2020 POOL REGISTRATION

Enclosed is your registration application for the upcoming pool season. Please read the enclosed information carefully. The following registration fees apply: Membership Type

(ALL pool passes are valid for current season only- season passes are non-refundable) REGISTRATION FORM MUST BE COMPLETED, IN FULL. RELEASE OF LIABILITY MUST BE SIGNED BY ALL PASS HOLDERS. ALL PAGES MUST BE RECEIVED WITH APPROPRIATE PAYMENT. ANY MISSING INFORMATION OR SIGNATURES WILL RESULT IN REGISTRATION BEING DELAYED AND/OR HELD FOR ALL PASS HOLDERS IN THE HOUSEHOLD.

MEMBER PASSES/PHOTO REQUIREMENTS – Member (season) passes are non-refundable and non-transferrable. Picture passes will be issued for all season passes. 2020 PICTURE GUIDELINES: Adults who were pool members last year will NOT need new photos. All minors (UNDER 18) will require new photos for passes. Pictures are to be taken by applicants, against a light color wall or door ONLY, and emailed to the office for processing – [email protected]. GUEST PASSES – Guest passes will not be issued this season PAYMENT – To receive your pool passes, complete and return all pages with appropriate payment. A separate check must be made payable to WECA (do NOT combine on the same check or include with your dues payment). These payments are processed differently and if you include your pool fees with your dues payment, your check will be returned, and passes will be delayed. Registration forms received without proper payment will not be processed. PROCESSING TIME – Allow 5 business days, minimum, from the date of receipt of your application, for passes to be processed. The office is closed to in person contact. You may drop off (drop box) or mail your application with payment, and you will be notified when your passes are ready and theyhave been given to the lifeguards. Due to late season opening, we will be striving to get passes completed as quickly as possible. DELIVERY – You will be notified by the office when they are available for pick-up from the lifeguards. DO NOT enter the pool facilities until you have been notified that passes are completed. MEMBERSHIP CUT-OFF – Season passes will NOT be sold after Friday, 8/28/20.

There will be no admittance to the pool area without proper passes - NO EXCEPTIONS

POOL RULES AND REGULATIONS POOL HOURS: 12:00 pm - 8:00 pm DATES: Saturday, July 4th – opening day – Monday, September 7th

September 8th (Tuesday) – POOL CLOSED FOR SEASON ** Dates are subject to change in the event the CASD calendar is adjusted and/or pandemic declarations are amended **

The WECA Pool is a private community pool. Membership is exclusive to owners and permitted owner assigned occupants (registered tenants) only.

Members must sign in and present photo pass to the Lifeguard EVERY DAY. Guests must sign in and submit guest pass and signed liability release to the Lifeguard. Guest passes are issued for

single day use only. No more than two guests admitted per individual Member, or four guests per family. Adult member must be present

at all times with their guests. No Smoking – no smoking is permitted inside the fenced pool area. This includes cigarettes, cigars & pipes (all tobacco). Clubhouse rental does not include use of the pool. Pool is open to members only – (2) guests maximum per member. Swimming is allowed only during pool hours and only when Lifeguard is on duty. Appropriate swimwear is required. No shorts or cut-offs allowed. Pool passes must be available at all times, for presentation upon request by a lifeguard, Board Member, or WECA Staff. Children, under age 15, must be accompanied by an adult member, AT ALL TIMES. If the Parent/Adult leaves the gated

area, so must their children less than 15 years of age. Parents/Guardians are responsible for watching children in the baby pool & must be present with them AT ALL TIMES. Babies must wear “swimmies” (waterproof swimming diaper) – NO EXCEPTIONS Children, age 5 and older, are NOT permitted in the Baby Pool No Alcoholic Beverages permitted. No Glass Containers permitted. No Loud Music – if it can be heard throughout the pool area – it’s too loud. Portable (battery operated) devices only – nothing is to be plugged into the pool house outlets. No Barbecues (unless organized and operated by the WECA Board). No Running or Horseplay. No water guns, water splash balls, water bombs or the like No Bikes or skateboards permitted within the pool gates. Lifeguard has the right to revoke any pool privileges at his/her discretion. Lifeguard and/or Pool Management Company have the authority to close the pool at any time due to weather, pool

condition, or equipment failure. Lifeguards are here to protect members and their guests. Sitting/Loitering at Lifeguard table is strictly prohibited. If Lifeguard asks you to leave you must leave immediately. Please contact the WECA office with any issues regarding the pool. By obtaining a pass you acknowledge you are

swimming at your own risk. Lifeguards are not babysitters, please do not ask any lifeguard to watch a specific child/person for any reason;

especially to go to the bathroom, run home, or to go to your vehicle. If the lifeguard is watching your child they are not watching the people in the pool. Adult member must be present at all times with their children.

