RecommendationBerlin 3 Open Access (Feb. 2005)

In order to implement the Berlin Declaration institutions should:

• implement a policy to require their researchers to deposit a copy of all their published articles in an open access repository and

• encourage their researchers to publish their research articles in open access journals where a suitable journal exists and provide the support to enable that to happen.

• Max Planck Society• The Max Planck Digital Library (MPDL) as central service unit is

involved in the BMBF funded project eSciDoc that provides a scholarly workbench as environment for electronic publishing, but also serves as the society‘s repository.

• Helmholtz Association• Strong interest in supporting SCOAP3 as well as in open access to

research data.• Leibniz Association• A working goup just prepared an open access policy taking into

account the different needs of the very diverse institutes within the organisation that shall be issued by the end of 2007.

• German Rectors‘ Conference• issues papers and recommendations, organises workshops to inform

and influence the university‘s top management.• Fraunhofer Gesellschaft• puts special emphasis on the „green road“ and is interested in using

the repository‘s contents for internal control and steering mechanisms.• German Research Foundation• funds various projects that aim at providing an efficient and

• "The DFG expects the research results funded by it to be published and to be made available, where possible, digitally and on the internet via open access. To achieve this, the contributions involved should either be deposited in discipline-specific or institutional electronic archives (repositories) following conventional publication, or should be published in a recognised peer-reviewed open access journal.

• When entering into publishing contracts scientists participating in DFG-funded projects should, as far as possible, permanently reserve a non-exclusive right of exploitation for electronic publication of their research results for the purpose of open access. Here, discipline-specific delay periods of generally 6-12 months can be agreed upon, before which publication of previously published research results in discipline-specific or institutional electronic archives may be prohibited.

• In order to determine the acceptance and use of open access publications in the German scientific community, the DFG designed a survey to identify the publishing habits of researchers and their means of accessing information. This data was also used to reveal whether discipline-specific trends exist.

„In the future, publications of the Helmholtz Association shall without exception be accessible for free, unless opposed by agreements with publishing companies or others. Therefore, the  General Meeting assigns the Research Group for Librarianship and Information Management the Coordination Committee for Data Handling (KODA) to commonly develop a proposal until February 2005 of how to make publications and data of the Helmholtz Association freely accessible in the future.”

The Federal Council• § 38 Abs. 1 UhrG (German IPL) should be

ammended as follows:• “Concerning scientific publications in

periodicals, which have been created during an employment with scientific or educational background being funded predominantly by public grants, the author (creator) has the right to publish the contents elsewhere, even if exclusive license is granted, at least six month after the first publication, without any commercial purpose and different from the layout of the first publication. This right cannot be ceded.”
