Антикорупциско право се оптира како опционен предмет од
страна на студенти на втор циклус студии.
10. Цели на предметната програма (компетенции):
Во рамки на предметот Антикорупциско право студентите од насоката Административно право и
Јавна администрација ќе се здобијат со можност да се запознаат со начините за спречување на
корупцијата кои се утврдени во правната регулатива на Република Македонија и во меѓународните
документи, особено имајќи ја предвид Конвенцијата на Обединетите нации против корупцијата
(United Nations Convention against Corruption) ратификувана од страна на Република Македонија во
2007. Студентите притоа ќе ја осознаат и институционалната рамка за спречување корупција во
нашата држава: независни државни органи за спречување корупција во јавниот сектор (Државната
комисија за спречување на корупцијата), внатрешни контроли (односно механизми за надзор),
обвинителство и судство. Во вториот дел, студентите ќе ги изучат најзначајните меѓународни акти,
стандарди и иницијативи за сузбивање корупција во јавниот сектор [во рамки на ООН, Европската
унија, Советот на Европа – Група на држави против корупцијата (ГРЕКО), ОЕЦД и слично]. Оттаму,
се очекува дека студентите ќе:
- ги зајакнат своите познавања и вештини на примена на антикорупциското законодавство,
така што тие по завршувањето со предметот би биле подготвени не само да истражуваат на
темата туку и да даваат правни совети и информации на жртви на корупција како и на други
лица на кои ѝм се потребни;
- ги разграничуваат превенирањето на корупција во јавниот сектор и постапките и мерките за
казнување на коруптивни активности;
- направат дистинкција помеѓу методите за спречување судир на интереси од една страна и
оние за спречување корупција во вршењето работи од јавен интерес од друга страна;

- се здобијат со знаења за важноста на слободниот пристап до информации од јавен карактер,
односно на принципот на транспарентност како алатка за спречување или откривање на
корупција и
- се стекнат со познавања за заштитата на укажувачите.
Студентите ќе бидат остручени за работа во јавните органи, во Државната комисија за спречување
на коруцијата, меѓународните (владини и невладини) организации, односно судовите,
обвинителството и сл. Тие ќе можат да работат на сите работни места во институциите поврзани со
спречување на конфликт на интереси и корупција.

Содржина на предметната програма:
Во рамки на предметната програма се изучува антикорупциското право во Република Македонија, но
и на меѓународно ниво, како посебна (специфична) правна гранка која во себе во голема мера опфаќа
управноправни правила. Имено, фокусот на Антикорупциско право е ставен на правната и
институционалната рамка поврзана со корупцијата во јавниот сектор.
Прва глава: Поим на корупција
Имајќи ја предвид целта на предметната програма, студентите најнапред ќе се запознаат со поимот
на корупција – класични правни, социолошки и други поимања. Непосредно потоа следи и
типологијата на корупцијата, т.е. разграничувањето на корупцијата во јавниот наспроти корупцијата
во приватниот сектор, како и определувањето на системската односно политичката корупција. Тоа ќе
биде сторено земајќи ги предвид најзначајните теоретски согледувања, но и современи меѓународни
стандарди и акти донесени во рамките на ООН, Европската унија, Советот на Европа и
Организацијата за економска соработка и развој (ОЕЦД).
Втора глава: Етика и корупција
Содржината ќе биде проткаена со етичките норми во правната професија, но и во јавната
администрација, медиумската сфера и сферата на политиката. Поинаку речено, во оваа глава
студентите ќе се бават со прашањето за релацијата помеѓу етиката и корупцијата (дали етичките
кодекси можат да спречат коруптивни практики, во која мера придонесуваат кон превенција од
коруптивни дејствија, како да се постапи во случај на законито, но неетичко однесување и сл).
Трета глава: Конвенција на Обединетите нации против корупцијата (United Nations Convention
against Corruption)
По општите напомени студентите ќе се запознаат и со позначајните меѓународни акти со кои се
забранува корупција во јавниот сектор, а тоа е првенствено Конвенцијата на Обединетите нации
против корупцијата (United Nations Convention against Corruption). Како единствениот универзален
договор (ратификуван од 186 држави) кој се однесува на спречувањето на и справувањето со
корупција, оваа ковенција предвидува дека секоја држава-потписничка (страна) ќе се стреми да:
развие култура на владеење на правото, односно да го примени концептот на добро владеење (чл. 1-
14); овозможи учество на јавноста во градењето на политиките и пристап до информации од јавен
карактер без особени бариери (чл. 13, поврзан со чл. 8 и 10); ја спречи корупцијата во приватниот
сектор со тоа што ќе предвиди механизми за контрола на финансиската состојба на претпријатијата
и кривична одговорност за коруптивни практики (чл. 12, 21, 22, 23, 24, 26, 39 и 40); обезбеди заштита
на укажувачите и новинарите кои откриваат кривични дела од сферата на корупцијата (чл. 8, 10, 12,
13); ја спречи корупцијата во правосудниот сектор (чл. 11); усвои адекватна правна рамка за
спречување на корупција во постапките за јавни набавки (чл. 5-13); превенира перење на пари (чл.
