DONA ANA COUNTY RESOLUTION NO. ----
RESOLUTION DECLARING BOARD INTENT TO NO LONGER ACCEPT ORCONSIDER ROAD MAINTENANCE APPLICATIONS FOR ROADS THAT DO NOTMEET MINIMUM DESIGN AND CONSTRUCTION STANDARDS, UNDERRESOLUTION NO. 05-22, PENDING BOARD CONSIDERATION OF AMENDMENTSTO THE METHOD FOR ACCEPTANCE AND APPROVAL OF SUCHAPPLICATIONS.
WHEREAS, the Dona Ana County Board of County Commissioners (hereinafterreferred to as the "Board") adopted Resolution Number 05-22 (hereinafter referred to as "05-22") on February 23, 2005, establishing a method by which citizens can apply for Countymaintenance of non-County maintained roads that do not meet minimum design and constructionstandards; and,
WHEREAS, the Board has considered numerous applications for County roadmaintenance of non-County maintained roads pursuant to 05-22, and has identified the need tore-examine the current method for accepting and approving such applications; and,
WHEREAS, the Board wishes to declare its intent to not accept or consider newapplications for County road maintenance for non-County maintained roads pursuant to 05-22until such time as the Board has had the opportunity to formulate changes to the method foraccepting and approving such applications.
NOW, THEREFORE, BE IT RESOLVED that the Dona Ana County Board of CountyCommissioners hereby declares its intent to no longer accept or consider applications for Countymaintenance of non-County maintained roads that do not meet the minimum design andconstruction standards currently in effect in Dona Ana County, pursuant to Section III ofResolution No. 05-22, that do not identify a funding source sufficient to bring the roads up tothese standards, including all up front costs such as survey and title costs, or that do not presentan opportunity for leveraging funds from other agencies to cover such costs, until such time asthe Board has had the opportunity to formulate changes to the method for accepting andapproving such applications, and to modify Resolution No. 05-22.
BE IT FURTHER RESOLVED that the intent declared in this Resolution shall notprohibit the consideration of any application for County maintenance of a non-Countymaintained road that does not meet the minimum design and construction standards currently ineffect in Dona Ana County, if such application has been submitted to the County DevelopmentReview Committee for recommendation prior to the date of this Resolution.
