EmailIntheyear2010,wedidablogpostonbecomingacontractorinKenya.Inthatpost,wehadstatedsomerequirementswhichhavesincebeenovertakenbyeventssincewenowhavetheNationalConstructionAuthorityAct,2011(No.41of2011)whichismandatedtoregulatetheindustry.

Tothiseffectandsubjecttoprovisionsundersection15and16oftheAct,apersonorfirmshallbeeligibleforregistrationiftheperson:

a)HoldsacertificateofincorporationfromtheRegistrarofcompanieseitherasalimitedliabilitycompany,partnershiporsoleproprietorship

b)Incaseofalimitedliabilitycompany,theMemorandumandArticlesofAssociationiscertifiedbytheRegistrarofCompanies

c)HasatechnicaldirectorwhoshallbeauthorizedbytheBoardthroughBoardresolutiontotakeresponsibilityonalltechnicalmatters.

d)ProvidestheAuthoritywiththecurriculumvitaeforeachDirector/Partner

e)ProvidestheAuthoritywiththePIN,VATandTaxComplianceCertificates.

f)Providesevidenceofexistenceofabankaccountinthenameoftheconstructioncompany.

ItisworthytonotethattheNationalConstructionAuthorityrequirestheapplicationforregistrationasacontractorbemadeintheprescribedformandonpaymentofaprescribedfeedependingonthecategoryofregistration.

SmallconstructionworksuptoamaximumofKshs.5,000,000.00cannowbeundertakenbyaccreditedpersonsi.e.ConstructionSiteSupervisorsmandatedbytheNCA.However,theaccreditationofconstructionsitesupervisorandconstructionworkershallbevalidforaperiodof36months(renewable).

Conclusion:

Therequirementthateverycontractorhaveoneofitsdirectorasthetechnicaldirectorwithfullresponsibilityforconstruction/technicalmatterisboundtoseearealigningofmanyconstructioncompanies.

ThepreviousregistrationofcontractorsbyvariouslineministriesandPublicWorksshallnolongerbeused

includingtheClassificationsintocategoryAtoH.WenowhaveclassNCA1toClassNCA7astabulatedabove.

Thereisalsoboundtobeagreaterstreamliningofthesectorsincewenowhaveasinglebody(theNCA)tocoordinatealltheaffairstouchingonconductandpracticeofcontractors.
