IACPUpdates2019DAIDConferenceplanningandupdates:KyleClarkreportedthatregistrationandlodgingarecurrentlyopenforthe2019DAIDconferenceinAnaheim,CAonAugust10-12,2019.TherewillbeaDREStateCoordinatorsmeetingthedaybeforetheconferenceonAugust9,2019andasessionfornewstatecoordinators.TheDRESectionmeetingwillalsobeheldonAugust9thaswilltheDRESectionReceptionthatevening.
Over50%oftheroomblockhasbeenreservedtodate.Theconferencewillbeexpandingthesessionspresentedthisyear.InadditiontothesessionareasforDREs,prosecutors,andforensics,therewillbemoretopicsongeneraltrafficsafetyandatrackforlawenforcementexecutives.OneofthenotedpresentationswillbeontheDREProgression,whichwillincludepresenterssuchasDickStuddard,SandyRichardson,ChuckHayesandHeidiKing.

FutureDAIDConferences:KylereportedthatfutureconferencelocationswillincludeSanAntonio,TexasonAugust6-8,2020attheGrandHyattandOrlando,Florida,August14-16,2021.
DRECredentialingUpdate:KyleprovidedinformationonthecurrentnumberofDREs,with8,700beingcredentialedintheUnitedStatesand1,025credentialedinCanadaandotherinternationaljurisdictions.CarolynEskinatIACPHeadquartersisworkingthroughthebacklogofcertificationandrecertificationpaperwork.Sheisgenerallyabletogetthepaperworkprocessedandreturnedtothestateswithin30days.IACPislookingatthepossibilityofmovingtheDRErecordstoaNIMBLEsystem,whichisthesystemcurrentlybeingusedbyIACPformembershiprecords.Ifthisoccurs,itmaybepossibletohavethesystemautomaticallysendnewcardsouttothestatecoordinators.Thiswouldpotentiallyspeeduptheprocessandhopefullyeliminatethehandlingofthesamepaperwork4-5timestocompletetheIACPprocess.TheremayalsobeanoptionwhereaDREstatecoordinatorcouldaccessthedatabasetodirectlyprintnewcardsiftheyareneededandtolookupotherdata,suchastheDREswithintheirstate.Carolynisworkingwiththestatecoordinatorsandcleaninguptheolddatabase.TherewereDREsthatarenolongerintheprogramthatneededtoberemovedaswellassomethatwerecertifiedthatwerenotinthesystem.
NHTSAUpdatesJohnMarshallextendedhisthankstotheIACPandthestafffortheworktheyhavebeendoing.TheNHTSAimpaireddrivinginitiativeiscontinuingtomoveforward,includingworkinthetoxicologyareas.HereportedtheyaregettingmoreinterestfromCapitolHillwithsomeoftheinquiriesfrommembersspecificallyaboutDREandARIDE.HestressedthattheworkofTAPismoreimportantthaneverandthattherecurrentlyisalotofsupportatNHTSAandDOT.TheDeputyAdministratorisverysupportiveoftheDECProgramandcontinuestopushtheissueofimpaireddrivingforward.
BillO’LearyreportedonarecentvisittoCaliforniatoattendseveralDREfieldcertificationtrainingsandgetanoverviewoftheCaliforniaHighwayPatrolprogramandprocesses.Hewasverypleasedwithwhatheobserved,andthetrainingprocessbeingemployedinCalifornia.Billalsoreportedonthefollowingareas:
DRENationalTrackingSystem(NTS):NHTSAisgettingclosertoswitchingtothenewdatacollectionsystem,butanexactstart-updatehasnotbeenidentifiedyet.ItisthehopeofthenewsystemthatitwillworkwellforeveryoneandaccomplishestheintendedgoalsforcollectingDREdata.ThevendorwillbeinAnaheim,CaliforniaattheDAIDConferenceandmay

