If you want to appoint an executor of a Will, you will

need to carry out the following matters:

1. Obtain the original Will and notify the beneficiaries of the Will;

2. Identify the assets and liabilities in the deceased estate and determine the value of the deceased estate. There may be assets that require managing such as a business or property;

3. Apply to the Supreme Court of WA for a grant of probate;

4. Transfer any assets under the name of the deceased into the Executor’s name;

5. Finalise the tax affairs of the deceased;

6. Pay the debts of the deceased estate;

7. Establish any trusts required for the

beneficiaries; and

8. Make distributions of the deceased estate to the

beneficiaries.

An Executor is responsible for losses which the deceased estate incurs from any unauthorised acts of the Executor. You may require professional assistance to carry out your duties as the affairs of the deceased may be complex.
