OY Series of 2012 "AN ORDER RECONSTITUTING AND REORGANIZING THE MEMBERSHIP OF THE CITY DEVELOPMENT COUNCIL PURSUANT TO REPUBLIC ACT NO. 7160, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991" WHEREAS, Republic Act No. 7160, or the Local Government Code of 1991 provides for the constitution and organization of the City Development Council in line with the national policy of encouraging local government units to evolve local development plans pursuant to existing laws, executive orders and other related issuances; WHEREAS, R.A. 7160 mandates the organization and strengthening of local government councils, prescribing therein the compositions, organizations and functions of local development councils, as well as other related measures for the implementation of said Republic Act; WHEREAS, Section 106 of the Local Government Code provides that each local government unit shall have a comprehensive multi-sectoral development plan to be initiated by its development council and approved by its Sanggunian. WHEREAS, the Davao City Development Council shall assist the local legislative Body in setting the direction of economic and social development and coordinating development efforts within the city; WHEREAS, Executive Order No. 21 dated December 7, 2007 created the Davao City Development Council; WHEREAS, in line with the development thrust of the City Government on focusing its delivery of services, programs and projects into more specific and essential targets, there is a necessity for an integrated manner of planning and expending its resources from within and outside sources into focused areas and barangays; WHEREAS, there is a need to reconstitute and reorganize the membership of the City Development Council; NOW, THEREFORE, I, SARA Z. DUTERTE, City Mayor of Davao, by virtue of the powers vested in me by law, do hereby order the following: SECTION 1. Composition of the City Development Council. • All Barangay Captains • Chairman, Committee on Finance, Ways and Means • Congressman of each legislative district or their representative • Representative of non-governmental organizations operating in the

city, who shall constitute not less than one fourth (1/4) of the members of the fully organized council

SECTION 2. Representation of Non-Governmental Organizations. Per Department of Interior and Local Government Memorandum Circular No. 2010-73, the DILG City Director in coordination with the Local Government Unit shall call all accredited organizations to a meeting where such organizations shall choose from among themselves the representative organizations to the various Local Special Bodies.

SECTION 3. Functions of the City Development Council. The City Development Council shall exercise the following functions:

a) Formulate the long-term, medium-term and annual socio-economic development plans and policies

b) Formulate the medium-term and annual public investment programs c) Appraise and prioritize socio-economic development programs and projects d) Formulate local investment incentives to promote inflow and direction of

private investment capital e) Coordinate, monitor and evaluate the implementation of development

programs and projects f) Perform such other functions as may be provided for by law.

SECTION 4. Executive Committee. The City Development Council shall create an Executive Committee to represent it and act in its behalf when it is not in session. The composition of the Executive Committee shall be as follows:

Chairman - The City Mayor or her alternate, the City Administrator

Members:

• Chairman, Committee on Finance, Ways and Means (Appropriations) Sangguniang Panlungsod

• President, Association of Barangay Captains • Representative of Non-Governmental Organizations • Chairman, Social Development Committee • Chairman, Economic Development Committee • Chairman, Infrastructure Development Committee/Zoning and Land

Use • Chairman, Environment Development Committee

The Executive Committee shall exercise the following powers and functions:

a) Ensure that the decision for the Council are faithfully carried out and implemented;

b) Act on matters requiring immediate attention or action by the Council; c) Formulate policies, plans and programs, based on the general

principles laid down by the Council; d) Act on other matters that may be authorized by the Council.

SECTION 5. Sectoral or Functional Committees. The City Development Council shall organize sectoral or functional committees to assist in the performance of their functions, namely: Economic Development Committee (EDC), Infrastructure Development Committee (IDC), Social Development Committee (SDC) and Environment Development Committee (EnvDC), the respective chairman thereof shall become member of the Executive Committee, as above-provided.

All National and City Government Offices shall be accordingly represented in the appropriate development committees.

SECTION 6. Secretariat. There is hereby constituted a secretariat which shall be responsible for providing technical support, documentation of proceedings, preparation of reports and such other assistance as may be required in the discharge of its functions.

The secretariat of the City Development Council shall be headed by the City Planning and Development Coordinator.

SECTION 7. Technical Assistance to the Council. All City Government Offices/Departments/Agencies are hereby enjoined to provide technical assistance, support and cooperation to the Council.

SECTION 8. Operational Expense and Funding. Members, Consultants and Technical Staff are hereby authorized to claim for incidental expenses relative to the services rendered in addition to their duties and responsibilities and for the work beyond office hours subject to the usual accounting and auditing rules and regulations chargeable against the budgetary allocations of the council.

SECTION 9. Repealing Clause. All Executive Orders or Issuances inconsistent with the provisions of this Executive Order are hereby repealed or modified accordingly.

SECTION 10. Effectivity. This Executive Order shall take effect immediately.