14, 15, 16, 23, 37, 40, 46, 51, 52 и 58); соработува со другите држави-потписнички (страни) во поглед
на гонењето и казнувањето кривични дела поврзани со корупција (чл. 38, 39, 40, 42 поврзани со чл,
6, 11, 12 и 13); одземање и враќање на незаконски стекнат имот (чл. 50 – 58). Конвенцијата исто така
предвидува дека секоја држава ќе има специјализирани антикорупциски тела (чл. 36). Како основни
принципи во нејзиниот текст можат да се пронајдат транспарентноста и одговорноста. Од
компаративни причини, во оваа глава ќе стане збор и за други регионални акти како што се:
Казненоправната конвенција против корупција на Советот на Европа (Criminal Law Convention on
Corruption); Граѓанскоправната конвенција против корупција (Civil Law Convention on Corruption);
Конвенцијата на ЕУ за борба против корупција која вклучува службени лица на Европските заедници

и службени лица на земјите-членки (Convention on the fight against corruption involving officials of the
European Communities or officials of Member States of the European Union) и слично.
Четврта глава: Правна рамка во Република Македонија за спречување на корупцијата
Во оваа глава следи запознавање со домашната правна рамка во Република Македонија, што во себе
ги опфаќа основите на: Законот за спречување на корупција; Законот за спречување на судир на
интереси, Законот за лобирање; Законот за заштита на укажувачи; Кривичниот законик и Законот за
кривичната постапка; Законот за финансирање на политичките партии; Законот за организација и
работа на органите на државната управа; Законот за Владата на Република Македонија; Законот за
вработените во јавниот сектор како и Законот за административните службеници; Законот за пристап
до информации од јавен карактер; Законот за граѓанска одговорност за навреда и клевета и други. Од
овие прописи на студентите ќе ѝм бидат посочени позитивноправниот поими на корупција, судир на
интереси, јавен сектор, укажувач, како и поедините инкриминации.
Петта глава: Органи за спречување на корупција во Република Македонија
Програмата е конструирана така за да посвети особено внимание на Државната комисија за
спречување на корупцијата. Ќе бидат опфатени нејзиното устројство, надлежности и овластувања,
начинот на работа како и обврските за пријавување или известување кои се пропишани за сите други
органи. Меѓу другото, тука спаѓа: донесувањето на Акционен план на Државната комисија за
спречување на корупција; давањето мислења на предлози на закони за спречување на корупцијата;
покренувањето иницијативи пред надлежните органи за финансиско-материјално работење на
политичките партии; покренувањето иницијативе за разрешување, распоредување, сменување или
други мерки на одговорност на избрани или именувани лица, службени лица или одговорни лица во
јавни претпријатија и други правни лица кои располагаат со државен капитал; покренувањето
иницијативи за кривично гонење и слично.
Освен на овој најзначаен и независен државен орган надлежен за спречување на корупцијата, во
рамките на оваа глава посебно внимание ќе биде посветено и на обвинителството и судството во
делот во кој се тие надлежни за гонење и казнување на сторителите на коруптивни дејствија и
кривични дела во сферата на корупцијата.
Шеста глава: Начелото на транспарентност или слободниот пристап до информации од јавен
карактер како алатка за превенција и откривање на корупција
Во оваа глава ќе стане збор за улогата на јавноста (граѓаните) во спречувањето на корупцијата.
Студентите ќе се запознаат со начинот на кој принципот на транспарентност предвиден во низа
меѓународни акти (види: трета глава) се развиваше во изминатите две децении, како на меѓународен
план така и во поедините држави. Основниот мотив е да се посочи дека ниту една држава не може
ефективно да се справи со проблемот на корупцијата доколку граѓаните не можат на едноставен
начин да дојдат до информации за тоа носителите на власт градат политики, носат одлуки и
управуваат со јавните финансии. На прво место ќе биде опфатен концептот на отворена власт (open
government) особено низ призмата на глобалната иницијатива Отворено владино партнерство (Open
Government Partnership) започната во 2011. Понатаму, студентите ќе се запознаат и со меѓународните
стандарди за пристап до информации од јавен карактер, каде ќе стане збор за Повелбата за отворени
податоци (Open Data Charter), Индексот за отворени, корисни и реупотребливи информации на ОЕЦД
(OECD OURdata index) и критериумите на Светската банка (World bank) за буџетската
транспарентност (како посебен концепт значаен за целокупната транспарентност). На крајот, посебно
внимание ќе се посвети и на постапката за пристап до информации од јавен карактер во Република
Македонија уредена согласно одредбите од Законот за слободен пристап до информации од јавен
карактер. Студентите ќе бидат охрабрени да спроведат и самостојно истражување за да оценат дали
македонското законодавство соодветствува на наведените меѓународни норми.
