designed for agricultural purposes, used exclusively in the conduct of

agricultural operations and used principally off the highway, or a trailer-mounted bulk liquid fertilizer

container

does not include any motor truck, farm truck, road tractor, truck tractor, or farm truck tractor or such a vehicle combined with a semitrailer, trailer or farm trailer,

when the vehicle or combination is a commercial motor vehicle operated on a highway.

Means a motor vehicle designed and used primarily as a farm implement for drawing plows, mowing machines and other implements of husbandry.

Operators of certain commercial motor vehicles are not required to hold a commercial driver’s license, if the operator holds a valid operator’s license.

If the farmer operates a farm vehicle outside the scope of the farm or is operating FOR-HIRE, and that vehicle meets the definition of a commercial motor vehicle, a CDL will be required.

Notwithstanding sub. (1), the secretary may restrict vehicles to a width of less than 8 feet 6 inches on any portion of state or local highway if he or she deems such restriction necessary to protect the public safety. Any such restriction shall be indicated by official signs. If the secretary restricts the vehicles to a width of less than 8 feet 6inches on a local highway, the local authority in charge of maintenance shall be responsible for erecting the appropriate signs on the local highway.

No person, whether operating under a permit or otherwise, shall operate a vehicle in violation of special weight limitations imposed by state or local authorities on particular highways, highway structures or portions of highways when signs have been erected as required by s. 349.16(2) giving notice of such weight limitations, except when the vehicles being operated under a permit expressly authorizing such weight limitation to be exceeded. If the secretary of DATCP determines that an agricultural emergency exists, DOT may authorize the movement of vehicles or combination of vehicles that:

Any traffi c offi cer having reason to believe that the gross weight of a vehicle is unlawful or in excess of the gross weight for which the vehicle is registered may

require the operator of such vehicle to stop and submit the vehicle and any load it may be carrying to a weighing by means of either portable or certified stationary scales and

may require that such vehicle be driven to the nearest usable portable or certified stationary scale except as provided in 348.19(1)(b).

348.19(2)(a)

TRAFFIC OFFICERS MAY WEIGH VEHICLES AND REQUIRE REMOVAL OF EXCESS LOAD.

After weighing a vehicle, it is determined that the vehicles weight is in excess of the limitations in 348.15, 16, 17(3) & (4) or any limitation posted in 348.17, the operator may not proceed (unless directed by the officer for unloading or reloading) until the overload is brought back into compliance within the limitations exceeded.

All material unloaded or reloaded shall be done so and cared for by and at the risk of, the owner or operator of the vehicle.

348.19(2)(b)

T R A F F IC O F F IC E R S M A Y W E IG H V E H IC L E S A N D R E Q U IR E R E M O V A L O F E X C E S S L O A D.

I n the case of a vehicle transporting livestock found in excess of the weight limitations in 348.15, 16, 17(3) & (4) or any limitation posted in 348.17, and if the apprehension is within 15 miles or less of the destination of the vehicle. The traffi c offi cer shall allow the vehicle to proceed w/ o requiring the reloading or unloading of such vehicle.

This paragraph does not apply to the interstate system w/ the exception of the Wausau- Portage exemption.

(5) Placing injurious substance on highway.– No person shall

place or cause to be placed upon a highway any foreign substance which is or may be injurious to any vehicle or part thereof.

(7) Spilling loads of waste or foreign matter.– The operator of

every vehicle transporting waste or foreign matter on the highways of this state shall provide adequate facilities to prevent such waste from spilling on or along the highways.
