Now COMES RELATOR Nancy S. Toliver and objects to Respondents
Motion for Judgment on the Pleadings/Motion to Dismiss filed on May 29, 2013.
RELATOR Toliver request this Court deny Respondents Request to Dismiss the
RELATOR Complaint with Oral Hearing Demand, render Respondent(s) initial
pleadings to be prohibited by law, rendered judgment in favor of the RELATOR
as the non-moving party and construe most favorably the credible and reliable
evidence submitted with RELATOR Toliver Original Complaint for Writ of
Mandamus. The following Memorandum in Support is attached.
Motion for Tudgment on the Pleadings Standard:
Civil R.12(C) provides that after the pleadings are closed but within such
time as not to delay the trial, any party may move for judgment on the pleadings.
Under Civ.R.12 (C), dismissal is appropriate where a court (1) construes the
material allegations in the complaint, with all reasonable inference to be drawn
there from in favor of the nonmoving party as true, and (2) finds beyond doubt
that the plaintiff could prove no set of facts in support of is claim that would
entitle him to relief, State ex rel. Nliclwest Pride IV, Inc., v. Pantious (1996), 75 Ohio
St.3d 565, 664 N.E.2d 931.
Thus, the granting of a judgment on the pleadings is only appropriate
where the plaintiff has failed to allege a set of facts which, if true would establish
the defendants liability. Walters v. First Natl. I3rank of Newark (1982), 69 Ohio St.2d

677, 433 N.E.2d 608; Siemientkowski v. State Farm Ins. Co., Cuyahoga. App. No.
85323, 2005-Ohio-4295. The granting of a Civ.R.12 (C) motion requires the court
to determine that the movant is entitled to judgment as a matter of law and may
only be granted. when no material factual i.ssEZes exist. Id.; Burnsicle v. Leimbach
(1991), 71 Ohio App.3d 399, 594 N.E.2d 60.
The determination of a motion for judgment on the pleadings is limited
solely to the allegations in the pleadings and any writings attached to the
pleadings, Peterson v. Teodosio (1973), 34 Ohio St.2d 161, 165, 297 N.E.2d. 113.
A Civ.R.12 (C) motion for judgment on the pleadings has been
characterized as a belated Civ.R.12 (B) (6) motion, and the same de novo
standard of review is applied to both motions. Gawloski v. Miller Breu^ing Co.
(1994), 96 Ohio App. 3 160, 1.63, 644 N.E.2d. 731. Unlike a court review of a
motion to dismiss pursuant to Civ.R.12 (B) (6), when reviewing a motion for
judgment on the pleadings, a. court may look at both parties pleadings, but must
construe the evidence in a light most favorable to the non moving party.
Thus when reviewing a Civ.R.12 (C) motion, the trial court's inquiry id
broadened to include consideration of the material allegations in the defendant's
pleadings, but the court is still restricted from consideration of evidentiary
rnaterial. Similar to a review of a Civ.R.12 (B) (6) motion, the trial court must
accept material allegations in the pleadings and all reason.able inferences as true.
Gawloski at 163.
Further, when a document is attached to and incorporated by reference
into the complaint, it may be considered as part of pleadings. See e.g. Vail v. Plain
Dealer Publishing Co. (1995), 72 Ohio St. 3d 279, 649 N.E.2d 182
judgment on the pleadings may be granted under Rule 1.2 (C) where the
material facts are undisputed and when judgment on the merits is possible
merely be considering the contents of the pleadings. Sellers v. M.C. Floor Crafters,
Inc., 842 F.2d 639 (2d Cir. 1988), If, after a review of the pleadings, the Court is
convinced that the plaintiff can prove no set of facts in support of his claim
which would entitle him to relief, judgment on the pleadings may be
appropriate. Conley v. Gibson, 335 U.S.41, 45-46 (1957).
The office of the motion for judgment on the pleadings or for summary
judgment is for practical purposes the same, and often are both applicable, but if
it is necessary to considers matters outside pleadings, mofion for judgmen.t on
the pleadings is to be treated as a motion for summary judgment, and neither can
be granted if there is any genuine issues as to any material fact. National Sur.
Corp. v. First i'vat. Bank in Indiana, D.C.Pa.1952, 106 F. Supp. 302, 304.