CurriculumUpdates:ThenextcurriculumupdateprocessisscheduledforAugustinOklahomaCityandChristineFrankwillbetakingtheleadontheproject.TherewillbesomenewmembersonthecurriculumworkgroupthisyearwiththeadditionandchangesforprojectmanagersatIACP.
On-LineARIDETraining:ChristineFrankwillbebeginworkingonatransitiontoODID(On-lineDrugImpairedDriving).Christinehasadegreeinadultlearning,whichwillhelpindoingareviewofthetraining,determinehowbesttoimplementthetransition,andgetmoreoutoftraining.
ARIDEReview:ThiswillbeanotherareathatChristineFrankwillbeworkingwithforNHTSA.Shewillbelookingatwaystoimprovethedeliveryoftheclassroomtrainingsessions.
NASBLAFSTSeatedBatteryTests:Therehavebeennumerouson-goingmeetingswithNASBLAregardingtheseatedFSTs.NHTSAhasdecidedtoresearchtheFSTsandifusedintheSFSTcurricula,wouldbereferredtoas“OptionalTests”.TheywillbeutilizedwhentheSFST’scannotbeperformedduetosuchthingsassubjectinjuries,physicallimitationsorweatherconditions.TheywillnotbemeanttoreplacetheSFSTs.AquestionwasaskedifNASBLAwouldbeupdatingsomeoftheoutdatedreferencematerial.Billindicatedthatheisnotsurewhattheywilldo,butNHTSAwillsharetheirresearchfindingswiththem.TherewillbecontinuingmeetingswithNASBLA.
DrugsandHumanPerformanceFactSheetsUpdates:AttherequestofBill,ChuckHayesprovidedinformationaboutameetingheldinWashingtonDCtobegintheprocessofupdatingtheNHTSADrugsandHumanPerformanceFactSheets.ChucknotedthatDonMarose,alsoaTAPmember,waspartoftheworkgroup.Thegroupbeganbylookingatthecurrentlylisteddrugstoseeifanyneededtoberemovedandthenlookedatwhatdrugsmightneedtobeadded.Theworkgroupwasprovidedassignmentsfortheareaforeachmembertoworkoninpreparationfortheirnextmeeting.Chuckexplainedthattheyexpectthefactsheetswillbeavailableinelectronicformatsothatmorepeoplecanhaveaccesstotheinformation.TheremayalsobeembeddedlinkstoitemssuchastheDECProgramwebsiteandglossaryofterms,linkstoexamplesofHGN,the12-StepProcessandotherresources.Thecontractorexpectsthefullprojecttotakeabout2yearstocomplete.ChuckexpressedthatifanyTAPmemberhadanythoughtsorconcernstopleasecontacthimorDonMarose.

OtherResearch:NHTSAislookingatwhattheresearchneedsareinthefieldandthattherearealotofnewpeopleintheresearchareaatNHTSA.IthasbeenrepeatedlysuggestedthatanupdatetotheSFSTstudiesbeconductedlookingatdrugimpairment.
TAPTravel:TheremaybeadditionalfundingbecomingavailabletoNHTSAandthatoneofthewaystheywanttoassistwiththeDECProgramistoreinstitutetravelfundingforTAPmemberstoattendthemid-yearandannualmeetings.NHTSAwillbeworkingwiththeIACPtoidentifythebestplantoprovidethetravelassistance.BillclosedbyagainacknowledgingtheIACPandtheexcellentworktheyhavebeendoing.
OldBusinessDECProgramInternationalStandardsRevisions
CaptainHelenaWilliams,thechairoftheStandardsworkgrouppresentedrevisionrequestsonthefollowingInternationalStandards:
1.12CertificationKnowledgeExamination(CKE)Reviewing:AlanguagechangeinStandard1.12inreferencetothereviewingoftheCKEbyDREinstructors.ThechangeallowsfortheDREinstructorstouseadditionalmaterial,similartothepartsalreadywithintheCKE,whenneedingtodoadditionalreviewandevaluationofaDREcandidatebeforeapprovingordenyingtheircompletionoftheCKE.
Thefollowinglanguageupdateproposalwaspresented:
WhenthecandidatehascompletedallfivesectionsoftheCertificationKnowledgeExamination,either asasingleexaminationoradministeredintwopartsasdescribedabove,thecandidate’sfull CertificationKnowledgeExaminationshouldbereviewedasawhole.ThereviewingDREinstructors shouldreviewtheexaminationasatotalityofthecandidate’sknowledgeandunderstandingwhendevelopingtheiropinionastotheirapprovalorrejectionoftheCertificationKnowledgeExamination. Iftherearequestionsaboutanyofthecandidate’sresponses,theDREinstructorsmayaskthecandidateforclarificationortoexplainitemsinmoredetailordepth.DuringthereviewingprocesstheDREinstructorsmayaskthecandidatetoperformadditionalsimilartasksfromanysectionoftheexaminationtoensurethecandidate’sknowledgeandunderstanding.Thisisnecessarysothatthe reviewingDREinstructorsfullyevaluatethecandidate'squalifications,performance,andgeneral abilitiestoperformasaDRE.

