This matter comes before the Court upon Appellant's "Motion for Leave to

File Delayed Appeal" and Appellee's response in opposition. Appellant seeks to

appeal the trial court`s entry dated February 8, 2011. He avers he did not timely

file a notice of appeal because he was in transit and did not have access to an

attorney or legal forms.

As the Supreme Court has held, "If a movant establishes sufficient

reasons justifying the delay, the appellate court may, in its discretion, grant the

motion, and the case proceeds as it would-have if timely filed." State- v. Silsby

(2008), 119 Ohio St.3d 370, 372, 894 N.E.2d 667, 669.

Upon consideration, Appellant's motion is denied.
