A SECRET recording has shredded sworn testimony that Melville mayor Russell Aubrey gave Perth magistrates court.
On Tuesday Mr Aubrey swore “before Almighty God” that councillor Nick Pazolli had threatened him during a private meeting in a council boardroom in May.
He testifi ed Cr Pazolli had stood and punched the table “in an extremely violent manner” and had said, “I fucking hate you! I
fucking hate the CEO! I fucking hate the City of Melville! I’m going to get you! I don’t give a fuck about amalgamations! I don’t give a fuck about Roe Highway! I fucking hate you and I’m going to get you!”
He testifi ed Cr Pazolli had then said, “Russell, I’m warning you, I am on the edge,” which Mr Aubrey said he had taken to mean, “he was on the edge of a violent attack”.
“It was a threat of violence and it traumatised me,” Mr Aubrey told magistrate Greg Smith.
Cr Pazolli’s barrister Belinda Lonsdale asked the mayor if he was certain those words had been said, and asked whether Mr Aubrey had “exaggerated the threat”.
“Absolutely not,” the mayor quickly replied. “It is to the best of my memory.”
“You couldn’t be mistaken about that?” Ms Lonsdale asked.
“No,” Mr Aubrey replied.Ms Lonsdale put an alternative
scenario to the mayor, which he also rejected. She then stunned the court by revealing she had a
recording of the meeting—which Cr Pazolli had secretly captured on his iPhone—and asked that it be heard.
Mr Aubrey’s barrister Fulvio Sammut got to his feet to complain this was the fi rst he’d heard of the tape, and in the “spirit of courtesy” Ms Lonsdale should have told him about it. Magistrate Smith said there was no obligation to have done so and allowed the recording to be played.
For the next hour, Mr Aubrey sat in the witness box as the recording demolished his

testimony, following the script he had just minutes before rejected as untruthful. There was no “I am going to get you!” nor “I fucking hate you!” nor “Russell, I’m warning you, I am on the edge”.
The recording showed Cr Pazolli to be clearly angry, but over repeatedly being hauled before the WA local government standards panel by the mayor for alleged breaches of council rules. Sparking Cr Pazolli’s May outburst had been the mayor’s latest complaint to the panel,

Magistrate Smith found Cr Pazolli had not threatened the mayor. He found the words “it’s a threat” and “I haven’t even started yet” likely referred to Cr Pazolli doing what he’d done in the past: Asking probing questions, speaking openly to the press, embarrassing the mayor and possibly going after his job.
“Those words can only be taken to mean that the respondent Cr Pazolli was only going to continue doing what he’d previously been doing,” Mr Smith found.“Those words, when looked at in context, could not be possibly taken to mean he was going to harm or injure or assault the mayor.”