3.4RecertificationTraininghours:AlanguagechangeinStandard3.4inreferencetothetraininghours,specificallythe4-hourminimumtrainingblockrequirement,andhowthehoursarepresentedtothestatecoordinator.TherewasactiveandproductivediscussionbytheTAPmembers.Questionswereraisedaboutifallthetraininghourscouldbebywebinars,howthestatecoordinatorwouldapprovethetrainingthatwasbeingaccepted,andhowtoavoiddelaysinaDRE’srecertificationifthetraininghourssubmittedarenotaccepted.
TAPAction:TheproposedmodificationtoStandard3.4wasreferredbacktotheStandardsworkgrouptoreviewandaddresstheconcernsraisedandreportbackattheOctoberannualmeeting.
4.1Decertification–Updatedlanguage:AlanguagechangeinStandard3.4inreferencetothedecertificationofaDRE.Itwasnotedthat“poorperformance”ascurrentlylistedisasubjectivetermandtodaythereareotherissueswhichmayimpactaDRE’sperformance,suchasBradylistsandtheDRE’sabilitytotestifyincourt.Theissueswerediscussed,andafinalversionoftheamendinglanguagewasdrafted.
Thefollowingproposedlanguageandmodificationswerepresented:
4.1a DecertificationofaDREmaytakeplaceifoneormoreofthefollowingconditionsexist:
• TherequirementsasenumeratedinSectionIIIoftheInternationalStandardsoftheDrug EvaluationandClassificationProgramarenotmetby the individualDRE,thusallowingcertificationtolapse;or
• ThereisevidenceofimproperperformanceofDREevaluations,noncompliancewith
theInternationalStandardsoftheDrug EvaluationandClassificationProgramorlocalstateenhancedstandards;or
• Performanceorethicalissues,evenifnotdirectlyrelatedtothedutiesasaDRE,
whichrestricttheDRE’sabilitytotestifyincourt,impacttheDRE’scredibility,orbringsdiscreditupontheDECProgram.
TAPAction:TheproposedmodificationtoStandard4.1wasapproved.
InternationalSFSTStandards:LanguagewaspresentedtoamendtheSFSTstandardstoincludesimilarlanguageinreferencetoan“Institution”tobeconsistentwiththeDECPlanguagewhichwasmodifiedinOctober2018.ThemodificationwouldaddthesamedefinitionaslistedintheDREStandards,butmodifiedforSFST.Thefollowingproposedlanguagewaspresented:

Thislanguageappliestothebelowsectionofthosestandards:

EnhancedStateDECProgramStandardsReview
Alistofthestateswhichhavepresentedenhancedstandardsfor2019wasmadeavailabletoalltheTAPmembers.Therewere27statesreportingenhancedstandards,withfivebeingnewstatesubmissionsandtwobeingupdatedenhancedstandards.CaptainWilliamsreportedthattheenhancedstandardshavebeenreviewedandnoneappeartoconflictwiththeInternationalDECProgramStandards.ManyoftherequestsincludedarequirementtoattendclassroomARIDEbeforebeingeligibletoattendDREtraining.Therewasnoactiontakenasthestatesreportingthisdidsoforareviewandrecordsprocessonly.
StatetoStateDREAssistanceStandardLanguage
ThiswasacontinuationofanissuethathadbeenpresentedtotheStandardsworkgroupattheOctober2018TAPmeetinginreferencetostatetostateDREinstructorassistanceandensuringthatDREinstructorsareproperlycertifiedandcredentialled.Theopinionwasthatthecurrentstandardlanguageaddressestheissueandnomodificationwasneededatthistime.