Седма глава: Улогата на укажувачите и медиумите во спречувањето на корупцијата
Во рамки на програмата ќе биде опфатен и режимот за заштита на лицата кои пријавуваат коруптивни
практики (укажувачи), односно за новинарите кои ја известуваат јавноста за соодветните дејствија.
Станува збор за два суштествени аспекти на откривањето корупција. Во поглед на првиот, студентите
прво ќе се запознаат рамката за заштита на укажувачите поставена во Конвенцијата на Обединетите
нации против корупцијата, како и со Акцискиот план на Г20 за антикорупција за 2017-2018 (Anti-
Corruption Action Plan 2017-2018). Потоа ќе следи и компаративен преглед каде особено внимание ќе

се посвети на Законот за откривање информации од јавен интерес (Public Interest Disclosure Act) на
Обединетото кралство, законската рамка во САД (особено Sarbanes-Oxley Act) и подзаконските акти
на француската Комисија за заштита на податоци (Commission nationale de l'informatique et des
libertés). На крајот детално ќе биде проучен Законот за заштита на укажувачите на Република
Македонија (првично споменат во четвртата глава) по што ќе бидат изложени неговите основни
правила, но и слабости. Во поглед на вториот аспект, повторно ќе биде анализирана Конвенцијата на
Обединетите нации против корупцијата, по што ќе се обрне внимание и на Законот за спречување на
корупцијата (чл. 56). Кога станува збор за мотивираноста на новинарите да објавуваат податоци
поврзани со коруптивни акти и нивната заштита, дел од вниманието ќе се посвети и инстиутот
клевета и навреда. На студентите ќе ѝм биде претставен Законот за граѓанска одговорност за навреда
и клевета, а како клучна ќе биде опфатена и јудикатурата на Европскиот суд за човекови права
(ЕСЧП) во случаите кога новинари биле санкционирани за објавување коруптивни скандали. Како
помошна алатка за анализа каков правниот режим за клевета и навреда треба да биде поставен за да
не спречи објавување на податоци за коруптивни акти, предвид ќе се земе и еден од прирачниците на
Меѓународниот прес – институт (Manual: Freedom of Expression, Media Law and Defamation).
Глава осма: Корупција во јавната администрација
Како еден од најгорливите проблеми, оваа наставна програма ја опфаќа и корупцијата во јавната
администрација или поинаку речено корупцијата кај административните службеници. Поаѓајќи од
меѓународните акти и стандарди, особено во поглед на принципот на транспарентност, ќе се
обработат неколку прашања. Во прв план ќе стане збор за начинот на пополнување работни места во
јавната администрација, односно за тоа дека јасните правила во тој контекст се еден од одлучувачките
фактори за интегритетот на административните службеници. Ако секој од нив е вработен поради
заслуга веројатноста дека тој/таа ќе постапува етично и со интегритет е поголема. Истото се однесува
и на напредувањето и наградувањето во службата, но и деградирањето. За оваа проблематика
студентите ќе се запознаат со Препораките на ОЕЦД за подобрување на етичкото однесување во
јавните служби (Recommendation of the OECD on Improving Ethical Conduct in the Public Service), но
и со правилата за пополнување на работни места, унапредување и наградување на службениците во
Република Македонија содржани во Законот за вработените во јавниот сектор и Законот за
административните службеници. Во втор план студентите ќе се запознаат со принципот на
одговорност и неговото значење, особено земајќи предвид дека секој вработен во јавниот сектор,
меѓу што и секој административен службеник, за работењето одговара кривично, материјално и
дисциплински. Со оглед на единаесеттата глава, во оваа пригода ќе бидат обработени само
материјалната и дисциплинската, повторно според Законот за вработените во јавниот сектор и
Законот за административните службеници.
Освен овие два аспекти за спречувањето корупција помеѓу административните службеници, во
главата ќе стане збор и за други одредби кои на посреден или непосреден начин влијаат на
корумпираноста на службениците. Тука би се вброиле забраните за примање подароци, за одбивање
на незаконски наредби, како и оние за пријавување на сомневање или сознание за кривично дело или
за незаконско или недозволиво постапување. Дел од материјата е веќе апсолвирана во претходната
глава, имајќи предвид дека административните службеници можат да се јават како укажувачи (види:
седма глава).