throwing out the mayor’s application.
BARRISTER Belinda Lonsdale put it to Mr Aubrey that his violence restraining order application was part of an ongoing campaign to get rid of Cr Pazolli.
“Mr Pazolli was a thorn in your side, wasn’t he?” she asked the mayor.
“No,” he replied.“You know, don’t you, that
the only way that you and Mr Pazolli could be separated is if one of you dies or one of you is found guilty of a crime that warrants a $10,000 fi ne or a two-year gaol sentence?”
“I believe that’s what’s written in the local government act,” Mr Aubrey said.
“His agitation in the interest of ratepayers drew the ire of the mayor,” Ms Lonsdale said.
Magistrate Smith found Mr Aubrey’s “fear is not reasonable” and the standard of evidence had not been met for his VRO to be upheld.
“I don’t think the mayor was making up the evidence,” Mr Smith said.
“I think he was recalling the events as best he could... this case demonstrates that peoples’ memories are not always accurate.”
A mayoral move to get rid of Pazolli?
MELVILLE CEO Shayne Silcox’s testimony that Cr Pazolli had told him “he was going to get the mayor” was rejected by the court.
Dr Silcox testifi ed Cr Pazolli had told him he would, “get the mayor”.
“I don’t put any weight on that evidence at all... I’m not persuaded those words were said,” the magistrate said.
He noted Dr Silcox had not made notes of the meeting and
CEO’s evidence dismissedhad not called the police.
Dr Silcox’s only action had been to arrange a meeting between the pair that didn’t occur until three months later, indicating a lack of urgency.
Dr Silcox also told the court it was he who had complained that Cr Pazolli had given a document noting the size of budget reserves to the Herald. Mr Aubrey had signed the 60-page complaint to the local government standards panel (which was thrown out).
RUSSELL AUBREY conceded Nick Pazolli was “not a big guy” and testifi ed, “if we both donned boxing gloves in a fair arena I could probably handle myself”.
“Could you handle yourself physically around Mr Pazolli?” barrister Lonsdale asked. “Mr Pazolli’s not a big guy, is he?” Mr Aubrey: “He can certainly hit a table very hard with his fi st.” Ms Lonsdale: “Would you describe Cr Pazolli as ‘not a big guy’?” Mr Aubrey: “Yes, Cr Pazolli’s not a big guy, but then, neither am I. If it came to one-on-one, man-to-man, I could possibly defend myself against Cr Pazolli. But my fear was that he may run me over, take some weapon to me, or attack me when I didn’t expect it.”

CREATIVE parents have been hard at work making hand-made fl oor rugs at Perth Waldorf School in Bibra Lake.
“Farmhouse rugs” are created using random scraps of knitting, felt, embroidery, patchwork and crochet work, donated by the community: Pretty much anything goes.
Young children play on the rugs which are used as teaching and story-telling aids.

“CRUDE” and “ham-fi sted” is how architects describe secret new plans for the redevelopment of Victoria Quay.
Fremantle Ports is refusing to release the drawings but the Herald understands they include scope for three- and four-level carparks with offi ce buildings up to 10 storeys.
Architects engaged to advise Fremantle council were allowed to see the plans but were not invited to provide feedback.
One was scathing: “The port authority is obviously wanting to generate capital from port land which I fully understand,” the architect says.
“However, they have chosen a crude, ham-fi sted approach and it is debatable if their current proposal would be taken up by the market.”
The architect says the quay should redevelop to refl ect its “unique maritime role” with a mix of “low-scale maritime education, marine science, testing and research facilities,” and not “generic commercial buildings”.
“These maritime-focused facilities could be coupled with tourism and entertainment uses and would complement rather than compete with an already struggling city centre.”
The architect says proposed buildings are too big and will hurt council attempts to redevelop the CBD.
“One reason for increasing building heights in the city centre was to o er the potential for better views,” the architect notes.
“Taller buildings on the wharf compromise this potential.”
Fremantle Ports is seeking to kickstart Victoria Quay’s redevelopment following the GFC-related failure of the $350 million ING project.
It commissioned CODA, the fi rm behind the Kings Square redesign, to draw up the new plans.
The Fremantle Inner City Residents’ Association says CODA’s plans signifi cantly exceed the scale expected for the site and are above what CODA itself had proposed in its own documents.
In its own submission to the port authority, FICRA says development should be based
on the 13-year-old waterfront masterplan and Victoria Quay conservation plan.
Mayor Brad Pettitt has seen CODA’s plans. He says they’re a “big improvement” on the ING plan but, “the connections across the railway still are not working as well as we would like, the integration between the port and city is not quite there yet”.
“We want the public transport authority to agree to greater connectivity and opening up the railway forecourt. We hope to have some new concepts to look at in September.”
FICRA says Victoria Quay must complement, not compete with, the existing city fabric.
“Fremantle has a well-defi ned port edge separated from the city by a working railway line,” FICRA member and former deputy mayor John Dowson says.
“The port should not be a continuation of the city centre. The port redevelopment should not try to reinvent a long-standing familiar townscape.
“Arguments put forward in CODA’s report that tall buildings on the port land will help with way-fi nding are simply justifi cation for height.”