POOL PRIVILEGES WILL BE REVOKED FOR NON-PAYMENT OF DUES DURING THE SEASON. BREAKING OF ABOVE RULES MAY RESULT IN SUSPENDED OR REVOKED MEMBERSHIP BY LIFEGUARDS OR WECA BOARD, WITHOUT WARNING OR

NOTICE.

SWIMMING POOL RELEASE OF LIABILITY AND ASSUMPTION OF RISK RELEASE AND WAIVER OF LIABILITY FOR USE OF THE WEDGWOOD ESTATES COMMUNITY ASSOCIATION (WECA) RECREATION CENTER & SWIMMING POOL. PLEASE NOTE, THE WECA POOL IS A PRIVATE COMMUNITY POOL. MEMBERSHIP IS EXCLUSIVE TO OWNERS AND PERMITTED OWNER ASSIGNED OCCUPANTS ONLY. I recognize that the use of recreational facilities, including the Wedgwood Estates Swimming Pool, and all equipment and facilities contained therein (collectively, the "Recreation Area"), have inherent risks of injury. I, my spouse, assignees, heirs, guardians, guests, and legal representatives (collectively referred to as “Me”, “I”, “Myself”, “My”) hereby voluntarily indemnify, release from liability, agree to defend and hold harmless Wedgwood Estates and its officers, directors, members, employees, agents, representatives, and any department, organization or group affiliated therewith (collectively "WECA") for any accident, injury, illness, death, loss, theft, damage to person or property, or other consequences suffered by Me arising or resulting directly or indirectly from My use of the Recreation Facilities, including but not limited to claims arising from or related to WECA's negligence and/or products liability, including strict products liability. In the event that I am injured, I agree to assume any financial obligation, either through my health insurance, or through some other means, for any medical costs that I incur. WECA assumes no responsibility for any medical expenses, injury, or damage suffered by Me in connection with My use of the Recreation Facilities. I further agree that I, my spouse, assignees, heirs, guardians, guests, and legal representatives, will not make any claim against, sue or attach the property of WECA for any loss or damage resulting from My use of the Recreational Facilities. I am aware of the potential dangers incidental to recreational sports activity and that this is a release of liability, a waiver of my legal right to collect damages in the event of injury, death or property damage, and a contract between WECA and Me, and I sign it of my own free will, and on behalf of my family, guests and myself. I expressly agree that this release is intended to be as broad and inclusive as the State of Pennsylvania will allow and that if any portion is held invalid, I agree that the balance shall, not withstanding, continue in full legal force and effect.

2020 COVID Liability Waiver

Everyone in your household 18 years and older who is requesting an adult pool pass must complete and sign this form (last page) and the entire form must be returned with your application!

The Wedgwood Estates HOA Board is monitoring the government response to the COVID-19 outbreak. As of now, state and local guidelines allow us to open the pool for use this season. By using the Wedgwood Estates HOA Pool Facility, you understand that there is a possibility of the spread of viruses, including COVID-19, and by being at the pool facility you are doing so at your own risk.

To ensure safety of our facilities:

1) Bathrooms will be closed. 2) No pool furniture will be provided. You may bring your own chairs or blanket to sit on, and you must

take all items with you when you leave. Items left behind will be disposed of at the end of the day. 3) You are required to maintain 6’ social distancing at all times within the HOA pool facilities.

The pool will be closely monitored to maintain the CDC's recommended chlorine levels. As of now, the CDC states that pool water kept at appropriate chlorine levels is not shown to allow COVID-19 to be passed on from person to person while in the pool. If this changes for any reason, we will need to close the HOA Pool Facility to comply with government guidelines, without notice.