Civ.R.10 (D) (1), does not retluire a claimant to attach all documents
relative to the claim, but "only the written instrument upon which the claim is
founded must be attached to the pleading. Firtk, Gre.enbaurrz & Wilson, Guide to
the Ohio Rules of Procedure, Section 10-6,10-9 (2001).
MEMORANDUM IN SUPPORT1. RELATOR Nancy S. Toliver filed an Original Complaint for Writ of
Mandamus against the Respondent(s) Montgomery County Board of County
Commissioners and Montgomery County Jobs and Family Services Division on
May 2, 2013 pursuant to S.Ct.Prac.R.12.02 (A) (B).
2. Respondent(s) filed an answer to RELATOR Toliver Original Complaint for
Writ of Mandamus on May 22, 2013 pursuant to S.Ct.Prac.R.12.04 (A) (1).
3. Pursuant to S.Ct.Prac.R.12.04 (A) (1) except as provided by S.Ct.Prac.R.12.08
and 12.09, the respondent shall file an answer to the complaint or a motion to
dismiss within twent^t^one daus of service of the summons and complaint.
4. Pursuant to S.Ct.Prac.R.12.04 (B) (1), RELATOR Toliver may not file a motion
for judgment on the pleadings or a response to an answer.
5. Respondent(s) filed a Motion for Judgment on the Pleadings/ Motion to
Dismiss with the Court on May 29, 2013.
6. Pursuant to S.Ct.Prac.R.12.04 (B) (1) the respondents may file a. motion for
judgment on the pleadings at the same time an answer is filed.

7. Pursuant to S.Ct.Prac.R.4.C11(B)(1) which states in pertinent part; if a party files
a motion with the Suprenie Court, any other party may file a response to the
motion within ten days frozn the date the motion was filed., uiiless otherwise
provided in these rtiles or by order of the Supreme Court.
8. Only Motions to Dismiss were filed in the following Original Action for Writ
of Mandamus 2013-0565 filed April 8, 2013, 2013-0705 filed May 6, 2013 and 2013-
0490 filed March 25, 13.
9. (Jnly Answers were filed in the following Original Action for Writ of
Mandamus: 2013-0643 filed Apr.il. 22, 2013; 2013-0689 filed May 2, 2013, and 2013-
0216 filed on January 22, 2013.
10. An Answer and Motion to Dismiss was filed on May 15, 2013 in case 203-
0784.
11. Pursuant to S.Ct.Prac.R.1.2.04 (B) (4), the Clerk of the Supreme Court shall.
refuse to file a response that is untimely or prohibited by this rule.
12. The office of the motion for jud;inent on the pleadings or for summary
judgment is for practical purposes the same ............. and neither can be granted

1.4. Pursuan.t to Ohio Civil R. 7(a), there shall be a complaint and answer filed No
other pleadings shall be allowed except, that the Cou.rt may order a reply to an
answer or a third party answer.
15. Respondent(s) filing of the Motion for Judgment of the Pleadings/Motion to
Dismiss on May 29, 2013 without leave of the Court pursuant to CivilR.15
violatesS.Ct.Prac.R.12.04 and Civil R.12 (C).
16. Respondent(s) failure to file both initial pleadings at the same time as
required by the rules of the Court must render the pleadings inadmissible before
the Court pursuant to S.Ct.Prac.R.12.04 (B) (4) and also violated OhivCivilR.7(A).
17. RELATOR respectfully reqltests the Respondent(s) Answer and
Respondent(s) Motion for Judgment on the Pleadings/Motion to dismiss are
considered prohibited by the rules of this Court and the Ohio Civil Rules of
Procedure.
Civ.R.10 (D) (1), does not require a claimant to attach all documents
relative to the claim, but "only the written instrument upon which the claim is
founded must be attached to the pleading. Fiizk, Greenbaum ^'^ INilson, Guide to
the Ohio Rules of Procedure, Section.10-6, 10-9 (2001).
18. RELATOR Toliver did attached to the Original Complaint for Writ of
Mandamus the Opinion and Order for the State Personnel Board of Review

