Introduction
Z. On 9 June2010, he AppealsChamber,pursuanto Article 28 of the Statuteof the Tribunal,
issued n Order n which it instructedhe Registrar, n an urgentbasis, o:
o request the assistanceof Rwandan authorities for the purpose of obtaining all
informationrelating o the exactnatureandbasisof the chargesbroughtagainstPeter
Erlinder;
o report o the AppealsChamberonthe outcome f this request; nd
o provide any information to the Appeals Chamber hat is furnished by Rwanda n
responseo this request.
3. On l0 June2010, the Registrar eported o the Chamberon the actions aken vis-d-visMr.
Erlinder's arrestand attachedall official exchanges etween he Tribunal and the Rwandan
authoritieson this issue. n particular, t is recalledhat upon receiptof a decision endered y
the High Court of Gasaboon the bail hearing or the Erlinder's caseon 7 June2010, he
Registrar equestedhe Rwandanauthoritieso providehim with a formal copy of the charges
levelledagainstMr. Erlinder. t is also ecalled hat, ollowing the AppealsChamber's ecision
instructing he samediligence, he Registrar ransmittedanother equest o the same effect,
alongwith copies f theAppealChamber's ecision.l

4. In compliancewith the above ecalled nstructions,he Registrarwishes o inform the Chamber
that a responserom the Rwandanauthoritiesas well asa formal copy of the charges rought
againstMr. Erlinderhasyet to be received.
5. In the meantime,mindful of the urgent and delicatecircumstances,he Registrarseized he
Office of Legal Affairs regarding he possibility for the ICTR to assert mmunity for Mr.
Erlinder on the basis of the decision endered y the High Court of Gasabo, bsenta formal
copy ofthe charges. t appears,n fact, from the decision, hat part ofthe reproachesevelled
againstMr. Erlinderderives rom the wordshe spokeand statements e made n his casebefore

Following the arrestof ProfessorErlinder, the ICTR soughtclarification from the
Rwandanauthoritieson the motivesof this arrest hrough ts Note Verbale of 3l May 2010.
This requestdrew from the need or the ICTR to ascertainheapplicabilityof any immunity
or privilege which DefenceCounselassignedo casesbefore this Tribunal enjoy in the
contextof their mandate.

Having subsequentlyearned hat ProfessorErlinder underwenta hearingbefore he
High Courtof Gasabo,he Tribunalrequested,n 9 June, he Rwandanauthoritieso provide
a formal copy of the charges eveled againstProfessorErlinder. On 10 June,the ICTR
transmitted notherNoteVerbale o the sameend n compliancewith an orderof the Appeals
Chambersitting in the caseof Mayor Ntabakuze. he Chambers'decisionwas atiached o
that NoteVerbale.
In themeantime,he ICTR receivedhedecisionon the bail hearing or the Erlinder's
caseheld on 7 June 2010 before the High Court of Gasabo.The ICTR notes that the
Prosecution ppearingbeforethe High Courtmade specific referenceso words Professor
Erlinder spokeand statements e made in his case before the ICTR. Excerptsof those
