March 2002: Colonies Partners sues SanBernardino County over flood-controleasements on the company's 434-acreresidential and commercial developmentn Upland.

September 2003: A San Bernardino

County judge rules in favor of ColoniesPartners. The county appeals.

February 2005: An appellate court issuesa tentative ruling favoring SanBernardino County.

March 2005: Then-Supervisor BillPostmus and Supervisor Paul Biane,without lawyers, negotiate with Colonies

and reach a tentative $77 millionsettlement. The county's lawyersrespond with a memo that says the dealraises too many questions. Thesettlement is not approved by the fullBoard of Supervisors.

July 2005: An appellate court orders anew trial.

April 2006: A new trial begins.

July 2006: San Bernardino CountySuperior Court Judge ChristopherWarner issues a tenative ruling in favorof Colonies Partners.

November 2006: In a 3-2 vote, SanBernardino County supervisors apa $102 million settlement with ColoThe county pays the company $22 min cash and issues $80 million in bto pay for the rest. Postmus, BianSupervisor Gary Ovitt vote in favothe settlement. Supervisor JosieGonzales and then-Supervisor DeHansberger vote no.
