UpdatedSeptember15,2017PleaseseetheinformationbelowregardingSection1104oftheUILConstitutionandContestRulesasitpertainstomarchingbandsandcopyrightcompliance.Section1104,CopyrightCompliance,inrelevantpart,statesthefollowing:(a)COMPLIANCE:CompliancewithcurrentcopyrightlawisrequiredofallparticipantsinUILmusicevents.ViolationsaresubjecttothepenaltiesoutlinedinSections27and29.UILexpectsthatallparticipantschoolscomplywithallapplicablecopyrightlawsatitsevents.Itissolelyaschool’sresponsibilitytodeterminewhatlicensesmayberequiredandtoobtainanyandallnecessarylicensespriortoparticipationinaUILevent.Suchlicensesmayinclude,butarenotlimitedto,arrangementlicensesorsynchronizationlicenses.UILrecommendsthataschoolwithquestionsregardingitsparticularmusicalperformanceandassociatedlicensingrequirementscontacttheschool’slegalcounsel.Forthe2017-2018schoolyearUILwillnotbesellingDVDsoranyothertypeofvideorecordingsofregion,area,orstatemarchingbandcompetitions.UILdoesplantoofferalivestreamofthestatecompetition.Detailsonthatbroadcastwillbepostedathttp://www.uiltexas.org/music/marching-band/stateastheybecomeavailable.UILwillalsoallowasinglevideoofaschool’smarchingbandperformancetobemadefromadesignatedlocationatthecontestvenuewiththestipulationthatsuchavideobeusedsolelyforeducationalpurposes.Aschoolmaynotusethevideooftheirmarchingband’sperformanceforanycommercialpurpose,normaytheyallowanythirdpartytomakeanycommercialuseofthevideo.Aschoolwishingtomakeaneducationalusevideooftheirmarchingband’sperformancemustsignandsubmitaUILformthatsetsoutthetermsandconditionsforthecreationanduseofthislimited-usemarchingbandvideo,nolaterthansevendayspriortotheschool’sUILcontest.TheUILMarchingBandEducationalUseVideoAgreementformmaybefoundat:https://www.uiltexas.org/machform/view.php?id=388184Note:Aschoolwishingtosubmitthisformmustonlydosoonceduringthecurrentschoolyear.PleasecontacttheOfficeoftheUILStateDirectorofMusic(512)471-5883ormusic@uiltexas.orgifyouhaveanyquestions.