Глава деветта: Корупција во правосудството и во органите надлежни за спречување на
корупцијата
Деветтата глава од наставната програма се однесува на корупцијата во правосудството, примарно
опфаќајќи ги судовите и обвинителствата, како и во органите надлежни за спречување на
корупцијата. Тематиката ќе биде обработена низ призмата на ефективната заштита на човековите
права и слободи воопшто. Имено, корумпираноста во правосудството и органите надлежни за
спречување на корупцијата, слично како и кај администрацијата, е една од основните пречки за
унапредувањето на заштитата на човековите и граѓанските права и слободи, а со тоа и на државата
воопшто. Оттаму, студентите ќе се запознаат со основните одредби од Конвенцијата на Обединетите
нации против корупцијата, но и со другите меѓународни документи и акти како што се: Мислењето
бр. 13 (2010) на Советодавниот совет на Европските судии за улогата на судиите во извршувањето на
судските одлуки; Бенгалорските начела за судско поведение; Препораката на Комитетот на министри
на Советот на Европа Рец. (2010)12 и појаснувачкиот меморандум. Освен тоа, предмет на обработка

ќе бидат и порепораките дадени во Извештаите за напредокот на Република Македонија кои на
годишно ниво се издаваат од страна на Европската унија (поглавје 23), како и Оцените и препораките
на високата група експерти на Европската комисија за системското владеење на правото (2017). Во
поглед на позитивното право на Република Македонија студентите ќе стекнат познавања од Законот
за судовите, Законот за јавното обвинителство, Законот за судскиот совет, но и Законот за судска
служба и Законот за јавнообвинителска служба. Причината зошто последните два прописи се
обработуваат во рамки на темата е фактот што на меѓународен план корупцијата во правосудството
се третира холистички, опфаќајќи ги и службениците.
Кога станува збор пак за вториот дел на оваа глава, студентите ќе се стекнат со сознанија за
коруптивни скандали токму во специјализираните антикорупциски органи. Акцентот ќе биде ставен
на законските гаранции кои една држава треба да ги предвиди, како овие тела би биле целосно
независни, но и на механизмите за надзор над нив. Особено внимание ќе се посвети на правилата за
именување, одговорност разрешување на членови на Државната комисија за спречување на
корупцијата, како и на Оцената на националниот систем за интегритет од 2016 – документ издаден
од Transparency International.
Глава десетта: Корупција во пенитенцијарните установи
Во рамките на оваа тема, студентите ќе се стекнат со сознанија за најчестите видови корупција во
затворите, во кои се разбира мора да постои и вмешаност од страна на службениците (затворската
полиција, затворски воспитувачи), па дури и можност за организиран криминал со вклученост на
носители одредени функции – директор на затвор, директор на Управата за извршување на санкции,
министер за правда. Во рамките на предавањата, ќе бидат вклучени практичари кои имаат
долгогодишно професионално работно искуство во некој од затворските установи во РМ, а ќе биде
вклучена и посета на студентите во една од казнено-поправните установи во државата во рамките на
која ќе имаат можност да разговараат со вработените.
Глава единасетта: Кривични дела од областа на корупцијата и кривична постапка против
сторителите
Во оваа глава ќе се посвети внимание на инкриминациите од Кривичниот законик на Република
Македонија кои се поврзани со поимот на корупцијата, како и на релевантните процесни норми за
гонење на лицата со коруптивно поведение – сторителите на соодветните кривични дела. Во
Кривичниот законик може да се детектираат повеќе дела кои по своето битие и природа се
подведуваат под корупција: злоупотреба на службената положба и овластување (членот 353);
несовесно работење во службата (членот 353-в); проневера во службата (членот 354); измама во
службата (членот 355); давање поткуп (членот 358); примање поткуп (357); давање награда за
противзаконито влијание (членот 358-а); примање награда за противзаконите влијание (членот 359);
противправно стекнување и прикривање имот (членот 359-а); неовластено примање подароци
(членот 253); неовластено давање на подароци (членот 253-а).
Од аспект, пак, на процесните одредби во македонското позитивно право, студентите ќе ги
продлабочат своите познавања на Законот за кривичната постапка во Република Македонија кои веќе
ги имаат апсолвирано во текот на студиите од прв циклус, но и со посебните процесни правила за
дела од организираниот криминал. Во тој контекст, анализирана ќе биде и надлежноста на Основното
јавно обвинителство за гонење на организиран криминал и корупција, како и онаа на одделението на
Основниот суд Скопје I – Скопје за организиран криминал и корупција.
