The Congress had yesterday demandedsacking of Telecom Minister for his "incom-petence" in resolving the issue of frequentcall drops experienced by consumers.

Congress General Secretary ShakeelAhmed had said it was becoming difficult totalk on mobile "for even five seconds" andthe problem was more in the networks ofstate-owned MTNL and BSNL.

Responding to the Congress' charge, MrPrasad said, "Call drop is also a legacy of pre-vious government. We inherited it. The weak-ness in telecom sector that came due to lackof monitoring...call drop came from otherfactors... lack of network improvement, opti-misation of network equipment."

The Minister added that BSNL and MTNLwere making profit in 2004 till the time thethen NDA government was in power, but thetwo firms became loss-making in 10 years ofthe Congress rule.

"BSNL's profit was Rs. 10,183 crore in2004 and after ten years, when we came back,BSNL was suffering a loss of Rs. 8,234 crore.Who is responsible for this. Will theCongress party government give answer tothis? MTNL in 2004 was in profit of Rs. 938crore and in 2014, it was suffering a loss ofRs. 2,843 crore," Mr Prasad said.

Call Drops Problem...Aircel, Idea, Vodafone and Tata Tele among

those having contained the problem, he saidnearly half of the defective mobile sites havebeen fixed to address the menace.

Addressing a press conference on the issueof call drops, the Minister said a total of34,460 mobile sites were found to be defec-tive, out of which 16,962 were fixed in thethird week of September.

As per the data shared by the Minister,17,498 sites still needed to be repaired acrosscountry.

As per the data, Aircel's network accountedfor the maximum number of sites found to bedefective, with 5,741 cells, about one-third ofthe total, that needed to be fixed.

Idea Cellular is required to fix 3,468 cells,Vodafone 3,344, Bharti Airtel 2,159, TataTeleservices 1,881, Telenor 530, RelianceCommunications 33, VideoconTelecommunications 46, Quadrant 81 andSistema Shyam Teleservices 65.

The operators have said they would try tofix these defective cells by next month, theMinister said, while adding that the compa-nies feel they must resolve the problem as itwas a matter of credibility for them.

Without giving any direct answer on penal-ising the erring telecom operators, Mr Prasadsaid that the regulator TRAI was working ona framework about incentives and disincen-tives linked to call drops and the government

would consider it as and when the recommen-dations come in.

TRAI has said that the recommendationscan come in by mid-October, although opera-tors have been opposing any move to com-pensate the consumers on the basis of calldrops.

Rohini and Justice Jayant Nath alleged that thecatering companies were charging arbitrarilyand not complying with the rates prescribed inthe circular issued by the Ministry ofRailways, to the prejudice of the common pas-sengers who were being over charged.

The court has fixed hearing on the publicinterest litigation (PIL) on November 18.

Doctor Sanjay Gupta, in his PIL, said exor-bitant rates were being charged for food andbeverage items on trains by the caterers.

"The money involved could be in thousandsof crores, once the matter is investigated. Sincethe catering companies are not issuing bills tothe buyers, there is bound to be tax evasion bythe companies, depriving the exchequer ofvaluable tax.

"The receipts issued by the caterers in differ-ent trains are in similar layout and printing,indicating that most caterers are common orhave formed a cartel," the PIL said.

The petitioner said that in 2012, Railwayshad released an elaborate circular pertaining tocatering services and prices. "The circular alsostated categorically that under no circum-stances, the railway should charge differentrates as rates of these items are determined atthe Railway Board level," he said.

The petitioner also urged the court to seewhether the caterers were complying with thecircular, whether they issued bills of fooditems sold by them to on-board passengers andwere paying all applicable taxes on the entiresales made by them on the trains.

He said that while undertaking railway jour-neys, he found that caterers were not charginguniform rates prescribed by the railways,which was "totally arbitrary and in flagrantviolation of the said circular".

While seeking action against officials andthe catering companies, the plea said that therailways have "not bothered to rectify the pro-cedure resulting in routine loss to the citizenand to the exchequer".

The plea also sought direction to theMinistry to "initiate awareness programme forthe passengers".

Enforcement Directorate...fresh case under the Prevention of Money

Laundering Act (PMLA), proceedings againstthe businessman will now be carried out undercriminal laws as against the current ones beingconducted under the Foreign ExchangeManagement Act (FEMA) and Income TaxAct which are civil in nature.

Officials said the agency slapped the freshcharges after taking cognisance of the I-Tdepartment's charge sheet (also called prosecu-tion complaint) against Qureshi in theiralleged tax evasion case in a local court heresometime back.

"The new rules notified by the agency statethat in any case if the prosecuting agency (taxdepartment here) has filed a complaint in acompetent court and the court has admitted it,such a case can be taken up for probe underPMLA," they said.

The ED has taken over this case underFEMA early this year after the I-T departmentshared documents indicating hawala andalleged contravention of forex laws by thebusinessman and his business entities basedhere.

The ED had alleged that Qureshi has sent"huge amount of funds" through the hawalaroute to Dubai, London and few other overseasdestinations in Europe.

The agency early this year had also conduct-ed searches on Qureshi's premises and had alsoquestioned him. It is expected that he may besummoned again for questioning and his assetsmay be attached as part of the fresh proceed-ings under money laundering laws.

The I-T department, during its probe, hadfound Qureshi had 11 bank lockers whichwere in the names of his employees and asso-ciates but the articles belonged to the business-man. The lockers were operated by theemployees of AMQ Group of Qureshi claim-ing that over Rs. 11.26 crore in cash and jew-ellery worth over Rs. 8.35 crore were found inthese lockers.

Consultation Seminar...process of drafting a policy after 29 years."No country in the world had done such a

long process or it had shared experience fromall the quarters to draft an education policy, butwe will do it and Gujarat has already taken thelead in this (in form of consultation),"Bhupendrasinh Chudasama, state educationminister, said in the event held at theKnowledge Consortium of Gujarat (KCG)campus here.

According to the minister, the consultationprocess on primary education has been con-ducted in around 12,304 out of 14,049 villagesin the state. In the higher and technical educa-tion segment, the process has been conductedin 188 out of 224 blocks, and in 19 out of 26districts have been completed.

Mr Chudasama also spoke about how thecountry and the state are far behind in GrossEnrollment Ratio (GER) in comparison withthe developed countries. He said, "Gujarat hasGER of 21 per cent, while the country hasGER of 20 per cent, but if you compare it withthe developed countries, then we are farbehind. The GER in those developed countrieswould be more than 50 per cent. We need tothink on this as well."

The minister also said the government mustreconsider its proposed 'No Detention Policy'.

"I insist to reconsider this act. This isGujarat's message to the Union government.Because, if you do not fix the accountability ofthe teacher, then I think he will not teach prop-erly. There must be changes in the NoDetention policy," Mr Chudasama said.

In an appeal to academicians Mr Chudasamaalso said the new education policy should besuch which made countrymen reliable, disci-plined, patriotic and honest.

Representative of Union Human Resourceand Development (HRD) Ministry, ShakilaShamsu said the new education policy is beingdrafted and it is likely to be introduced byDecember this year.

A bench, headed by Justice V K Jain, issuednotice to the government on the company'splea and sought response by October 8. It alsoissued notice to Nestle on a separate pleafiled by the government seeking further test-ing of Maggi noodles.