Preaching hypocrisyIT is always enlightening to see how many residents in well-heeled areas can be considered socialists at heart, at least when it comes to the property of others.
Following on from the complaints by neighbours of Aquinas College objecting to the college fencing o its own property, we now have members of an Attadale tennis club complaining the parishioners and priest at St Joseph Pignatelli ought to have no right to decide on a new use for the large proportion of their private property (Melville City Herald, August 17, 2013).
The rationale they o er is the tennis club has been permitted to use this land in the past and consider that purpose to be more valuable than the use the owners prefer. This is also despite being offered a range of practical solutions to reduced access, including the local college o ering weekend use of its courts.
I am sure that Mr Muller (Herald letters, August 10, 2013) and any other members of the club—of whom 90 per cent are not parishioners—would be happy to be on the receiving end of the same logic, if Mr Muller found some neighbours decided on what they believed was a better use for his front or backyards, that would be just fi ne by him and he would bow to their superior wisdom.
Or perhaps it is just other people who are supposed to give up the right to use their private property as they wish. In that case, its not socialism but hypocrisy they are preaching.

Tennis elbowedTHE article “The luv of God,” (Melville City Herald, August 17, 2013) was more noticeable for its omissions then its inclusions. Criticism of the letter that appeared the week before for me was all the more distasteful because the parish priest at St Joseph Pignatelli Attadale has always been the tennis club’s patron.
The club has been operating for more than 50 years: I am not a member. I’ve been a member of the parish for almost 30 years and I have never experienced our parish divided over any issue except this proposed new memorial church. Those parishioners that have tried to present a point of view and discuss issues have been gagged.
The most important omission was the proposed new church would never have been considered without
the generous donation recently of some $1 million for the sole purpose of building a memorial church for a deceased parishioner. The fact is the parish approached the diocese some fi ve years ago to build a new church which was rejected because the parish could not fi nance it.
Mention of the columbarium for the internment of ashes of deceased persons in the new church was omitted as was the installation of the bells. The 4.1 per cent increase of parishioners over a decade in my estimation represents less than 20 people.
The fundraising campaign has been running for more than four months, and since the fi rst fundraising evening on May 15, 2013 at Santa Maria when it was announced $1.7 million had been raised in pledges and “in kind” (inclusive of the $1m donation), it seems only $300,000 more has been raised, and in my estimation the campaign has stalled some $2.5m short of the mark.
I am also aware that many concerns relating to the proposed new memorial church in Attadale have been communicated to Perth Archbishop Timothy Costelloe.
I t i s an enormous pi ty the parishioners and stakeholders, including the tennis club, were not provided the opportunity and the courtesy to openly discuss the proposed memorial church when the preliminary plans and budget became available, and before it was heavy-handedly imposed on our parish. Polite requests for community discussions have all been rejected out of hand.
I have advocated meaningful community consultation to discuss the proposed new memorial church; however, the barriers are formidable as your article aptly illustrates.

Barbie bogansTHANK you to those who left a BBQ in the park in George Street, East Fremantle in the most disgustingly dirty state last week.
I’ve seen some BBQs left in a pitiful state in my time but this one takes the proverbial cake. Large pieces of meat were left to rot on the hotplate, encased in a layer of lard, in amongst piles of unidentifi able foodstu s, also cooked.
Scattered amongst all this were discarded food wrappers, items of clothing and a large chunk of half-eaten watermelon.
Thank you for leaving this BBQ in this disgusting mess for the next unfortuate people to use it and I pity the poor old East Freo work team who have the pleasure of cleaning this lot up. A message to the slobs—clean up after yourselves!