Assumption of Risk:

For the 2020 pool season, if you choose to use the HOA Pool Facility in Wedgwood Estates, you are stating that:

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family, including child(ren), and I may be exposed to or infected by COVID-19 while on site at the pool and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

I understand that the risk of becoming exposed to or infected by COVID-19 at the pool may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Wedgwood Estates, the Wedgwood Estates HOA Board, Pool Committee members (paid and volunteer), pool management company’s employees, volunteers, and other participants/attendees and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, my family and my child(ren) may experience or incur in connection with attendance at the pool or participation in pool activities (“Claims”).

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Wedgwood Estates, the Wedgwood Estates HOA Board, Pool Committee members (paid and volunteer), and the pool management company and their employees, agents, and representatives, and their families, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereof.

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Wedgwood Estates, the Wedgwood Estates HOA Board, Pool Committee members (paid or volunteer), or other individuals acting on behalf of the Wedgwood Estates HOA Board, the pool management company and their employees, agents, and representatives and their families, whether a COVID-19 infection occurs before, during, or after participation in pool facility activities.

Additional and Amended Rules for 2020 Season

To comply with CDC guidelines, we ask that anyone using the HOA Pool Facility to follow these additional rules for the 2020 pool season:

1) If you have a cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, new loss of taste or smell, and/or red swollen fingers and/or toes, do not enter the pool area. If you have been in contact with anyone that is sick with COVID-19 or other communicable virus or illness, or if you have family members living in your household that are sick with COVID-19 or other communicable virus or illness, do not come to the HOA Pool Facility.

2) Please maintain 6’ distance between you/your family and others in the pool, and in the pool enclosure.

3) To keep the amount of people at the pool to a minimum and to allow full access to our HOA members, we are NOT allowing guests or visitors to be brought into the HOA Pool Facility at this time. No guest passes will be issued this year.

4) There will be a occupancy limit at 50% capacity. Limit of members in the pool enclosure will be enforced by the lifeguard on duty, and/or HOA board appointed member. Once occupancy capacity has been reached, the first members signed in on the daily register will be asked to leave the pool facility. Members are asked to be cooperative with this process, and sign in and out of the register.

5) On busy days, residents may make a maximum of (2) visits per day.

6) Food and drinks are permitted, but all residents must clean up after themselves, and all trash must be taken home with you when you leave.

7) Diapers cannot be changed in the pool enclosure.

8) No Pool toys, rafts or floats are allowed in either the baby (wading) pool or the main pool. Personal flotation devices for children that are attached to the child are allowed. Pool noodles are allowed; however, they must remain in your assigned area when not in use, and they must be taken home with you.

9) Anyone with an adult pass (15 years and older) may come to the pool by themselves.

10) Anyone with a child pass (younger than 15 years) must be accompanied by their parent or guardian. Please do not bring neighbor’s children with you. Everyone entering the pool together must reside in the Wedgwood Estates residence listed on the pool passes.

11) Pool attendees must bring their own chairs or blanket and sit at least 6 feet apart from other families.

12) Masks must be worn by everyone over two years of age, coming in or out of the pool enclosure, when walking around the pool enclosure and when interacting with gate keeper or lifeguard.

13) Any resident not adhering to these rules, as well as the general pool rules, may lose their pool privileges for the 2020 Pool Season, without warning or notice.

14) Sanitize your hands and the hands of those in your care frequently while at the HOA pool facility. Sanitizer will not be supplied, bring your own supply with you.

15) If anything changes concerning the pool use for the 2020 season, we will be sure to notify you. If government declarations should change, and facilities are limited or forced to close, there will be no refunds for proration of season, and/or non-use of HOA pool facilities.

Please return this entire agreement signed and dated by everyone obtaining an adult pool pass. Adults are signing for themselves as well as their child(ren):

I am sufficiently informed about the risks involved in using the Wedgwood Estates HOA pool to decide whether to sign this document; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Waiver of Liability shall be governed by and construed in accordance with Pennsylvania law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole. This waiver remains in effect until the State of Pennsylvania lifts all COVID-19 related mandates.