TAPRegionRevisions
KyleClarkreportedthatTAPregionswerediscussedattheOctober2018meetingwhichincludeddiscussionaboutrevisingtheregionsmovingfromfourtothreeregions.However,therewasnoformalactiontakenonthisattheOctober2018meeting.ItwasexplainedthatthisadjustmentwouldplacetheIACPandTAPRegionalpositionsin-linewiththeNHTSAregionsandtherealignmentwouldkeepastatefrombeinginoneNHTSARegionbutworkingwithadifferentIACPDECPprojectmanager.ItwasexplainedthattheDRESectionhadalreadymovedtothe3-regionformat.Theproposedformatwouldbe:Eastern–NHTSARegions1–4andincludeeasterninternationalsites,Central–NHTSARegions5-7,andWestern–NHTSARegions8-10andwesterninternationalsites.
TAPAction:Modificationtonewregionallayoutwasapproved.
DREBestPracticesGuide
ChuckHayesreportedthattheDREFieldCertificationTrainingBestPracticesGuideisstillintheworksandisbeingexpanded.TheintentofthedocumentistoprovideDREstatecoordinatorswithguidelinesandrecommendationsforconductingeffectivefieldcertificationtrainingandwithtraininglocationoptions.Itwillincludetheexpansionofcertificationsites,suchastheadditionofOklahomaCityforsmallergroupsandReno,Nevada.Theultimategoalistoensurethatstatesarealldoingthings,suchasfieldcertificationtrainingeffectivelyandinthesamemanner.
DrugImpairmentTrainingforEducationProfessionals(DITEP)Curriculum/Funding
KylereportedthattheIACPhasbeenlookingatfundingeffortsfortrainingforschoolstosupportDITEP.TheIACPhasbeenactivelylookingformajorcorporatesponsors.Aspartofthecurriculumupdates,the2017DITEPmaterialhasbeenupdated.EffortswillbemadetokeepDITEPup-to-datewithothercurriculumupdates.TheIACPisalsolookingatemployertrainingfordrugimpairmentintheworkplace.Thiswouldprobablybea4or6-hourtraining.AmajorportionofthecurriculumwouldbefromDITEPandwouldincludetopicsonworkplacelaws.Whendeveloped,itwillbemadeavailableforthestatecoordinatorstouseasatoolintheirstates.CeceliaMarquart,TexasDREStateCoordinator,sharedthatTexasisworkingona6-houronlinetrainingprogramwhichmaybeabletobesharedwithotherstatesinthefuture.Theyarealsoworkingonaclassforprobationandparoleofficers.DarrinGrondelreportedthatthereareothergroupsthatmaybeusefulresourcessuchastheNationalCooperativeResearchProgram.TheIACPwillexplorethispossibleresource.