There is no more stark example of Labor’s contempt for the blue collar workers of WA than the resources and energy minister and, laughably, small business, continuing to push for the o shore processing of Browse Basin gas.
The irony seems to be completely lost on a media that chastises Colin Barnett for his dogged determination to deliver a huge windfall in royalties, jobs and Aboriginal benefi ts to the state, whilst ex Woodside Labor man Gary Gray continues to push for federal royalties only and an exclusively overseas-built fl oating plant. It beggars belief a pioneering deepwater facility built by the Koreans to be operated in a cyclone area can be cheaper than pipes and steel erected onshore. What has really happened is fi ve years of Labor intervention and strangling red tape have delivered this absurd outcome. Remember also that had our blue-collar crusader Colin Barnett not put up such a fi ght, Gary Gray would have got his way and delivered for Woodside long ago.
Melissa Parke will claim the o shore jobs are in fact Australian jobs, but it’s only the tight and highly paid clique of the Maritime Workers’ Union that will get those positions and all the years of construction work will be done in Asia. Australia has never built a fl oating gas facility of this scale so even the design engineering will be o shored, or ex-pats fl own in.
The Greens will argue o shore is better for the indigenous locals of Price Point. Unlike the Greens I would not pretend to place myself in their shoes, but the benefi ts, royalties and jobs that were to fl ow to the
traditional landholders of this project were unprecedented and a model of what they always should have been. Again, all to have been delivered by WA’s Liberal government and taken away by Labor’s federal WA ministers.
Energy jobsJust take a step back and
imagine if every project in the past 30 years had been designed to deliver so much to traditional owners, the whole equation of Aboriginal prosperity, welfare and equality would be far, far advanced. Its not too late to stop Gary Gray, Melissa Parke and the other Labor candidates exporting all these highly sought-after energy jobs and depriving the Goolarabooloo Jabirr Jabirr of their prosperity.
Luckily WA’s Liberals have stuck their foot in the door.
Fremantle has never been a Liberal seat in its current confi guration: The workers of Fremantle have a chance to make history at this federal election.
I’m not so naïve to think Fremantle will ever be a Liberal stronghold but we have never had a group working so actively against blue-collar workers before. I ask the workers of Fremantle to see through the pandering rhetoric of Labor’s fallacy that it is on your side.

It appears the City of Fremantle has drawn the line for those of us living east of Stock Rd and traded us for Palmyra and Bicton.
I assume the council has judged the residents of Samson and O’Connor do not fi t the “sensible community of interest” criterion and thus are expendable.
The mayor decries the involuntary amalgamation of Fremantle with Melville and I decry the council’s suggested involuntary excision of Samson and O’Connor from the City of Fremantle.
We are told the community survey which I and others completed rejected the idea of amalgamation and a forced merger, but I don’t see where it recommends the excision of Samson and O’Connor.
It seems an irony the names of the two men after whom our suburbs were named, and are an essential part of the history of Fremantle, are now deemed not worthy enough for preservation within the city they served and helped build.
Samson was named for former mayor Sir Frederick Samson, who served Fremantle for more than two decades and whose family home is preserved in Fremantle, and O’Connor for the great engineer CY O’Connor, whose statue stands near Fremantle Harbour, which he designed.

Kitchener hots upI LIVE close to the proposed development at 94 Kitchener Road, Alfred Cove, and I have some serious concerns over the potential for a signifi cant decline in road safety for pedestrians, cyclists and motorists using the local road infrastructure that must inevitably carry more traffi c if the development goes ahead.
By way of example a few possible “scenarios”.
Walking children to Melville primary school from a home south and east of the Kitchener Road/Cottrill Street intersection? In Mullings Way you are forced to walk on the road (no footpath) or Fenton Place (no footpaths) and cross Kitchener Road twice (no designated crossings and in the face of traffi c travelling well in excess of the 50kph limit) to use the single footpath on the northern side.
Cycling west along Kitchener Road? Be aware of dangers from cars parked at parallel indented bays proposed for Kitchener Road.
Turning right from Cottrill Street into Kitchener Road along with the 46 other car drivers heading east in the am peak hour? Across a two-way traffi c fl ow of 550 vehicles per hour on Kitchener Road, with an average gap of 6.5 seconds. Bear in mind that intersection traffi c research has shown a gap ranging from four to nine seconds is the most dangerous for

