ACTION ON HOUSE BILL 480: The C o m m i t t e e c o n s i d e r e d t h i s b i l l f o r some t i m e - S e n a t o r Norman s a i d h i s c o n c e r n was i n t h e area o f p r o p e r t y o w n e r s ' t a x e d t o c o v e r f u n d s needed t o s u p p o r t t h e d e - i n s t i t u t i o n a l i z a t i o n program c u r r e n t l y underway i n Montana f o r some p a t i e n t s i n o u r m e n t a l h o s p i t a l s . The S e n a t o r s a i d t h e F e d s s t a r t t a k i n g care o f t h e m e n t a l h e a l t h p a t i e n t s , t h e n p u t them o u t i n t o t h e communi t i e s , a n d now t h e f u n d i n g i s p u t on t h e p r o p e r t y owner s ( w i t h o u t a v o t e ) . I t was a l s o t h e

A f t e r reviewing t h e A r c h i t e c t u r a l Glaz ing M q t e r i a l s Standard adopted by t h e Na t iona l Consumer Product Safety Commission, I have come t o t h e conc lus ion t h g t it i s s i m i l a r t o H. B. 694, a l though d i f f e r e n t I n one s i g n i f , i c a n t r e s p e c t . The n a t i o n a l s t a n d a r d does adopt a s a f e t y g lass requirement f o r hazardous l o c a t i o n s . However, i n s t e a d of p r o h i b i t i n g t h e u se of r e g u l a r p l a t e g l a s s a t hazardous l o c a t i o ~ s , *the " f e d e r a l approach p r o h i b i t s manufac ture rs and iabricators from milking g l a s s door s , e t c . , from anyth ing o t h e r t han s a f e t y g$ass . There i s no p r o h i b i t i o n a g a i n s t i n s t a l l i n g such a door , on ly f a b r i c a t i n g it. I n o t h e r words, t h e f e d e r a l r e g u l a t i g n i$ nbt a b u i l d i n g s t a n d a r d , b u t a manufactur ing s t anda rd . Builder$ yould s t i l l be a b l e t o i n s t a l l r e g u l a r p l a t e g l a s s doors if they could o b t a i n them, perhaps a s used i t e m s . he b u i l d i n g code approach of H.B. 6 9 4 seems more comprehensive than t h e f e d e r a l approach.

I t a l k e d by t e l ephone wi th an a t c o r ~ e y f o r t h e Consumer Product S a f e t y Commission. He s t a t e d t h a t t h e n a t i o n a l s t a n d a r d would t a k e precedence over s t a t e law, b u t f e l t s t a t e laws were s t i l l needed because f e d e r a l tinforcement of t h e f e d e r a l s t anda rd would be v e r y minimal. The t om mission has on ly a l i m i t e d s t a f f of f i e l d i n v e s t i g a t o r s which cannot p o s s i b l y g i v e meani u l enforcement T f o r t h e e n t i r e n a t i o n . For t h a t r ea son , I r e s p e c t f u l y recommend t h a t H.B. 694 be passed i n o r d e r t o g i v e adequate p r o t e c t i o n t o t h e c i t i z e n s of o u r s t a t e .