SFST/ARIDE/DRECurriculaUpdates
KylereportedthatplansarecurrentlyinplacefortheCurriculumworkgrouptomeetinAugustattheTransportationSafetyInstitute(TSI)inOklahomaCitytobeginworkonthenextrevisioncycleforallthecurricula.NHTSAwillbetryingtokeeptheupdatesona2-yearrotation.AlotoftheupdatesarebasedontheinformationreceivedfromtheDRESchoolCouseManagerreportsstressingtheimportanceofthosereports.
AAADREExpertWitnessTraining
KyleandChuckreportedthatAAATrafficSafetyFoundationiscontinuingtheireffortstohosttheDREcourtroomtestimonytraining.ThetrainingisintendedforDREofficersandprosecutors.Theclassis8hoursinlengthandtaughtbyexperiencedandextremelyknowledgeableTSRPs.Thetrainingwasoriginallydesignedfor4hoursbeingintheafternoonofDay1and4hoursonthemorningofDay2.However,thishasbeenmodifiedbasedonattendeefeedbackandthetrainingisnowa1-dayclass.In2018,trainingclasseswereheldinNHTSARegions1,2,3,and4.CurrentlyclassesarescheduledinLaramie,Wyoming;Portland,Oregon;Indianapolis,Indiana;andoneisbeingplannedforDallas,Texas.AAAisplanningtocovereachofthetenNHTSAregionsandwillconsiderrequestsforadditionaltraininginareasalreadycovered,aftereachofthetenregionshavehostedatraining.
DREEquipment/Penlights/RedLights
IACPcontinuestoreceiverequestsaboutDREpenlightsandotherDREequipment.JimMaisanopresentedinformationanddataonvariouspenlightsthatwererecentlyreviewed.Thedatadisplayedtheilluminationfromthepenlightsandmeasurementsofthelightintensity.ThedatawillbesharedwiththeDREstatecoordinatorsandcanbeusedasareferenceforfutureuseandpurchasesofavailablepenlights.
Dr.KarlCitekpresentedinformationontheuseofanon-whitelight,specificallyaredlightforthenear-totaldarkness(NTD)partoftheDREevaluation.ItwasstressedthattheNTDprocedureshouldusetheleastamountoflightpossible,withjustenoughlightilluminatingtoseethepupil.Therewasadiscussionregardingpotentialparametersonpenlights.Itwasagreednon-whitelights,oraredlight,shouldbeallowed.Dr.Citekwillprovidelanguageforthecurriculumworkgrouptouseduringthenextupdatethatwilladdressthewhiteand/orredlights.
ItwasmentionedthatsomeDREstudentshaveburnedtheirfingerwhileusingcertainLEDpenlightswhichisanindicatorthattheyaretoobright.Discussionalsoincludedreportsof

meltedgloveswhileusingthehighintensitypenlightsaswellasthepropercolor/typesofglovesaffecting“theredglow”.Whiteprotectiveglovesaffordthebest“redglow”fordarkroomexaminations.
Dr.Alvespointedoutthatheusesapenlightthatdisplaysasquarelight,notacircle.HesuggestedthattheCurriculumworkgroupconsiderchangingthewordingintheDREcurriculato“coverthebulkofthearea”at6inches,whichwouldincludeasquarelightbeam.
TAPAction:Noformalactionwastakenonthis.Dr.CitekwillprovidetheCurriculumworkgroupwithsuggestedlanguagefortheDREcurricula.
MattMyers,DRESectionChair,remindedthemembersthataone-pageinformationsheetwaspresentedattheOctober2018TAPmeetingaboutpenlightsandthelightdistribution.ThatinformationwasapprovedbyTAPbutmaynothavebeendistributed.ChuckHayeshadacopyoftheinformationsheetandinformedthemembersthathewouldensurethatitissharedtoallthestatecoordinatorsandcanbeplacedonthestatecoordinatorresourcepage.
HGNandIndicatorsofImpairment
MattMyersreportedontheworkwithDr.CitekandtheyhaveputtogetherashortinformationpageabouthowtheeffectsofHGNareconsideredtobeactualimpairmenttoaperson.ThematerialwasnotavailablefortheTAPnotebooks,soitwasreadtothemembers.Afterdiscussionandafewminormodifications,thefollowingwasproposed:
Anydeficiencyineyemovementorpupilresponse,especiallyifitisacquiredorofrecentonset,canimpairaperson’sabilitytoseeproperly.Drugimpairment,includingfromalcohol,canaffecteyemovementsinseveralways,dependingonthenatureoftheintoxicantused.Druguse,includingalcohol,isunderstoodtocausephysiologicalchangesthatareofrecentonsetandacquired:1.Lackofsmoothpursuitcanimpairtheabilitytoseedetails(suchaswhenreadingasign)ormakeaccurateobservations(asofthedirectionandspeedofanothervehicle)whenthereisrelativemotionbetweentheobserverandthetarget(oneortheotherismoving,orbotharemovingbutatdifferentspeedsand/ordifferentdirections);2.Acquirednystagmus(eitheratorbeforemaximumdeviation)causesareductionofvisualacuity,primarilybecauseofthesuppressionofvisualprocessingduringthefastphaseofthenystagmus;and3.Lackofconvergencecancausedoublevision(diplopia)whenlookingatobjectsupcloseorwhenfrequentlyorrepeatedlychangingviewingdistancebetweenfarandnear(suchaswhenlookingbackandforthfromtheroadtothecar’sdashboard).Individualswithlong-standingabnormalityordeficiencyoftenlearntocompensateinsomemanner.Oneexampleincludesmakingaheadmovementratherthananeyemovementwhen

