DIGITAL COMMONS :a new way of public-private partnerships

AN OPEN INNOVATION IN A DIGITAL WORLD

Closely related to digital, the adoption of Open Models (Open Source, Open Data, etc.) is going fast.

More than a technical shift, they conduct to rethink the way we build and use digital resources. Each use of a digital innovation is also a contribution to such resource.

PREAMBLE

DEFINITION (DIGITAL COMMONS)

Commons refer to either natural resources or resources collectively produced which are maintained by a community of actors, governed by its own rules ensuring its collective and shared dimension.

● Convergence– Commons are devoted to a collective interest– Sometimes, collective interest and public

interest are not aligned. Il this case, public entity can join such commons and participate at its governance.

A NEW WAY OF COLLABORATION FOR PUBLIC ENTITIES

● From a competition perspective, asking specific resources is fair as long as everybody is able to use and to participate at the governance of the commons

● For instance, see Decision of the Conseil d’État (n°350431 30th of September 2011, Région Picardie c. Kosmos and Itop companies)

FRENCH “OPEN DATA BY DEFAULT APPROACH”

● Introduced in the last “Loi pour une Republique Numérique” (2016) law, in application from oct. 2018

● The principle obliged each administration (any entity executing public service tasks) to diffuse “openly” and by default all document (including software) produced during its activity

● More openness– Between administrations– Between administration & companies (including

research centers)

● New opportunities to mutualize● A new design of the way administration is

contributing to digital innovation, in terms of valorization and influence

Public and private innovation may be done together, at least partially. Direct competition is not the more efficient way of building innovation.

Public-private innovation may be stronger and more ethical, benefiting to each stakeholders.

Building commons is an efficient way to involve every actors on a local territory (public entities, private organizations and civil society).
