Ddt seem to havebreachedAustralian PrivacyPrinciple6, specifically 6'1:' 61 tf an Appentityhtolds personalinformationaboutan individual that wascottectdd for a particularpurpo.se (fhe primary purpose), the entitymust notuse ordisc/osetheinformation for another purpose(the secondary purpose)unless;POBox412,FairfieldVIC 3078ph/Fax:g4B1-0ggg Email:email2jphillips@yahoo.com.auMobile:04 17 570197ABN: 85 403 892030the individual has consentedto the use or disclosureaf the information;b.subc/ause 6.2 or 6.3 appliesin relationto the useor disclosure of theinformation.Needlessto say, theexemptions in 6.1(a) and 6.1 (b) do not apply to the factthatyou are using personalinformationinappropriately.You havebeenasked,beforeyouproceededany further,to provideSomeextremelybasic informationabout the natureof your informationcollection,includingbut notlimitedto the privacyof that information,and howyourorganisition or DET (who you represent)will dealwiththat information'Youhave beenasked how you will protectparentsand studentsfrom victimisation.Not onlyhas there beenno responsefromyouor yourclient, but youcontinueto write to individualsand telephonethem, as if these issues had never beenraised.3. Whatyou and yourclient have managedto eliminate, in a relativelyshortspaceof time,is any faith or trust fromthecommunitythatDET mayhavebeencapableof an unbiased, professionalenquiry.Not manyorganisationscouldachievesucha resultin such a short time.I stronglysuggestto youfor the sakeof yourorganisation's reputation(whichisalreadyifuite batteredas a resultof yourapproach),that you ceaseand desistcontaiting individualsusing private informationwhich you haveno right to useforthis purpJse. ln factI suggestthat if either you'or yourclientwere eversincereaboutinvestigatingthe educational negligencein this region,that the onlycourseof actionfor you-rorginisationis to withdraw.
