CERTIFICATION FEES) REGULATIONS

Short title. 1. These Regulations may be cited as the
BELIZE AGRICULTURAL HEALTH AUTHORITY (QUARANTINE INSPECTION AND CERTIFICATION FEES) REGULATIONS.
Interpretation. 2. In these regulations, unless the context otherwise requires-
"Authority" means the Belize Agricultural Health Authority established under section 3 of the Act;
"Quarantine Officer" means an officer authorized by the Authority to cany out quarantine inspections.
Export 3. (1) Every exporter of a commercial cargo, or his authorized agent, certification. shall pay to the Authority a fee of BZ$20 per hour of quarantine inspection of
such cargo plus the transportation costs of the Quarantine Inspector.
(2) Every exporter of a commercial cargo, or his authorized agent, shall pay to the Authority, the following fees for the issuance of a Phytosanitary Certificate for such cargo-

(a) non-commercial commodities or products (either for samples, personal use or in small quantities for research) ............ 10.00;
(b) commercial commodities or products amounting to less than atruck or 20 feet container load ....................................
(c) commercial commodities or products amounting to more than a truck or 20 feet container load .................................... 100.00.
(3) The fees prescribed by subregulations (1) and (2) (c) shall be paid aRer the quarantine inspection but before the issuance of the Phytosanitary Certificate.
(4) The fees prescribed by subregulation (2) (a) and (b) shall be paid before the quarantine inspection.
4. (1) Every owner of avessel, or his authorized agent, shall pay to Boarding, etc., the Authority, the following fees for boarding and quarantine inspection of his of vessels.

(2) The owner of a vessel with a Belize based agent shall make payments to the nearest office of the Authority on a bi-weekly basis.
(3) The owner or a captain of a vessel without a Belize based agent shall make payments directly to the Quarantine Inspector conducting the quarantine inspection.
(4) The owner of a vessel, his authorized agent or the captain of the vessel shall also pay the transportation costs of the Quarantine Inspector, in the case ofpayments made under subregulation (1) (4). (6) or (c).
Boarding, etc., of 5. (1) Every owner of an aircraft, or his authorized agent, shall pay aircraft. to the Authority. the following fees for boarding and quarantine inspection of

(2) The owner of an aircraft with a Belize based agent shall make payments to the nearest ofice of the Authority on a bi-weekly basis.
(3) The owner or pilot of an aircraft without a Belize based agent shall make payments directly to the Quarantine Inspector conducting the quarantine inspection.
Inspection of
6. (1) Every imported commodity or product listed in the Schedule commoditica,
shall be inspected by a Quarantine Inspector to determine if a Landing Permit shall be issued for the commodity or product. Schedule.

(2) The importer of a commodity or product referred to in subregulation (l), or his authorized agent, shall pay to the Authority the following fees for the quarantine inspection-

(6) non-regulated (low risk) commodities or products with a weight exceeding one thousand (1,000) pounds .........................
(c) regulated (high risk) commodities or products with a weight exceeding one thousand (1,000) pounds .....................
(3) Where a Landing Permit is not issued for a commodity or product under subregulation (l), such commodity or product shall be confiscated, destroyed, or returned to the country of origin at the owner's expense, by the Authority.
(4) A non-governmental organization or statutory body importing a commodity or product referred to in subregulation (1) for non-commercial

purposes may appeal to the Managing Director for a waiver of the fees prescribed in subregulation (2).
(3) hor the purposes of this regulation, the expression "non- commercial purposes" means the importation of commodities or products for purposes other than for sale to the general public.
7. (1) Every owner of a commodity or product listed in the Schedule Intransit and which is in transit through Belize, or his authorized agent, shall pay to the commodities,

(2) The fees prescribed by subregulation (1) shall be paid to the Authority.
(3) Every owner referred to in subregulation (l), or his authorized agent, shall also pay the other expenses of the Quarantine Ufficer.
(4) The expression "other expenses" referred to in subregulation (3) includes transportation, overtime, subsistence and accommodation expenses

incurred by the Quarantine Inspector during the process of travelling from the point of entry to the point of departure in Belize ofthe commodity or product (including the fiee zones).
Out of port 8. (1) Every container or vessel, carrying any commodity or product inspections. listed in the Schedule, whichneeds quarantine inspection at a private warehouse Schedule. or storage facility and for which Customs entry forms have been stamped
"VISUAL INSPECTION REQUIRED", shall not be allowed to leave any air or seaport unless accompanied by a container application fiom the Authority and a Quarantine Inspector.
Schedule. (2) The importer of a commodity or product listed in the Schedule, or his authorized agent, shall pay to the Authority a fee of BZ$20 per how for the inspection of such commodity or product, plus the transportation costs of the Quarantine Inspector.
(3) The fee prescribed by sub-regulation (2) shall be paid to the Authority.
Offences and 9. (1) Any passenger who makes a false declaration on a Customs penalties. Declaration Form, pertaining to the importation of plants, animals and their
products and by-products, commits an offence and shall be liable to a spot fine of fifty dollars (BZ$50).
(2) Any person who-
(a) is found in illegal possession of any plant, plant product, plant by-product, animal, animalproduct, animal by-product, carcass, feed, litter, dung, biologicals or similar things;
(6) breaks a quarantine seal;
(c) boards any commodity or product listed in

the Schedule in a carrier without the presence Schedule.

(4 imports into Belize any commodity or product listed in the Schedule and to which Parts V1 Schedule.
and X of the Act does not apply, otherwise than under an import permit granted by the Authority;
(e) contravenes or fails to comply with any of the provisions of any import permit referred to in paragraph (d),
commits an offence.
(3) Every person who commits an offence under sub-regulation (2), shall be liable on summary conviction to a fine not exceeding five thousand dollars or to a period of imprisonment not excee&ng two years, or to both such fine and period of imprisonment.