dated June 27, 2008 and the Reconsideration Denial Letter dated July 16, 2008 as
evidence to support Complaint for Writ of Mandamus.
19. RELATOR requests for a meeting to discuss an amicable resolution to the
issues now before this Court was r.efased by the Respondent(s) and its Counsel
in the letter for the Assistant Prosecutor Office dated Apri122, 2008.
20. Respondent(s) stated in a letter dated April 22, 2013 f:rom Assistant
Prosecuting Attorney Julie A. Droessler in pertinent part: :I am responding to
your telephone message. I reviewed your OCRC Conciliation Agreement which
discusses the conditions in which you could have been reinstated to your former
posltlon..........., you did not meet the conditions set forth in 9a and 9b of the
Agreement to be reinstated ( Exh'ibit No. 10 )
21. Respondents have relied on the fraudulently obtained conciliation
agreement(s) signed by the parties at the Ohio Civil Rights Commission on April
28, 2008 as its excuse to ignore or comply with the State Personnel Board of
Review Order dated June 27, 2008 and RELATOR.
22. Respondent(s) as the appointing authority failed to comply with 9b of the
agreement which states in pertinent part:
Respondent(s) will schedule the physical exam at Med Works and notify
Charging Party of date and time. (Exhibit No. 11)

23. Respondent(s) failed to submit any evidence that a physical examination was
scheduled at Med Works the week of'Vlay 12, 2008 per the conciliation
agreement.
24. Instead RELATOR Toliver received letters for BWC dated April 28, 2008 and
April 29, 2008 and May 5, 2008. Respondent(s) had scheduled RELATOR Toliver
for a BWC Independent Medical Examination on May 13, 2008 and May 19, 2008
but failed to schedule the Med Works on May 12, 2008, set out in the
fraudulently obtained conciliation Agreement(s). (Exhibit No. 12, 1:3, & 14)
25. Respondent(s) failed to disclose to the RELATOR at the mediation hearing
held at the Ohio Civil Rights Commission on April 28, 2008, that the appointing
authority had already ratified an Involuntary Disability Separation on April 15,
2008 which separated the RELATOR as o.f. April 9, 2008 without Notice as
required by law.
26. The Court must construe most favorable for the RELATOR as the nonmoving
party; Peterson v. 7eoelosio; 34 Ohio St.2d 161, 297 N.E.2d 113 (1973) (citations
omitted), that (1) RELATOR has no plain and adequate remedy in the ordinary
course of law, (2) the respondents are under a clear legal duty to perform the act,
and (3) RELATOR has a clear Iegal right to the relief prayed for State ex rel. Ber^ger
v. McMonugle, 6 Ohio St.3d 28, 29, 451 N.E.2d 225 (1983) (citations omitted).

27. RELATOR filed an Administrative Appeal to the Final Determination of the
OCRC on July 7, 2008. Respondents are attempting to mislead the Court
regai-ding its knowledge of the Agreement Respondents signed on April 28, 2008.
See Toliver vs. Montgomery County Johs and Family Services 2008-cv-06316.
28. The EEOC Determination dated. August 1, 2008 (FEPA No. DAY B6 (19875));
EEOC No. 22A-2008-02981C) stated in pertinent part:
This concludes the Commissions' processing of the charge subject to the
performance by the Respondent of the promises and representations contained in
the order or agreement (conciliation agreement(s) signed on April 28, 2008.) The
parties are reminded that federal law prohibits retaliation against individuals
who have exercised their right to protest acts they believe violate the laws
enforced by the Commission. These protections exteTid to the indiuiduals regardless of
the Conznaissions determination concerning the merits of the charge.
29. Respondent(s) failure to perform the promises and representation contained
in the OCRC agreement(s) pursuant to the EEOC Determination dated August 1,
2008 must be construed as retaliatory against the RELATOR.
30. Montgomery County Common Pleas Court entered a Decision, Order and
Entry granting Defendants (Respondent(s)) Motion to Dismiss and Final
Appealable order signed. by Judge Wiseman on September 11, 2008. See Case No.

