounds for approval of this Application.

REZONING APPLICATION OF WALKER ANDERSON HOMES, LLC

Mahaffey Pickens Tucker, LLP submits this Letter of Intent and attached Rezoning

Application (the "Application") on behalf of Walker Anderson Homes, LLC (the "Applicant")

for the purpose of requesting the rezoning of an approximately 19.8 acre tract of land (the

"Property") situated on the north side of Kilgore Road just north of the Mall of Georgia. The

Property is currently zoned RA-200.

The Applicant is requesting to rezone the Property to the OSC zoning classification in

order to permit the development of the Property as an open space conservation subdivision

including a total of 49 single-family detached homes. The proposed community would include a

mixture of ranch and two-story homes with a minimum of 2,000 square feet of heated floor area

for the ranch homes and 2,200 square feet for the two-story homes. Homes in the community

would include two-car garages and attractive building materials commensurate with homes in the

surrounding area with a mixture of brick, stone, and/or fiber-cement shake or siding as depicted

on the building elevations submitted with the Application. The proposed development would

also set aside approximately 6.43 acres of open space which is about a third of the Property's

overall area. The proposed development would also provide a fifty-foot wide conservation strip

around the perimeter of the Property providing appropriate buffering for adjacent subdivisions.

The development also provides a fifty-foot setback along Kilgore Road protecting the aesthetics

of that roadway.

The proposed development is consistent with the encouraged land use policies set forth in

the Gwinnett County 2040 Unified Plan (the "2040 Plan"). The subject Property is designated as

within the Established Neighborhoods Character Area for which the 2040 Plan encourages a

variety of housing options. Moreover, the 2040 Plan specifically encourages "Conservation Open

Space Subdivisions" as a potential development type. One of the main purposes of the OSC

zoning classification is to "enhance land, water, air, and tree resources by minimizing the area of

land disturbance, reducing impervious surface, optimizing stream buffers, preserving tree cover

and encouraging retention and conservation of natural resources in common areas." The

proposed development achieves precisely that by allowing typical single-family residential

densities while keeping land disturbance focused on the central portions of the property. The

proposed development would be a quality development that is compatible with development in

the surrounding area. The proposed development would also preserve important green space in a

growing area of Gwinnett County.

The Applicant and its representatives welcome the opportunity to meet with staff of the

any concerns relating to the matters set forth in this letter or in the Rezoning Application filed
