WHEREAS climate change is the biggest environmental threat to our planet and a majorconcern for all Canadians;

AND WHEREAS at exactly 8:30 p.m. on Saturday, March 27,2010, major cities aroundthe world will turn off their lights for one hour to raise awareness about climate changeand to symbolize that, working together, the people of the world can make a difference inthe fight against globalwarming;

AND WHEREAS the event, called "Earth Hour'', began in one city just three years agoand has now grown to be the largest environmental movement in history;

AND WHEREAS significant action by political leaders around the world has not takenplace despite the efforts of the United Nations Climate Change Summit in Copenhagenlast December;

AND WHEREAS strong participation in Earth Hour 2010 will send a message to worldleaders to finish the job by quickly completing fair, ambitious and binding targets in orderto avert the repercussions of climate change;

AND WHEREAS Canada will be in the spotlight this year as our country hosts the nextmeeting of the G20 leaders this June - and climate talks will resume;

AND WHEREAS participating in Earth Hour sends a powerful message to every citizenand business around the world that it's possible to take action on climate change andthat switching off our lights is just one simple action we can take to help make adifference;

AND WHEREAS in the last two years, Newmarket has been a leader in this effort, withone of the highest rates of reduction in electricity consumption in the GTA;

Subject: 2010 Tax Incentive Programs

Each year, the Ministries of Natural Resources (MNR) and Agriculture Food and Rural

Affairs (OMAFRA) notify MPAC about the properties that qualify for the farm, conservation

land and managed forest tax incentive programs for the following taxation year.

MPAC regularly liaises with the Ministries to establish schedules for the submission of

tax incentive changes to MPAC for the year-end Assessment Roll. The schedules coincide

with the legislative application deadlines for the tax incentive programs and with MPAC’s

annual Property Assessment Notice mail out. This enables the Ministries to plan for a more

successful outcome in their overall administrative process

For the 2010 taxation year, MPAC updated all of the properties approved by the MNR and

OMAFRA at the time of the Property Assessment Notice mail out. However, O.Reg. 282/98

provides authority for OMAFRA and MNR to approve properties for the tax incentive

programs after the program deadlines and into the following taxation year under certain

situations:

applications are submitted to the Ministries after the application deadline due to

extenuating circumstances, or

RfRs are filed with OMAFRA, MNR or MPAC and the owner is concerned about the

classification or tax liability of their property.

In consultation with OMAFRA and MNR, MPAC has implemented a new process for farm

and conservation land properties that are approved by the Ministries after the Property

Assessment Notices are mailed. This change ensures that the Ministries and MPAC are

fulfilling the legislative requirements under O.Reg. 282/98.

Properties that are approved by the Ministries after Notices are mailed and before the return

of the Rolls will be processed by MPAC using a 2010 Amended Property Assessment

Notice. MPAC will mail a Notice to the property taxpayer and the municipality.

If OMAFRA and MNR approve farm or conservation land properties after the return of the

Roll:

the Ministry will issue Minutes of Settlement to the property taxpayer;

once a settlement is reached, the Ministry will notify the municipality, the ARB and

MPAC, electronically by e-mail, about the change in property classification only.

The municipality will have 90 days after receiving notification from the Ministries to

exercise their right of appeal to the Assessment Review Board (ARB);

subsequent to the Ministries’ notification, MPAC will mail a 2010 Advisory Notice

of Adjustment (ANA) to the property taxpayer and the municipality. The ANA will

include the change in classification (residential to farm) or tax liability (taxable to

exempt) and the revised phase-in calculations.

The Ministries will begin notifying municipalities about the 2010 tax year approvals at the

end of February. Going forward, they will continue to send the notifications on a bi-monthly

or monthly basis. MPAC acknowledges that municipalities require the revised phase-in

calculations to make an informed decision about whether to exercise their right to appeal the

classification change. We will make every effort to deliver the ANAs to you as soon as

possible upon notification of the approvals from the Ministries.