Глава дванаесетта: Решавање случаи во Клиниката за анти-корупциско право
Во последните часови студентите ќе се здобијат со можност да работат на вистински случаи поврзани
со корупција во рамки на Правната клиника за антикорупциско право на Правниот факултет
„Јустинијан Први“ (Клиника). Работата ќе се одвива на тој начин што под менторство на професорите
и експертите од практиката, студентите ќе анализираат предмети пристигнати во Клиниката, по што
ќе дадат правно мислење. Споменатите предмети во Клиниката ќе бидат доставувани од страна на
физички и правни лица на кои ѝм е потребно правно мислење, но и од страна на здруженија на
граѓани и институции со кои Правниот факултет „Јустинијан Први“ има остварено соработка. На тој
начин студентите кои го слушаат предметот Антикорупциско право ќе го применат знаењето
стекнато во текот на единаесетте седмици настава, односно ќе се стекнат со практични вештини кои
ќе ги доразвиваат и ползуваат во текот на нивната кариера.

12. Методи на учење: Наставата ќе биде составена од интерактивни предавања со
професор и наставник, како и вежби со истакнати струшњаци
од практиката, и посета на релевантни институции. Таа ќе се
одвива во вкупно 12 работни седмици. Студентите се должни
активно да партиципираат вклучувајќи се во дискусии,
одговарајќи на квизови и пишувајќи куси есеи на зададена
тема. Тие ќе имаат прилика да ѝм поставуваат прашања на
експертите од практиката, а особено ќе бидат охрабрени да
даваат свои коментари на прочитаната литература. Се
препорачува редовно следење на наставата и вежбите, како и
сериозна партиципатција на студентите при нивното
изведување.

10. Course aim (competences)
The course Anti-Corruption Law is aimed to equip the Administrative Law and Public Administration
students with knowledge on the mechanisms for corruption prevention set down in the legislation of the
Republic of Macedonia, but also in the international documents especially the United Nations Convention
against Corruption (UNCAC) ratified by the Macedonian Assembly (Parliament) in 2007. In that respect,
the students will be introduced to the country’s anti-corruption institutional framework: independent
authorities established in order to prevent corruption in the public sector (the State Commission for
Prevention of Corruption), internal controls (mechanisms for supervision), prosecution offices and courts.
Furthermore, they will learn about the most significant international acts, standards and initiatives for
prevention of corruption in the public sector [established or adopted within the UN, the European Union, the
Council of Europe – Group of States against Corruption (GRECO), the OECD, etc.). It is therefore expected
that the students are going to:
- strengthen their knowledge and improve their skills related to the implementation of the anti-
corruption legislation, i.e. be prepared not just to research on the topic but also to provide victims
of corruption and any other interested persons with legal advice and/or information;
- be able to distinguish the methods to prevent corruption in the public sector vis-à-vis the measures
to penalize (sanction) the corrupt;
- be able to distinguish the phenomenon of conflicts of interest from the phenomenon of corruption
(a conflict of interests can exist without corruption, but there can be no corruption without a conflict
of interests), which would also lead to them having capacities to differentiate the methods to prevent
both occurrences;
- become aware how important it is, when speaking of the prevention of corruption, that a country
has a proper legislation for access to information of public interest, i.e. that the fight against

corruption cannot be successful without proper implementation of the principle of transparency set
out in numerous international documents;
- learn more in respect to the protection of whistleblowers.
It is expected that if a student completes the course successfully, he/she will be qualified to work at any
public authority, the State Commission for Prevention of Corruption, the international (governmental and
non-governmental) organizations, the judiciary, etc. Respectively, they are going to be able to work on any
job-position that is related with prevention of conflicts of interest and/or corruption.
11.
Course content
The course is constructed in such way that the students are going to learn more about the Macedonian anti-
corruption legislation, as well as the relevant international documents. This is an indeed peculiar legal area
which includes rules of different kinds, many of which are deemed as Administrative Law ones. Those very
rules (the Administrative Law ones) will be found in the focus, namely the course Anti-Corruption Law deals
primarily with the corruption in the public sector.
Unit one: Introduction to corruption
Bearing in mind the course aim, the students will first and foremost become acquainted with the concept of
corruption – classical legal, sociological and other types of definitions. Upon that they will learn more about
the corruption typology, i.e. what is considered as corruption in the public sector and what in the private
sector, the notion of systemic corruption and the one of political corruption. For that purpose they be
introduced to the contemporary theories, but also international standards and acts adopted or developed
within the UN, the EU, the Council of Europe as well as the Organization for Economic Co-Operation and
Development (OECD).
Unit two: Corruption and ethics
This course unit will deal with the legal profession’s ethical norms and standards, as well as the meaning of
the principle of ethics when it comes to the public administration, the media and the political sphere. In other
words, what the students will focus on is the question how is the principle of ethics related with the existence
of corruption (do codes of ethics effectively prevent corruptive behavior, to what extent, and what actions
should the authorities undertake when a certain individual or a legal person behaves legally but not
ethically?).
