What We Have HeardFrom CMS

• The CMS Final Ruling expanded on the definition of “availability” to include whether a provider is able to “fully implement” the 2014 version. “Full implementation” as described in the new Final Rule includes such items as: • staff training• system testing and workflow revisions• update and integration • software patches or workflow changes

• To me that is a liberal, and most welcome, CMS interpretation.

• CMS states that the attestation site will be ready by October• This could be mid October

• When we attest how do we notify CMS we are taking advantage of the Rule?• You must swear to a specific statement

during attestation

• How should we document why we took advantage of the Rule?• Document your reasons – bring in help

• What should we do to prepare for audit?• Document, Document, Document

Effective 10/1/14Eligible Hospitals

• Full 365 days reporting period regardless of Stage

• If you were to be Stage 2 Year 1 in 2014 and you take advantage of the Rule — you will be Stage 2 Year 2 in 2015 (10/1/14 to 9/30/15 and Stage 2 Year 3 in 2016 (10/1/15-9/30/16)

• Ready on 10/1/16 for Stage 3

• Under the new rule, ONC will not require EHR vendors or providers to update or recertify their systems; however, it gives vendors the opportunity to make changes to their products