someonehasanaturallackofsmoothpursuit,notduetointoxication,illness,ortrauma.Likewise,someonewhohasaconstantandlong-standingnystagmusmaybeabletodetectandextractvisualinformationbetweensuccessiveeyemovements.Therefore,whiletheappearancetotheofficermaybeabnormal,thepersonisnotnecessarilyimpaired.
Twosourceswerecitedandwillbeincludedintheinformation.

ArizonaDREResearchUpdate
DavenByrdreportedthattheArizonaDREstudyisstillindevelopment.Thedatahasbeencollectedandtheyarewritingthereport.HehopestohaveadraftforthemembersattheOctober2019meeting.

D’ArcySmithreportedthattheCanadaDREcertificationoptionrequestisonhold.CanadahasutilizedanSFSTclassformatwithpartoftheSFSTclassbeingusedasvolunteerdrinkers.Thereweresomeissueswiththerepetitiononthenon-drinkingstudents,butoverallithasworkedwell.TheymanagedtheBAClevelsofthedrinkerswithnoonebeingabove.14,andmostdrinkersinthe.08range.TheywillkeeptrackofdatafromtheSFSTclassesusingthismodifiedformat.Basedonwhattheyhavelearnedthusfar,theymayconducta5-dayclassinsteadof6-dayclass.
AAADECPEnhancementStudy
Mr.JacobNelsonfromthenationalAAAInsuranceofficewasinattendanceandreportedthataAAAsponsoredstudywasconductedabout4yearsagolookingintoimpaireddriving,andthatDREwasfoundtobeapremierprogram.KylereportedtheprojectreporthasbeenreviewedbyIACPandissupportiveoftheDECProgram.Mr.NelsonalsoreportedthatfinalmodificationsarebeingmadebaseduponIACPandotherinputbeforethefinalpublication.AAAwantstoexpandontheinitialreporttoseewhatcanbedonetofurthersupporttheDECProgram,determinewhatvalidationofthestudiesarebeingconducted,andhowAAAcancontinuetohelppromoteDREandARIDE.AAAwouldliketoworkmorecloselywiththescientificworkgroupinthefuture.Mr.NelsonreportedthatAAAisverymotivatedinhelpinglawenforcementandtheDECProgram.DarrinGrondelspokeabouttheworkAAAhaddoneonoverthecounterdrugs,andontheperceptionsthatjudgesandajuryhaveregardingthesetypesofsubstances.Aspartofthiseffort,AAAwascontractedtolookatcountermeasurestoimpairingoverthecountermedications,andwhendrugsareprescribed.

AsaresultofthedraftreportfromAAA,IACPDECProgramstaffcompiledalistofthe12potentialDRE-relatedactionitemsfromthereport.Kylesortedthelistintothreegroups:1)AlreadyinProgress,2)Non-starteritems,and3)ItemssupportedbyTAPandtheIACPiffundingwasavailable.ThoserecommendationsdeemedtobeAlreadyinProgressincluded:theuseofDREtabletsduringevaluations;ocularrecordingdevicesfortrainingandenforcement;theuseofsubjectmatterexpertstodeliverDREtraining;thedevelopmentofstandardscoringelementsfortheFinger-to-NoseandModifiedRombergBalancetests;investigatingtheuseoforalfluidtestingintheDREprogram;andencouragingandsupportingnewvalidationstudies.AAAreportrecommendationsthatwereconsideredtobenon-starteritemsincluded:theuseofautomatedmedicalmeasurementequipmentforDREsandaddingaprobationaryperiodfornewDREs.Therecommendationsthatarepossible,withsupportfromTAPandsufficientfunding,included:revisingtheDREfacesheettoincludeaplaceforrecordingthepresenceofeyelidandlegtremors,addingasecondbloodpressuremeasurementintheDREevaluationprotocol,addingrespiratorybreathingratetotheprotocol,andexaminingtheuseofforceplatesformeasuringbalanceandbodysway.TAPAction:ItwasagreedthattherevisionstotheDREfacesheet,addingasecondbloodpressuremeasurement,alongwithdocumentingrespiration,wouldbepassedtotheScientificworkgroupfordiscussionattheOctober2019meeting.