Unit three: United Nations Convention against Corruption (UNCAC)
Following the introductory remarks given in the first two units, the students will be introduced to the most
important international acts which forbid corruption in the public sector as well as corruptive acts in general.
The first among them is the United Nations Convention against Corruption (UNCAC). The UNCAC is not
just the only universal convention (ratified by 186 states) that deals with corruption, but also one that does
so in a rather holistic manner. First of all, it covers both the prevention and the handling of corruption;
secondly, different provisions are contained for each area where corruption can occur. In that sense, the
UNCAC stipulates that each State Party will strive to: develop a rule of law culture and to implement the
concept of good governance (Articles 1 – 14); enable to public to participate in the public policies
development as well as to access information that are of its interest without unusual barriers (Article 13 in
relation to Articles 8 – 10); prevent corruption in the private sector by setting out mechanisms to supervise
the companies as are procedures for appropriate auditing and certification as well as criminal liability
(Articles 12, 21, 22, 23, 24, 26, 39 and 40); protect whistleblowers and journalists who report on criminal
actions which constitute corruption (Articles 8, 10, 12, and 13); prevent corruption in the justice sector
(Article 11); adopt an adequate legal framework to prevent corruption in the public procurement procedures
(Articles 5 – 13); prevent money laundering (Articles 14, 15, 16, 23, 37, 40, 46, 51, 52 and 58); collaborate
with the other State Parties when it comes to the prosecution and sanctioning of corruption (Articles 38, 39,
40 and 42 in relation with Articles 6, 11, 12, and 13); properly regulate the confiscation and asset recovery
(Articles 50 – 58). In addition, the UNCAC also provides that every State Party shall, in accordance with
the fundamental principles of its legal system, ensure the existence of a body or bodies or persons specialized
in combatting corruption through law enforcement – specialized authorities (Article 36). From the
perspective of its fundamental principles, the UNCAC rests upon the ones of transparency and accountability.
Besides the UNCAC, this unit will, for comparative purposes, also deal with other regional acts such as: the
Council of Europe’s Criminal Law Convention on Corruption and Civil Law Convention on Corruption; the

EU Convention on the fight against corruption involving officials of the European Communities or officials
of Member States of the European Union, etc.
Unit four: Anti-corruption legal framework of the Republic of Macedonia
This unit is focused on the anti-corruption legal framework of the Republic of Macedonia which consists of
numerous laws (statutes): the Prevention of Corruption Act; the Prevention of Conflicts of Interest Act; the
Whistleblowers Protection Act; the Criminal Code; the Criminal Procedure Act; the Act on the Organization
and Operation of the State Authorities; the Act on the Government of the Republic of Macedonia; the Public
Employees Act; the Administrative Servants Act; the Political Parties’ Financing Act; the Act on Free Access
to Public Character Information, Act on Civil Liability for Insult and Defamation. The students are expected
to learn these acts’ basic provisions in order to understand how the Macedonian legislation defines
corruption, conflicts of interest, public sector and whistleblowing. In addition, the criminal provisions will
be only briefly introduced to the students so that more attention can be paid further on in the course.
Unit five: Anti-corruption authorities in the Republic of Macedonia
The course places special attention on the State Commission for Prevention of Corruption (Commission).
The students will learn more about the way it is organized, its competences and the obligations all authorities
and officials have towards it. This would cover, inter alia, the Commissions’ right and duty to adopt an
Action Plan; its competence to provide opinions whenever there are draft laws that deal with the prevention
of corruption; its right to initiate proceedings for supervision of the political parties’ financial conduct; its
right to provide initiatives for dismissal or degradation of elected or appointed officials, as well responsible
persons within the public enterprises and the legal persons which manage state capital; its right to initiate
criminal investigation and prosecution, etc.
Aside from this independent state authority, the unit will also deal with the role of the prosecution offices
and the courts, i.e. their competences to prosecute and sanction persons who have committed criminal
offences that pose corruption.
Unit six: The principle of transparency or the access to information of public interest as a tool to
prevent and uncover corruption
The sixth unit deals with the role of citizens when it comes to the fight against corruption. Students will learn
about the principle of transparency, its scope and its meaning, as well as the way it has been developing in
the Republic of Macedonia and internationally in the past two decades. The general idea therein is to raise
awareness that no country can effectively deal with corruption if its citizens cannot access information on
the way policies are developed, decisions reached and/or finances managed in a simple procedure. From a
structural point of view, the lecture will start with the concept of open government as interpreted by the
global initiative Open Government Partnership which was commenced in 2011. Upon that, students will find
more about the international standards on access to information which are of interest to the public. As
reference points, the unit will include the Open Data Charter, the OURdata Index of the OECD and the World
Bank criteria on budget transparency (as a subcomponent of the principle of transparency as a whole). Last
but not least, the Macedonian legislation is also going to be included. The lecturers will elaborate on the key
provisions of the Act on Free Access to Public Character Information, encouraging the students to carry out
their own research if they are in line with the international norms.
