1 - Apprentice Ratios

• Not knowing what the proper ratios are per classification

• Having incorrect ratios

• Not paying apprentices appropriately

2 - Conformances

• Not requesting conformances

• Using incorrect classifications

• Not paying restitution if conformances come back approved at a higher rate

3 – Employee Payment

• Paying bi-weekly

• Paying monthly

• Paying “per piece” instead of hourly

4 - Trucking Brokers

• Turning in Certified Payrolls with Owner-Operators on them

• Not paying correct prevailing wages

• Improperly listing Teamsters as 1099 contractors

5 - Wage Determinations

• Utilizing an incorrectly dated wage determination

• Utilizing the wrong construction type of wage determination

• Not including a copy in lower tier subcontracts

• Referring to Davis-Bacon requirements by referring to Prime Contract

• Not including proper flow-down provisions in subcontracts

• Not being aware of every contractor on a project site

• Not being aware of which contractor is performing covered work

11 - Misclassification

• Classifying a covered worker by the wrong craft

• Short paying a covered worker since they are classified wrong