IACPDECProgramstaffhasbeenworkingtoreviewwhatstatesaredoinginthisareaandtotrytodevelopsomebesttrainingpracticesforrecertification.ThegoaloftheIACPreviewistostressprogramprofessionalismandintegrity.Inaddition,toalsohelpensurethatqualityDRErecertificationtrainingsarebeingproperlyaccomplishedandthattheprocessisnotbeingtakenlightly.ThereisaconcernthatsomeDREsarenotbeingofferedorattendingproperrecertificationtrainingandthatsomenon-DRErelatedtrainingmaybebeingallowedinsomestates.CeceliaMarquartvolunteeredtohelpdoasurveyofthestatecoordinatorstoseewhatrecertificationprocessestheyareusing.IACPstaffwillaidherinformulatingwhatquestionstoask.
IACPDECProgramstaffisalsoworkingoninformationforstatecoordinatorsaboutwhichformstouseforprocessessuchasrecertificationandreinstatement.Therehasbeenamixofformsbeingsubmitted.Thoseformsarecurrentlybeingupdatedandwillbedistributedtothestatecoordinatorsalongwithinstructionsofhowandwhentousetheforms.
Anotherissueiswhatconstitutesarecertificationevaluation.Fortheapprovedevaluationperformedinfrontofaninstructor,whetheritbeasimulatedsituationorsuspectedimpairedsubject,itneedstobestressedthatanapprovednarrativereportisneededfortheevaluation.ThisensuresthatthenarrativeisreviewedandapprovedbytheDREinstructor.ThenarrativeisapartoftheDREevaluationsoitshouldbepartoftherecertificationprocess.Arecommendationwasmadetoprovidethisinformationtothestatecoordinatorsatthenextstatecoordinatorsmeetingatthe2019DAIDConference.

ChuckreportedontheMADDLawEnforcementExecutiveSummitheldinAlexandria,VirginialastNovember.Thesummithadexcellentresultsandwaswellattended.Theoverallagendastressedtheimportanceofgettingmoreexecutivelevellawenforcementpersonnelsupportforimpaireddrivingenforcement,whichincludedARIDEandDREtraining.Thesummitincludedmanylargeandmid-sizelawenforcementagencyleadersnationwide.
MADDisworkingwithNHTSAtopossiblyexpandthesummitsintoeachofthe10NHTSAregions.Ifthisoccurs,theIACPwillworkwithMADDingettingtheinformationoutandsharingwithallpartners.Additionally,MADDNationalhastakenthefollowingpositiononthe.05BACperselimit:IfastatehasalegislativebillintroducedtolowertheBAClevelto0.05,MADDwillsupportthestate’sefforts,buttheywillnotbehavinganationwideinitiativeforaperselimitof0.05.MADDhasalsopledgedsupportingthenationaleffortstoaddressdruggeddrivinginitiatives.
UniversityofCASanDiegoCannabisStudy
HelenaWilliamsreportedthattheSanDiegoCannabisStudyisnotcompleted.TheyhopetohavethedatacollectioncompletedbythesecondweekinMay.Theprojectwillthentransitionintotheanalysisphase.Thestudyisusingthreedosinglevelsanddrivingsimulators.Thestudyisbeingconductedsothatitisadouble-blindstudy.
DRENationalTrackingSystem(NTS)DataEntryRequirementDiscussion
JimMaisanoreportedthatbasedontheinputandrecommendationsfromseveralstatecoordinators,theissueofplacingarequirementforDREdataentrywithintheInternationalStandardswasresearched.ItwasidentifiedthatregulationsprohibitedNHTSAfromrequiringDREevaluationdatabeenteredintotheNTS.However,thereisnothingthatwouldprohibitastatefromusingtheirenhancedstandardsprocesstorequirethedataentryintotheNTS.Itwasalsomentionedthatthestate’shighwaysafetyofficecouldencouragedatatobeenteredintotheNTSaspartofthestateDREprogramcontracts.JohnMarshallpointedoutthatdatafromthesystemwasrecentlypresentedtotheNHTSARegionalAdministratorsanditwaspointedoutthatforthenumberofDREsnationally,whencomparedwiththenumberofevaluationsbeingconducted,itappearsthattheDREsareonlydoing3-4evaluationsannually.ThecounterwasthatnotallDREenforcementevaluationsarebeingenteredintotheNTS.