Unit seven: Whistleblowers and media in the fight against corruption
This course will address the crucial role played by individuals who come forward with information on
corruption (whistleblowers) and by journalists who report on such acts. Respectively, the seventh unit
comprehends two disclosure of information aspects. As for the first one, students are going to learn how
crucial the whistleblowers’ protection is in the anti-corruption endeavors. What has to be borne in mind in
this sense is that many of the corruption scandals that we know of now would have remained uncovered
without these individuals. Therefore, the regime for their protection is one of paramount importance.
Students will learn more about the provisions of the UNCAC, the G20 Anti-Corruption Action Plan 2017-
2018, the comparative legislation including United Kingdom’s Public Interest Disclosure Act (PIDA), the
Sarbanes-Oxley Act of the United States and the by-laws adopted by the French Commission for Data
Protection (Commission nationale de l'informatique et des libertés), as well as the Macedonian
Whistleblowers Protection Act. When it comes to the last act (the one of the Republic of Macedonia) it is
crucial to note that its provisions are not merely going to be explained but also criticized vis-à-vis the ones
in the enlisted foreign legal acts (statutes). As for the second aspect of information disclosure, the unit will

again briefly focus on the UNCAC, while more attention will be paid on the Macedonian Prevention of
Corruption Act. However, bearing in mind that it is crucial when it comes to the prevention of self-
censorship, the defamation regime will also be dealt with. Namely, the lecturers will firstly present the key
provisions of the Act on Civil Liability for Insult and Defamation; after which they will help the students
assess their adequacy by comparing them to the standards provided in the decisions of the European Court
of Human Rights (in cases where journalists were sanctioned for disclosing corruption-related information).
As a helpful tool for the elaborated task, students are going to be encouraged to also take into consideration
one of the International Press Institute’s publications, i.e. the Manual: Freedom of Expression, Media Law
and Defamation).
Unit eight: Corruption in the public administration
It is undisputed that one of the most challenging problems in every country is the public administration
corruption, or, in other words, the existing corruption among the civil (or so-called administrative) servants.
Although many lessons in that respect have been learned in the past decades, awareness rising in this context
– especially among young lawyers who are the future legal professionals – is still a necessity. For that
purpose, the eight unit deals with the international and national standards and rules for employment,
promotion (awarding) and degrading of civil servants, as well as the ones for their accountability. In other
words, two sets of rules and standards are in our focus. Both of them are essential when it comes to the
prevention of corruption. As for the first one, the unit starts off with one of the key documents on this topic
issued by the OECD – the Recommendations on Improving Ethical Conduct in the Public Service. As it is
pointed out therein, the integrity (or the ethical conduct) of the civil servants depends, to a large extent, on
how vivid the rules for their employment, promotion and degradation are, and whether their content promotes
a merit-based approach. Namely, one can only expect ethical conduct if the demonstration of high-quality
and dedication brings about the civil servant’s employment or promotion, whereas the lack thereof about
his/her degradation. This relation goes vice-versa too. One should not expect that there will be integrity in
the public service if the principle of merits is not fully implemented. Once this is absolved, the students will
concentrate on the Macedonian legislation and the provisions of the Public Employees and the
Administrative Servants Act. They will not only examine and learn the provisions related with the
administrative servants’ employment (or even broader – engagement), promotion, awarding and degradation
but also compare them with the standards promoted by the OECD. As for the second set of standards and
rules – the ones related with accountability – this unit will only refer to the civil servants’ disciplinary and
material liability (i.e. liability for damages) and not the criminal one which is the focus of the eleventh unit.
Besides these two sets of rules and standards, the unit will also contain reference to other provisions of the
Macedonian legal system which affect the corruption in the public administration. Those are, for instance,
the once that forbid administrative servants from receiving gifts, as well as the ones that provide for their
protection once they have reported wrongdoings (criminal or other types) within their institutions. As for
these latter ones, it has to be taken into account that some of the rules have already been introduced to the
students in the previous unit (more information: unit seven which deals with whistleblowers’ protection).
Unit nine: Corruption in the justice sector and within the anti-corruption authorities
There is no dispute that the justice sector (the courts and the prosecution offices) and the independent
(specialized) anti-corruption authorities play an important role in the fight against corruption in general.
