Understanding Economic Loss Analysis

Whether bringing or defending a personal injury, wrongful death, employment discrimination, or other lawsuit where damages are contingent on various types ofeconomic loss, it is incumbent upon the attorney to have a thorough understandingof how the economic projections are determined, what set of assumptions the projections are based upon and the different rules applicable to the type of case.
Joel R. Evans, a consultant in Economics and Business, will provide attorneyswith the tools they need to understand economic loss analysis.

The most critical point in litigation is the pre-trial deposition stage where manypersonal injury and commercial cases are virtually won or lost. This programtakes a practical approach to teaching the basic deposition skills, techniques forhandling commonly encountered problems and using depositions at trial.

This program will examine the pitfalls of real estate transactions from two pointsof view: that of the private practitioner and mortgage attorney and that of the titleinsurance industry.
Some of the issues the panel will discuss include:•How to spot deceptive advertising.•How to read the mortgage documents to spot predatory practices.•How to cope with the ever more complex paperwork involved in real estate transactions.

The private practitioner and mortgage attorney's perspective will be presented byWILLIAM J. HORAN, an MBA and J.D. engaged in private practice for twodecades before joining Delta Funding in 1998 upon the creation of its GeneralCounsel's Office. The New Attorney Advertising Rules: Ethical Ramificationsof the New Rules on the Practice of Law in New York

Expansive new rules governing attorney advertising and solicitation of business by attorneys are scheduled to take effect on January 15, 2007. ChiefAdministrative Judge Jonathan Lippman called the rules “sweeping reforms,”and stated that they “address[ed] the many issues raised over the last decade inrelation to advertising, as well as bringing the rules into sync with moderntechnology.”
The rules deal with numerous issues -- from restricting the solicitation of personal injury and wrongful death clients who were victims of mass torts suchas the World Trade Center disaster, to restricting the use of testimonials andendorsements, non-attorney celebrity voice-overs, re-enactments of courtroomand accident scenes and fictionalized nicknames or monikers. The rules havealso been updated to cover all forms of electronic communications - from Webpostings, to pop-up ads, e-mails, and other communications with potentialclients using the Internet. Further, strict new filing and retention requirementsfor attorney advertisements have been imposed, and will now be subject toreview by the disciplinary committee of the State.

Co-ops and Condos - A Practice Guide for the NewYork Attorney
This program, sold out in prior presentations, provides the skills necessary toeffectively represent purchasers and sellers of individual co-operative and condominium apartments. The entire transactional process will be discussed -from the first client call to the final closing.
Attendees will gain useful insight into many important issues involved in negotiating and finalizing the co-op/condo real estate deal, including:•Conducting due diligence - reviewing the co-op/condo association's organizational and financial documents;
•Contract negotiations and drafting, including essentials for contract riders;•Contract deposits and escrow considerations, as well as other ethical considerations, including avoidance of conflicts;
•Title, judgment and lien search issues; •Financing considerations, including dealing with mortgage brokers, lenders and lenders' counsel; and
•The ACRIS recording system, implemented by the City Registrar, requiring a change in the recording process for real property, condominium and cooperativesin each of the five counties.
Further, the program will provide an overview of how to prepare for and conducta successful closing, including preparing the closing statement and other postclosing considerations.

Bringing a child custody case is a difficult task under the best of circumstances.But, when mothers and/or children are the victims of domestic violence, theissues become even more exacerbated. This panel of experts will focus on thespecial intricacies involved in these child custody cases, and how to successfullyrepresent your clients.
Some of the topics to be covered include:•How to recognize whether your client is a victim of abuse or battering; •The psychological ramification of abuse; •The appearance of battered spouses and the batterers; how to successfully deal with their appearances in court;a