2008-cv-06316. Respondent(s) failed to comply with the Agreement signed on
April 28, 2008 at the Ohio Civil Right Commission.
31. RELATOR filed a Notice of Appeal on October 9, 2008 with the Second
District Court of Appeal Case for Montgomery County Ohio in Case No. 22979
32. EEOC issued RELATOR a Notice of Right to Sue regarding the Respondent(s)
improperly involuntary disability separation on Decenlber 30, 2008 and a copy
was sent to the Montgomery County Human Resource Director Stephanie
Echols. (Exhibit No. 15)
33. The Second District Court of Appeal entered an opinion and final entry
affirming judgment of the lower trial court on July 17, 2009 that appellant was
timed barred for filing the administrative appeal with the trial cour.t. See Toliver
vs.Montgorner,y County Jobs ar2d .Family Services 2009-Ohio-3521 at 34;
34. RELATOR filed a legal malpractice on Apri120, 2009 against its legal
representative that was retained to represent RELATOR in December 2007
regarding the mediation agreement and RELATOR issues with the union as the
twice elected chapter chairperson for Loca1101. See: See Case No. 2009-CV-
03189.
35. The Second District Court of Appeals for Montgomery County Ohio in CA
24768 rendered it decision in 2012-Ohio-846 regarding Case No.09-CV-03189 in
Opinion and Ord.er dated March 2, 2012 stated in footnote 4 of the opinion stated

in pertinent: in the case before us, two copies of the signed OCRC agreement
were presented......... Toliver presented a version that includes the "attempt" to
make an appointment language. We accept that as the established version citing
Toliver v. Montgomery County Jobs and Family Servs., 2d Dist, Montgomery No.
22979, 2009-Ohio-3521 at pg. 5.
36. Ohio Supreme Court declined jurisdiction. on RELATOR discretionary appeal
on June 6, 2012. Case No. 2012-0593. A copy of the entry was sent to the Clerks
Office in Montgomery County on June 20, 2012
37. The US Supreme Court denied RELATOR request for a Writ of Certiorari on
in its order dated January 7, 2013. Case No. 12-6870
38. RELATOR contacted the Attorney General Office in January 2013 regarding
the Respondent(s) failure to comply with the State Personnel Board of Review
Opinion and Order and what enforcement rights does the administrative agency
have after rendering an Opinion.
39. RELATOR contacted the state representative office in February 2013
regarding who can enforce the State Personnel Board of Review Order as a state
administrative agency created by the legislature.
40. RELATOR was contacted by Ms. White at the State Personnel Board of
Review Office in late March or early April 2013 because the Attorney General
Office employment law division forward RELATOR letter to them.

41. Respondent(s) reliance on State exre. Terrell v. Phillips 108 Ohio App 237
(1959) is misplaced.
42. RELATOR. has given this Court a satisfactory expianation as to the five year
period in question.
43. In the PURSUIT of Justice and after five years long years of legal battles and
applying for thirty plu.s positions with the Respondent(s), RELATOR just gained
constructive knowledge that a Writ of Mandamus filed with the Ohio Supreme
Court as an Original Complaint was the only remedy left to RELATOR Toliver.

44. Respondent(s) as the moving parties failed to re file the involuntary disability
separation on or after Jcine 27, 2008 as required by law, filed of a Notice of
Appeal with the State Personnel Board of Review and the Court of jurisdiction
within fifteen days of the letter of Reconsideration denial mailed to the
Respondent(s) ].egal counsel. Assistant Prosecuting Attorney Robert Guehl on
July 16, 2008 as required by the law.
45. Respondents as the moving parties failed to meets it burden pursuant to Civil
R. 12(C) when it filed the Motion for judgment on the pleadings/Motion to
Dismiss pursuant to Civil R. 1.2(C) or submit any credible evidence to show why
the Respondent(s) relied on the tentative and fraudulently obtained conciliation