Nevertheless, there is also no dispute that they are not immune to this negative phenomenon as well. Having
that said, this unit will firstly reveal how difficult it is to prevent corruption within the courts and the
prosecution offices, but also how essential that is when it comes to the effective protection of human rights
and liberties. Students will study both, the international rules, recommendations and standards as well as the
Macedonian legal framework: the UNCAC; the Opinion no. 13(2010) on the Role of Judges in the
Enforcement of Judicial Decisions; the Recommendation CM Rec. (2010)12 of the Council of Europe and
its explanatory memorandum; the Bangalore Principles of Judicial Conduct; the European Union’s Reports
on the Progress of the Republic of Macedonia (chapter 23); the Assessment and recommendations of the
Senior Experts’ Group on system Rule of Law issues 2017 in the Republic of Macedonia (issued by the
European Union); the Courts Act; the Public Prosecution Act; the Judicial Council Act; the Acts on Judicial
Service and the Act on Prosecutorial Service. Of course, only certain provisions or chapters of each act or
document will be pointed out.
So far we were referring to the corruption in the courts and the public prosecution offices. However, as
already said, this shall also refer on the corruption within the specialized anti-corruption authorities. The

students will not only become acquainted with some of the largest corruption scandals related with anti-
corruption institutions world-wide, but also get insights in the latest theoretical considerations on the
mechanisms and methods to prevent corruption among the ones establish to fight it. Special attention will be
given to the legal provisions that regulate the appointment and dismissal of the State Commission for
Prevention of Corruption members, as well the ones regarding their accountability. In that respect, the unit
will also elaborate on the latest National Integrity System Assessment published in 2016 by Transparency
International.
Unit ten: Corruption in the penitentiary institutions
This unit will bring the students closer to the corruption in the penitentiary institutions, meaning they will
gain knowledge on who the perpetrators usually are and what types of acts of corruption they most-
commonly commit. What is important in respect to the perpetrators is to stress out that there could be no
corruption in the prisons and the other penitentiary institutions if the administrative staff (the prison police,
the tutors, etc.) is not involved as well. Furthermore, it is not uncommon that the higher ranking (elected or
appointed) officials – such as the prison directors, the director of the Directorate for Execution of Sanctions,
or the Minister of Justice – are involved too, which ultimately means that there is organized crime as well.
The lectures are going to be carried out not just by professors, but also by practitioners which have a
significant experience in some of the Macedonian penitentiary institutions. In addition, the students will have
the opportunity to visit one of the respective institutions and discuss their questions and views with the
employees as well.
Unit eleven: Crimes in the area of corruption and criminal procedure against the perpetrators
The eleventh unit has two main focal points: the incriminations from the Macedonian Criminal Code which
are related to the concept of corruption and the relevant procedural rules for prosecuting and sanctioning the
perpetrators. Respectively, the Criminal Code has multiple provisions which criminalize actions that can be
deemed as corruption: misuse of official position and authorization (Article 353); recless work in the service
(Article 353-v); embezzlement (Article 354); fraud (Article 355); bribery – active (Article 358); bribery –
passive, i.e. receiving (Article 357); giving awards for illegal influence (Article 358-a); receiving awards for
illegal influence (Article 359); illegal gain and hiding of assets (Article 359-a); illegal receiving of gifts
(Article 253); illegal giving of gifts (Article 253-a).
As for the procedural rules in the Macedonian legal system, it is expected that the students already have some
knowledge in respect to the Criminal Procedure Act which will, in this case, be deepened. In that respect,
they will pay more attention to the special (lex specialis) provisions which are related to organized crime.
Additionally, they will also analyze the competences of the Prosecution for Organized Crime and Corruption,
as well as the ones of the special department for organized crime and corruption within the Court-of-First-
Instance Skopje I – Skopje.
Unit twelve: Practical work at the Anti-Corruption Law Legal Clinic
The last unit is not envisaged as a classical lecture. Instead, the students will have the opportunity to have
some practical work on real-life cases related with corruption in the Anti-Corruption Law Legal Clinic
established at the Faculty of Law “Iustinianus Primus” (Clinic). This practical work will be carried out in
such way that the students will examine the cases that have arrived in the Clinic and, under the supervision
of their professors and attorneys, provide legal advice to the persons who need it. Some of those cases are
delivered by individuals and natural persons who need advice, while some by the non-governmental
organizations and institutions that have established cooperation with the Faculty of Law “Iustinianus
Primus”. That way the students are going to have the chance to apply the knowledge they have gained during
the eleven weeks of lectures and gain (at least basic) skills which they can upgrade in the future.
12. Methods of learning The lectures will be interactive. Some of them are going to be
carried out by professors, while in some cases the students will
have exercises or group-work under the supervision of experts
from the practice. In addition, they will visit institutions that are
of relevance. Each unit will be covered in one week, meaning that
the entire course duration is twelve working weeks. Each student
is obliged to actively participate in the discussions and the
quizzes, as well as to write essays as requested. They are strongly
encouraged to ask questions whenever they have some, as well as

to provoke deliberations with both, the professors and the other
experts. They can freely comment on the literature they have read.
Each student is advised to regularly attend classes.
