endorsementoftheUNGuidingPrinciplesonBusinessandHumanRights(UNGPs),aseminaldevelopmentinrecognizingcorporations’humanrightsresponsibilities.TheDepartmentofJusticeplaysacrucialroleinensuringtherealizationofsuchcommitmentsbyenforcingexistinglawsandadministeringjusticefairlyandimpartially,howeverpowerfulandwealthythedefendantmaybe.Whencorporationscommitwrongdoingsthathavehumanrightsimpacts,theyveryrarelyareheldtoaccount.Suchcorporateimpunityhasaperniciouseffectonoursocietyasitdeniesjusticetovictimsofthecrime,weakenstheruleoflaw,andcreatesanunevenplayingfieldforlaw-abidingbusinesses.TheDepartmentofJusticeistaskedwith“seek[ing]justpunishmentforthoseguiltyofunlawfulbehavior.”2Thisshouldincludeprosecutionofhumanrightscrimes,includingwhensuchviolationsoflawarecommittedbycorporations.Eradicatingcorruptbusinessespracticesabroadisanessentialsteptoprotectinghumanrightsandensuringcorporateaccountability.Expertshaverecognizedthatwherecorruptioniswidespread,humanrightsaresubjecttoabuse.3OneofthekeylawsincombattingcorruptionabroadistheForeignCorruptPracticesAct(FCPA)whichbarsAmericanbusinessesfrommakingcorruptpaymentstoforeignofficialsandengaginginfinancialfraud.Unlikeotherareasofthelaw,FCPAenforcementhasbeenrigorousandproveneffectiveinpunishingcorruptbusinessactorswhilepromotingeconomicgrowthbyensuringafairandcompetitivebusinessenvironment.
