    ORDER

    This matter comes before the court for trial on the charge of interference with official acts. The stateof Iowa appears by County Attorney Ben Smith. Defendant does not appear nor anyone on his behalf.The record reflects that the defendant was properly advised of the trial date and has voluntarilyelected not to appear and contest the charge. The court notes that at the time of the defendant's initiaappearance it advised the defendant than in the event that he entered a guilty plea that the court

    intended to impose a 10 day jail sentence and rather than accept that plea situation he elected toplead not guilty so that he could confer with his father about the matter.

    This matter then proceeded to trial. Testifying on behalf of the state was Brian Mentzer, the arrestingofficer.

    Having heard the evidence presented, the court finds that the officer's decision to place handcuffson the defendant was well within his discretion in order to secure the scene of his investigation andto prevent any altercation between the defendant and Tyler Dungan. The court further finds that thestate has met its burden of proving beyond a reasonable doubt that the defendant interfered with theofficer's attempt to secure the scene and therefore is guilty of the crime of interference with official

    acts.

    Because the defendant was not present the court defers sentencing in this case until September 29,2014 at 11:00 AM. The defendant shall be present at that time.