Agreement signed on April 28, 2008. Respondent(s) pleadings are in violation of
the S.Ct.Prac.R.12.04 and other applicable rules cited herein.
46. Respondent(s) remained silent to the State Personnel Board of Review
Opinion and Order filed June 27, 2008 that disaffirmed the involuntary disability
separation as defective after RELATOR Toliver filed the Notice of Appeal with
the State Personnel Board of Review on May 5, 2008 for the last five years.
47. Respondent(s) pursuant to the Doctrine of Laches, failed to meet the four
prong test, namely (1) what caused the unreasonable delay or lapse of time in
asserting a right to an Notice of Appeal as required by law, (2) failed to give an
excuse to the Court for the delay, (3) knowledge, actual or constructive, of the
injury and wrong, and (4) prejudiced RELATOR Toliver by ignoring the
administrative agencies Opinion and Order State ex rel. Polo v. Ctiyahagcz Cty. Bd of
Elections, 74, Ohio St.3d 143, 656 N.E.2d 1277 (1995) and failed to return the
RELATOR to position of employment held since September 1999.
48. The State Personnel Board Reconsideration Denial letter dated July 16, 2008
was addressed to former. Assistant Prosecutor Robert Guehl. Equal Employment
Opportunity Commission Determination Dated August 1, 2008 was addressed to
the Human Resource Director for Jobs and Family Service Division. (Pet. 26&27)

49. Respondent(s) has not displayed any remorse for their discrimination,
prejudicial, fraudulent and unconscionable actions against RELATOR after more
than eight years plus of service with the Jobs and Fa.mily Services Division. under
the appointing autliority Montgomery County Board of Commissioners.
50. It is the Respondent(s) silence that has caused th.e RELATOR and her two
children unnecessary hardship(s). RELATOR had been a great employee with the
knowledge skills and ability to complete the essential daty of the position(s)
prior to the involuntary disability separation ratified by Commissioners without
notice to RELATOR unti.l one day after Respondents obtained the signature of
the RELATOR on the tentative and unenforceable conciliation Agreement signed
by the RELATOR legal representative.
51. Respondent(s) only concern is the alleged hardship it would cause, when in
the interest of justice, this Court renders a decision ordering the respondents to
pay five years of back pay, lost benefits, compensatory and other damages as
required by law and return RELATOR to her position and ariy other action
deemed appropriate by this Court within its discretion.
52. Respondent(s) public policy states in pertinent part: disability separation is a
termination of employmertt with reinstatement rights for up to three (3) years....
If approved for disability retirement through OPERS, you would have

reinstatement rights for up to five (5) years from the effective date of disability
retirement. (Pet. Exhibi_t No. 2a)
53. Respondent(s) actions in ignoring tlhe adininistrative agencies opinion and
order as an appointing authority must be deemed an act of retaliation against the
RELATOR. by the appointing authority and its subdivision by this Court for
Respondent(s) failure to comply within a reasonable amount of time.
54. Respondents failure to promptly comply with the administrative agency
order has caused the RELATOR undue harm, prejudiced the RELATOR and has
caused RELATOR extreme financial hardship, emotional pain and suffering, loss
of benefits, loss of RETRO upgrades, wage increase and promotional
opportunities for the last five years, and employee benefit package.
55. In this pursuit of Justice, RELATOR Toliver only remedy was to file the Writ
of Mandamus action against the Respondent(s).
WHEREFORE, RELATOR Toliver requests the Respondents Motion for
Judgment on the PleadingsJMotion to Dismiss and Respondent(s) Answer that
be stricken from the record, render a favorable decision to tlze RELATOR/non
moving party based on the Original Complaint for Writ of Mandamus and Oral
I-iearing Demand and the reliable credible evidence submitted with the
Complaint.

RELATOR Toliver pursuant to ORC 2371..06 request the Court issue a
peremptory Writ of Mandamus directing Respondent(s) to comply with the State
Personnel Board Opinion an Order dated June 27, 2008.
In the alternative, RELATOR Toliver request that the Court issue an
alternative Writ requiring Respondents to show cause, why the requested
peremptory Writ should not be issued, or that pursuant to S.Ct.Prac.R.12.10 refer
this matter to a master commissioner for an oral argument.
Further, RELATOR request that the Court Order Respondent(s) to pay the
costs of this action. RELATORS' damages pursuant to ORC 2731.11. and all other
such relief to which RELATOR may be entitled, including but not limited to an
injunction the Respondent(s) as the appointing authority to counsel all
management and supervisory employees regarding the Respondents' obligation
under Title VII of the Civil Rights Act and the American with Disabilities Act
and order to provide to the Court a report describing the manner in which it will
satisfy the obligations and to cease and desist such unlawful actions in the fu.ture
against RELATOR and any other public employee in a srmilar situation.
RELATOR requests to be made whole.