Tree shameTHE removal of the 12 or more established native trees in the Rob Campbell Reserve, Bicton recently was yet another mindless act of environmental vandalism.
These beautiful trees shaded the local community in the long, hot summer months. They provided a lovely outlook for local residents, better air quality, shade for walkers and their dogs to shelter under and for cars utilising the Bicton Baths.
But Melville council decided a car park was more important. For years locals and visitors to the area used the verge to park under the trees. It seemed to work.
It takes many, many years for any newly planted trees to provide shade. The council may not have any intention of replacing the trees as in other areas of the Melville council. And what about all those displaced birds approaching mating season this spring, homeless.
Yet another senseless decision, by an increasingly, unconscious group of individuals who “pave” our future.

COOLBELLUP may not be on bean geeks’ radar when it comes to co ee, but locals are hoping to remedy that for at least one day with a pop-up cafe planned for election day.
Cooby Now is setting up a java jalopy at the Coolbellup Community School in Waverley Road on September 7. Chairs and tables will go up next to the co ee van from 6am to noon so voters can soak up the cafe experience while pondering their choice for government.
“This election day get down to Coolbellup Community School sometime in the morning to cast your vote—Vote 1 for good co ee and a happening community,” Cooby Now co-founder Katie Attwell says. Money raised will go towards new equipment for the school.

SHOPS in Fremantle are not allowed to hand out single-use plastic bags from next week.
The local law—an Australia-fi rst—applies to all retailers within the municipality. Those who ignore the ban can be fi ned.
“With this local law in place, we hope that the Fremantle community will begin to make a more conscious e ort to move away from using plastics which are having an enormous e ect on our oceans in particular,” says Plastic Free Freo spokesperson Wade Harrison.
“There are many councils in WA paying close attention to the outcome of this initiative in the hopes to do the same.”
Retailers do not have to provide alternative bags but if they do, they must charge at least 10c per bag and the alternatives must be fully compostable.

FREMANTLE city council has challenged architects worldwide to design a major chunk of the $220 million Kings Square project.
As the Herald fl agged back in February, the council has decided to launch an international competition to get global ideas for a proposed new library, visitor centre, civic centre and administration building.
Stage one closes September 10. The design competition is the biggest of its kind in WA since the State Theatre in 2005, which—as it happens—was awarded to Fremantle fi rm Kerry Hill.

Kin admits to not knowing what she’d gotten herself in for when agreeing to Oxfam’s request.
“I thought they meant you walk with a team of four and each walks 25km so I thought I could walk 25km in my sleep, surely?”
Battling blisters, dead toenails and aching muscles are easy compared to the mental challenge.
“When your mind says stop you are generally at 20 per cent capacity,” she says. “You have so much more physical capacity then your mind gives you credit for.
“The message is telling your mind you are about to hit another barrier, but the thing is you can
break through that and break through that again and again, even when you don’t actually agree with the message.
“It is so much of a mental challenge, but when it gets hard you think, why am I doing this again?
“I’m doing this for people who live in dire conditions. I’m doing it to raise money for people from our a uent society and I’ve got a few blisters? Talk about fi rst-world problems.”
The portsider is taking a breather from the bush to do a gig with local musos at the Navy Club on August 30 to raise money.
She will belt out some ‘80s classics with Silky De Haar (Oats Supply) and divas Natalie Gillespie and Anna Wallwork. “It’s a win-win deal,” Kin smiles. “I’m having a ball scouring op-shops for a Pat Benatar outfi t, knowing all tickets go to Oxfam.”