MPAC will continue to issue Minutes of Settlement to property taxpayers that are approved

for the Managed Forest Tax Incentive Program after the return of the Roll. Properties that

are approved for this program are valued using regulated rates, which may result in a change

to the 2008 Current Value Assessment.

Over the coming months, MPAC and the Ministries will explore opportunities to improve

communications to property taxpayers with a view to encouraging taxpayers to submit tax

incentive program applications, on time. In turn, this will ensure that qualifying properties

under these programs are reflected correctly on the Assessment Rolls.

AMO Report to Members on January 2010 Board Meeting

To keep members informed, AMO provides updates on important issues considered at regular AMO Board of Directors’ meetings. Highlights of the January 2010 Board meeting follow: AMO Pre-Budget Submission The Board approved an outline of the AMO 2010 pre-budget submission, delivered to the Standing Committee on Finance and Economic Affairs on February 2, 2010. Entitled “Propelling Economic Prosperity”, the submission focused on the following issues: that the provincial deficit cannot alter negatively the current cost-shared arrangements that provide predictable municipal funding; calls for the reconciliation of Ontario Municipal Partnership Fund (OMPF) social programs grant for 2008 and 2009; continued investment in municipal infrastructure; improved economic development opportunities with several new financing tools; and, rebalancing municipal liability exposure as a result of the 1% rule through legislative change. Joint and Several Liability Paper The Board approved The Case for Joint and Several Liability Reform in Ontario. Joint and several liability provisions are having a significant impact on litigation and municipal governments and their insurance. The courts may oblige a defendant (i.e., a municipality) which is only 1% at fault, to pay the plaintiff’s entire judgment particularly in cases where another defendant who has greater fault is unable to meet a court ordered award. As “deep pocket” defendants, municipalities, with what some view as seemingly limitless public resources at their disposal through the power of taxation, have often become the targets of litigation. The paper will be formally presented to the Attorney General at a future Memorandum of Understanding meeting. Implementation of the Provincial Municipal Fiscal Service Delivery Review (PMFSDR) The Board received an update on the progress of the PMFSDR implementation working groups. Activities are underway to implement the recommendations in all areas of the review. This includes the integration of employment services across Ontario Works, ODSP and Employment Ontario. Principles to determine the Ontario Works Cost of Administration are being discussed as well as the development of an accountability model in light of the planned upload of costs. Also in the human services portfolio, the consolidation of housing and homelessness programs is being undertaken which includes a new accountability framework and approach to community human services planning. On Court Security, costs