ChuckaddressedaneedtoknowhoweffectiveDREevaluationsarewhenitcomestocaseadjudication,especiallywhencomparedtonon-DREinvolvedcases.TheDECProgramasawhole,islackingdatatoshowtheconvictionrateofDRErelatedcasesvsnon-DRErelatedcases.
JenniferHarmonspokeaboutOrangeCounty,CaliforniaandthewaytheytrackDUIDdataandcasesandhowtheymightbeabletohelpsupportthisareaoftheDECProgram.SomeareasthatwouldbevaluabletoknowwouldbeifadistrictattorneyisaslikelytofileaDUIdrugcaseifthecaseisanon-DREcase.InthebeginningoftheDECProgram,DREswererequiredtoenterthedispositionoftheirevaluationcasesintotheirrollinglog.However,thatentryhasbeenremovedthroughtheyearsmainlyduetodifficultyinobtainingcaseadjudicationinformation.
ThiscouldbeanimportantareawhichcouldbebeneficialtotheDECProgramandhopefullyshowitseffectiveness.AnotherhelpfulaspectwiththistypeofinformationwouldbeinshowinglawenforcementadministratorsandothersthemorefavorableoutcomesoftheprosecutionoftheDREinvolvedcases.
ItwassuggestedtoconsultwiththeGHSAtoseeifwecangetapracticalprogramreviewthatwouldincludecaseadjudicationevenifonlyonasmallerperspectiveandnotnecessarilystatewide.Itwasaskediftherewasasourceforthenamesofcontactsforthestateimpaireddrivingtaskforcestoconsultforthisinformation.ItwasalsosuggestedtolookatTennessee,inthattheyhaveagoodtrackingsystemofdispositionsofallDUIcases.
TAPAction:IACPstaffwillworkwithvariousstatesandjurisdictionstotryandcollectDREcaseadjudicationinformationandmakecomparisonswithnon-DREinvolvedcases.TheprogressonthiswillbesharedattheOctober2019TAPmeeting.
ChangingtheCultureofDREUse
ChuckbeganadiscussiononwhetherthereneedstobeachangeinthecultureandthinkingofDRE.HedescribedanincidentwhereaDREwasnotdoingfullevaluationsbutgivingaDREopinionbaseduponpartialDREevaluationsteps.And,itappearsthatinsomeareasofthecountry,officersarenotcallingaDREandprocessingtheDUIdrugcasesthemselves,orDREsarenotrespondingwhencalled.ItwasidentifiedthatinsomecircumstancestheDREwasthearrestingofficerandnotdoingadrugevaluation.AquestionwasposedabouthowdowemotivatetheDREtodotheevaluation,especiallywhentheDREisthearrestingofficer.Plus,howdowekeepfromhavingtheDECProgramandtheDREsbeingunderutilizedandofficersjustdoingabloodtestinhopesofmakingtheir

International:D’ArcySmithfromtheRCMPreportedthatCanadathusfarhasnotseenanymajorincreasesinCannabisDUIarrests,butdataisstillcomingin.HealsoreportedthatCanadianborderofficersarenowbeingtrainedinSFSTsandwillbeonwatchforimpaireddriversenteringthecountry.InspectorTinaMaierfromtheOntarioProvincialPolice(OPP)reportedonanoralfluidprojectthatstartedinFebruaryandshewillprovideadditionalinformationonthatprojectatthenextTAPmeeting.