A BICTON woman whose tiny dog was savagely mauled before her eyes by a bull masti says she could been attacked next if not for the actions of a passer-by. She has contacted the Herald in the hope of being able to thank her rescuer, whom she knows only as Lorraine.
Valerie Preston, 61, (pictured, above) had been enjoying a morning walk with toy poodle Poppy in Angove Lane when the big dog lunged.
“It was suddenly upon us and leapt onto her chest, sinking his teeth into her chest and shook her violently,” Ms Preson recalls, still shaken by the June 3 attack.
“This woman got hold of the dog and shoved it into a yard, which wasn’t easy because it had no collar. She the ran to the next property to phone the ranger: “She was marvellous and I have no doubt this big dog would’ve had attacked me if I’d had my dog in my arms. I have not been able to let you know how grateful I was to have you there. It was extremely frightening and distressing.”
The 12-year-old poodle sustained four broken vertebra and puncture wounds. Unable to feed herself or toilet unassisted, she was euthanised three weeks later.
Despite the dog’s owner being charged with o ences under the Dog Act, and the bull masti now declared a dangerous dog, Ms Preston remains concerned it may strike again.
“It’s a real concern because the attack was near Bicton pools, where kids are coming and going. The walkway is a common walkway for people.
“I have been incredibly shaken by it and have had quite a number of anxious moments.”
Melville council CEO Shayne Silcox says the dog’s owner will front court September 3 and faces a $10,000 fi ne if convicted: “The dog has also been declared a dangerous dog, which imposes conditions including the dog be muzzled in public places, signs on property indicating a dangerous dog exists and the dog to be on a lead at all times in public,” he says. “The dog resides in Serpentine-Jarrahdale and was visiting a property in Bicton at the time of the attack.”

food scene.The arrival last year of La
Sosta shook things up. Now, Deca Bodega has taken things to a whole new level again.
As it happens the Spanish tapas bar has opened next door to La Sosta, at the corner of Market and Bannister Streets, in the place recently vacated by Vidlers (and which, many years and renovations ago, was home to a funeral parlour).
Deca Bodega has been an overnight hit. Open just a few weeks word has spread like wildfi re and you’ll be lucky to get a Saturday night seat without booking ahead.
After our midweek lunchtime visit for this review we raved about the place to a colleague, who tried it out and enjoyed his Friday lunch so much he raved about it to the boss, who booked a party of nine for Saturday night, who then raved about it to their family and friends, who… well, you get the picture.
This place just does everything right. From the simple yet chic decor to the tight, mouth-watering menu that has not a hint of sag about it.
Highlights are crispy duck and pineapple tacos ($16), garlic prawns with chorizo ($18) steamed clams, jamon, herb and cherry tomatoes ($14), and sugar-cured salmon and nicoise
salad and fattoush ($14). For a light lunch you might simply choose the hommous and pita ($6). But there’s plenty more: Pork belly and more fi sh and meat dishes, for example.
All the dishes were so full of fl avour, texture and taste we thought witchcraft was at work.
When the fi rst dish came out and was a hit, and then the second, and then the third, we knew we had stumbled onto something special.
The salmon salad was a stand out, with big, translucent chunks of deep red sugar-cured fi sh nestled amidst the quenching fresh nicoise vegies peppered with capers.
The chicken salad saw us served with generous serves of manchego and cornmeal-encrusted cuts of tender meat, and the crispy duck and pineapple tacos mixed the rich meat with the juicy tangy fruit.
Ten dishes between four (working out to about $30 a head) provided a meal at a standard so far unmatched along the strip.
Colleague Stephen Pollock, a Scot, said without hesitation this was the best meal he’d had in Fremantle—delicious, fresh
produce and great service. “The standout dish was the
garlic prawns and chorizo. Deca went a long way to restoring my faith in tapas.”
As for the Saturday night experience: It went like a charm, with the boss just as e usive about the dishes and the service (Matteo—a star!).
Is a renaissance of Fremantle food underway? Here’s hoping so.
If La Sosta and Deca Bodega are anything to go by, then perhaps a night out in Fremantle can once again be something to look forward to.