and standards work is progressing. In addition, the commitment to develop an option regarding responsibilities and funding arrangements for roads and bridges has been recently initiated. As with the Review, the implementation is a joint partnership with the appropriate ministries and municipal staff representatives doing the work. Working groups each have an approved terms of reference, work plan and will keep the Ontario-AMO Memorandum of Understanding team informed of the progress. Contact: Petra Wolfbeiss, Senior Policy Advisor, email: [email protected]; phone: 416.971.9856 ext 329 Bill 237: An Act to Sustain and Encourage Improvement in Ontario’s Water and Waste Services This Private Member’s Bill by MPP David Caplan would significantly restructure municipal water and waste water services in Ontario, including requiring municipalities to devolve their water and waste water assets to municipal service corporations for management, requiring water and waste water services serving fewer than 10,000 customers to amalgamate with other water and waste water services, and establishing an economic regulator to ensure full cost recovery pricing among other changes. The Board directed AMO staff to prepare a letter which outlines concerns with the Bill, and demanding full consultation with the sector before legislation is introduced. Long Combination Vehicles Some municipalities in Ontario are part of a one year pilot project by MTO to allow Long Combination Vehicles on Ontario roads. The Board directed AMO staff to request MTO to provide a report with the results of its pilot evaluation program after it has taken place and conclusions have been drawn. Response to Waste Diversion Act “Towards Zero Waste” AMO, Municipal Waste Association (MWA) and Regional Public Works Commissioners (RPWCO) jointly developed a response to the consultation paper on the Waste Diversion Act. The response recommendations support making individual producers fully and financially responsible (EPR) for management of all the material sold into the Ontario marketplace. It recommends that consumer services remain highly accessible, including service in the rural, northern and remote municipalities and that transition planning begin as soon as possible. CUTA Vision 2040 The Board received a presentation from the Canadian Urban Transit Association (CUTA) on “Vision 2040 – A Vision for the Next Generation”. In 2008, the OMERS pension plan fell from a surplus of $82 million to a deficit of $279 million. A contribution rate increase of 0.15% per side effective January 1, 2010 will address the deficit; however, investment losses during the same period will result in a loss of $6.4 billion that must be accounted for over the next four years. Without changes to the plan or an exemption from solvency requirements, the 15.34% combined contribution rate that employers and employees currently pay could grow to more than 22% by 2013. Given decisions made by the Sponsors Corporation may not impact the Plan for more than a year, the time to discuss managing these impacts is now. To move beyond the annual cycle of various specific Plan change proposals by Plan sponsors, MEPCO is developing a long term funding strategy, which will consider all factors influencing Plan health and its future sustainability and affordability for both employers and employees. Ontario now has a significant surplus of coal-free electricity, making it possible for the province to complete the coal phase out ahead of the G20 Summit in Toronto this June. According to an Ontario Clean Air Alliance (OCAA) report released today, Finishing the coal phase-out: An historic opportunity for climate leadership, Ontario’s coal-free generation capacity is now 23% greater than the province’s forecast peak day demand in the summer of 2010, and 27% greater than its forecast peak day demand in 2014. This means we no longer need our dirty coal plants to keep the lights on in Ontario or to ensure a reliable electricity supply! The OCAA is recommending that the province immediately put the coal plants on standby reserve and operate them only in the event of a power emergency or to support grid stability until their permanent shutdown in 2014. Let’s show the world that we do care about our health and our climate. - Key Facts -

- Ontario’s coal-fired generation fell by 73% between 2003 and 2009.

- In 2009 Ontario’s coal-fired output was at its lowest level in 45 years.

- Coal-fired generation is no longer profitable for Ontario Power Generation (OPG). During the first nine months of 2009, OPG received a $294 million subsidy from Ontario’s electricity consumers to compensate it for the operating losses of its Nanticoke and Lambton coal-fired power plants.

- In 2009 Ontario’s coal plants caused 246 deaths and almost 123,000

minor illnesses (e.g., asthma attacks).

- Ontario’s coal phase-out is the single largest greenhouse gas emission reduction initiative in North America – equivalent to taking almost 7 million cars off the road.

PURSUANT to Section 26 of the Planning lcr, R.S.O.,1990, the Corporation of the County of Wellington will hold aSpecial Meeting of Council to discuss the revisions that may be required to the County Offrcial Plan through the S-YearReview on Thursday Februa'ry 25r 2010 beginning at L0:00 a.m. in the Council Chambers atthe Counfy of Wellington Administration Centre,74 Woolwich St., Guelph, Ontario.

PURPOSE OF MEETINGThe purpose of the meeting is to provide information on the S-Year Official Plan review process and provide anopporhrnity for public input on the types of changes to the Official Plan that may be needed.

Key areas for review identified to-date by staff include, but are not limited to:

a) incorporating Planning Act changes that provide for complete application and pre-consultation requirements,and addressing matters of exterior design through Site Plan Control;

b) conformity with the Greenbelt Plan;c) updating the Greenlands System mapping;d) adding 4ha woodlands to the Greenlands System County-wide;e) providing additional protection to the Paris and Galt Moraines; andÐ reviewing policies on agriculture and mineral aggregates.

It is anticipated that additional key areas may result from the public, agency and Council input on the S-Year review.
