A Russian legal entity (the Borrower) borrowed money from a foreign bank (the Lender) under a loan agreement (the Loan Agreement). The Borrower’s obligations under the Loan Agreement are secure by an agreement of pledge (mortgage) of certain real estate assets of the Borrower (the Mortgage Agreement). The Borrower fails to make due repayment under the Loan Agreement and bankruptcy proceedings are initiated against it. What would be the priority of the Lender’s claims under the Loan Agreement, and what is the maximum amount which the Lender may expect to get for satisfaction of its claims out of proceeds of the sale of the assets that the Borrower pledged to the Lender under the Mortgage Agreement?

“My experiences at the firm have led me to conclude that White & Case is the best place to work. The work at this firm is groundbreaking, complex and difficult and the associates are demanding. However, work never gets boring or less exciting.”
“The trainings are impressive: I find presentations by experienced speakers to be very useful, especially because they cover such specific topics, which are not part of universities’ curriculum.”
“The friendly environment makes the job enjoyable. Cultural events perfectly relax you so you can work most efficiently, and also provide the possibility to abstract from the work and get closer to the colleagues.”
“White & Case summer program gives you a brilliant opportunity to see from inside how an inter-national law firm works. During this time you will also try yourself in different areas of law which will help you to understand your preferences for the future.”

“I felt totally unprepared for life in a law firm. I was surprised when White & Case made me an offer during my 3rd year of study, but I received intensive training and guidance and work with Partners from Day 1. Now I feel I am an important and valued member of the finance team.”

“The White & Case Summer Program is not only about working hard and gaining legal experience, it is also about friendship, personal development and broadening your horizons.”
“The most surprising thing so far is the scope and quality of the projects the Firm handles. They involve established national and foreign corporations and are very complicated and significant. I was very proud to read in the mass media about one of the current transactions to which I had made a modest research and analysis contribution.”
