GENERAL All licensed vehicles must comply with Section 385 of the Vehicle and Traffic Law, which limits the weight of vehicles or combinations of vehicles. It authorizes the Commissioner to grant permits for the operation of vehicles with weights in excess of the general limitations provided. Licensed construction vehicles will be in nominal compliance if they observe the payload limits shown in Exhibit 105-12A. Divisible Load and Special Hauling permits, which may be required in order to legally transport equipment and/or materials to a contract site, are issued through the Department Central Permit Office. II. PERMITS Different limits are appropriate for each type of permit and vary with the length of wheel base. Adjustments may be made if the tare (empty) weight of the vehicle is known to be significantly different from the assumed tare weight. Vehicle tare weights and GVW may be determined from manufacturer data plates placed on the door frames of most vehicles. Licensed vehicles, under the control of the Contractor or carrying materials for incorporation in the work, should not be allowed to operate within the contract limits if they are overweight. The Contractor will strive to haul the maximum allowable on each load. Even under the best of controls and intentions an occasional overload may occur. Weight limit enforcement by the EIC is expected to prevent damaging overloads and to prevent damage to work to be accepted under the contract. Weight limitations are a legal requirement of the Vehicle and Traffic Law for the protection of public streets and highways. III. CONTRACT OPERATIONS For non-licensed vehicles, the EIC may allow in writing, loads in excess of those allowed by the Vehicle and Traffic Law. Such authorization, if given, should be limited to short sections for a restricted period of time when feasible alternatives are not available. Adequate measures for the protection of the pavement or structure, including but not limited to earth blankets of sufficient depth, heavy wood planking, or other means as appropriate, must be prescribed and enforced. Load restrictions do not apply to on-site operations, such as earthwork, which are confined exclusively to the contract site and which do not affect pavement courses or structures which form part of the completed work. During the preconstruction meeting the Contractor should be reminded of the load restrictions, including any special weight limitations on existing structures within the contract limits. 1. Where trucking is to be over pavements or structures to be preserved within the contract limits, determine the payload limits that can be hauled. 2. Make periodic checks of hauling equipment, permits and loads to determine compliance. This can be done readily for deliveries of hot mix asphalt and portland cement concrete by checking permits and truck tickets. Volumetric/density computations of load can be used with other materials. 3. Where it is found that a hauling unit is overloaded or equipment is overweight, the Contractor should be directed to promptly make any necessary correction in loading or provide haul roads or adequate protection, as appropriate. Subsequent overweight deliveries should not be accepted at the contract site for incorporation in the work. 4. If overweight problems continue, the EIC should take immediate active steps to gain compliance. 5. Prior to authorizing isolated construction equipment overloads, the Region should prescribe conditions which will adequately protect the work. Main Office concurrence should be sought when structures or other than pavement crossings are involved.
