AN ORDINANCE OF THE MUNICIPALITY OF ANCHORAGE AMENDING THE 1 ZONING MAP AND APPROVING THE REZONING OF THE NE1/4 OF THE SE 2 1/4 OF THE SW1/4, PTN, SECTION 29 FROM R-1A (SINGLE-FAMILY 3 RESIDENTIAL – LARGER LOT) DISTRICT TO R-3 SL (MIXED RESIDENTIAL 4 WITH SPECIAL LIMITATIONS) DISTRICT AND TO REZONE THE E1/2 OF 5 LOTS 7, 8, AND 9, BLOCK 22, POGGAS SUBDIVISION (PLAT P-236) FROM R-6 1A (SINGLE FAMILY RESIDENTIAL – LARGER LOT) DISTRICT TO B-3 SL 7 (GENERAL BUSINESS WITH SPECIAL LIMITATIONS) DISTRICT, ALL 8 APPROXIMATELY 3.31 ACRES AND WITHIN THE SW 1/4 OF SECTION 29, 9 T12N, R3W, SEWARD MERIDIAN, ALASKA, GENERALLY LOCATED WEST 10 OF THE OLD SEWARD HIGHWAY, SOUTH OF OCEANVIEW DRIVE, AND 11 EAST OF VENUS WAY. 12 13 (Old Seward-Oceanview Community Council) (Planning and Zoning Commission Case 2016-0093) 14 15 THE ANCHORAGE ASSEMBLY ORDAINS: 16 17 Section 1. The Assembly finds the recommended zoning map amendment 18 described in this section and in the accompanying memorandum for the property 19 described below satisfies the criteria of anchorage Municipal Code section 20 21.03.160E. and is hereby approved. The zoning map shall be amended by 21 designating the following described property as R-3 SL (Mixed Residential with 22 Special Limitations) District: 23 24 The NE1/4 of the SE1/4 of the SW1/4, PTN, Section 29, T12N, 25

R3W, Seward Meridian, Alaska, generally located west of the Old 26 Seward Highway, South of Ocean View Drive and east of Venus 27 Way, as shown on Exhibit “A”. 28

29 Section 2. The zoning map amendment established in Section 1 shall be 30 subject to the following special limitations: 31 32 1. Providing a 20-foot wide buffer along the west boundary of 33

the NE1/4 of the SE1/4 of SW1/4, PTN, Section 29, T12N, 34 R3W, S.M., Alaska. 35

36 2. Submitting a site plan to the Planning Department for review 37

The Assembly finds the recommended zoning map amendment 1 described in this section and in the accompanying memorandum for property 2 described below satisfies the criteria of Anchorage Municipal Code section 3 21.03.160E. and is hereby approved. The zoning map shall be amended by 4 designating the following described property as B-3 SL (General Business with 5 Special Limitations) District: 6 7 The E1/2 of Lots 7, 8, and 9, Poggas Subdivision (Plat P-236), as shown 8

on Exhibit “A”. 9 10 Section 4. The zoning map amendment established in Section 3 shall be 11 subject to the following special limitations: 12 13 1. Providing a 20-foot wide buffer along the west boundary of 14

the E1/2 of Lots 7, 8, and 9, Poggas Subdivision (Plat P-15 236). 16

17 2. Submitting a site plan to the Planning Department for review 18

and approval. 19 20 Section 5. This ordinance shall become effective upon the receipt of the written 21 consent of the owners of at least 51 percent of the property within the area 22 described in Sections 1 and 3 above to the respective special limitations for 23 those rezonings as contained herein, in accordance with AMC 21.03.160G., 24 received within 120 days after the date on which this ordinance is passed and 25 approved. 26 27 Section 6. 17 On September 12, 2016 the Planning and Zoning Commission (PZC) approved 18 this rezone with special limitations intended to protect adjacent R-1 zoned 19 property. This requested amendment to the zoning map will rezone the E 1/2 of 20 Lots 7, 8, and 9, Block 22, Poggas Subdivision from R-1A to B-3 (general 21 business) district. Adjacent lots 4, 5, and 6 are currently zoned B-3. In addition to 22 the B-3 rezoning, an un-subdivided parcel located at the southwest corner of the 23 Jarvis Avenue-Old Seward Highway intersection is included in the application 24 with a request to rezone the parcel from R-1A to R-3 (mixed residential) district. 25 These parcels are located north of Jarvis Avenue and west of the Old Seward 26 Highway. 27 28 The proposed rezone is associated with a larger platting action in the area, which 29 will correct current deficiencies and bring the proposed parcels into compliance 30 with Title 21. A map depicting these changes can be found in the attached 31 packet. 32 33 Single-family residential subdivisions are located on the R-1A zoned property 34 that adjoins the west petition site boundary on the north and south sides of Jarvis 35 Avenue rights-of-way. To address the impact of the commercial and multi-family 36 zoning districts, the PZC required Special Limitations with this rezone. These 37 included a requirement for a site plan review with any new development and a 38 20-foot wide buffer (rather than the required 15-foot wide buffer) separating the 39 rezone area from adjacent residentially zoned property. 40
