TERMS AND CONDITIONS FOR BANQUET EVENTS
1. The minimum guarantee will be charged if the numbers of persons are less
than the guarantee. If more, the actual will be charged there are no
discounted rates for children. An intimation of guaranteed number of guests
would be required 48 hours prior to the function; no reduction thereafter
would be entertained.
2. For all private functions 50% of the advance amount must be paid at the
time of/he reservation and 25% of the estimated amount should be paid as a
further advance one week prior to the function. Settlement of the bill is
made on the same day of the function. If the payment is delayed beyond
agreed date and time an interest of 20% will be added to the bill.
3. The Hotel has the right to stop service if the actual number far exceeds the
expected number indicated in the Function Prospectus. Maximum variation
of 5 to 10%. Prices are subjected to change at any time without prior
notice.
4. Tentative bookings made within one month of the date of the function will
be held for a maximum of 72 hours from the date of the booking.
5. As per the policy, all food and beverage items served are to be consumed in
the banquet room itself. No leftover food will be permitted to be taken off
the buffet for consumption outside. In case of outdoor catering function, no
leftover food items (cooked or uncooked) shall be left behind
6. The hanging of banners /posters on the walls, partitions and using nails,
thumb tags and tape is not permitted. Free standing framed banner shall be
allowed to be displayed at the banquet hall at the discretion of the hotel
management.
7. In case of cancellation, a refund of a deposit will be made only if a
minimum notice of 30 days is given before the dates of the function, or due
to unforeseen circumstances at the discretion of the management. In the
event due to any unforeseen reason, the hotel is obliged to cancel the
booking made by the guest.
8. The organizer agrees to begin and end the function at the scheduled time as
agreed upon should the event go beyond the agreed time frame the hotel
would reserve the right to whatever costs are reasonably incurred to ensure
smooth operation of the function. It should be understood that the organizer
would conduct the event in an orderly fashion and the hotel would reserve
the right to exclude or eject any and all objectionable persons from the
persons without any liability whatsoever
9. If the hotel believes that the junction would affect the smooth running of the
hotel business, its security or reputation, it reserves the right to cancel the
function without any liability.
10. Clients are
responsible for all costs incurred in set-up prior to the function. All
deliveries to the hotel must be advised to the management prior to the
function whilst every effort would be made to assist in movement of the
goods from the loading bay to the function room it would be made based on
availability of the staff at that time.
11. The hotel
does not any take any responsibility of damages incurred to guest property
by services of a contractor hired for or by the guest.
12. All
entertainment to be approved by the Management. Place and the timing of
the entertainment will also be approved by the management. If any license
required for the same will it be borne by the guest. Set-ups involving
fairy lights, helium balloons etc are not permitted as a policy.
.
13. As per
legislation loud music/DJ is not allowed at outdoor venues after 10:00 p.m.
However, this can be allowed against government approval/permission
obtained prior to the function.
14. 20%
outdoor catering charges will be levied on all function catered to outside
the hotel premises
15. As per the requirement under the Income Tax, 1961,for settlement of
bills in cash, cheque or through credit card It is mandatory for the payer to
provide his/her Permanent Account Number
16. All disputes arising from this agreement shall be settled by arbitration
proceedings conducted in accordance with the Arbitration and conciliation
Act, 1996 at Odisha by a sole arbitrator duly nominated by the General
Manager- Hotel Guest hereby declares that he shall have no objection for
the arbitrator being nominated by General Manager Odisha and waives all
objections to the same for any such nomination. Agreement shall be subject

17. PPL license will be required for music shows, live band or
performance, as per prevailing laws of the state/country.
18. If either party shall be unable to carry out this obligations under this
contract due to an Act of God, War, Riot, Blockade, strike, lockout, flood,
earthquake or explosion or any other reason not within the control of the
parties hereto which results in an inability, in spite of due diligence of
either party in performing its obligation in time, this .contract shall remain
effective, but the obligation which the affected party is unable to carry out
shall be suspended for a period equal to the duration of the relevant
circumstances provided that: The non-performing party gives the other
party prior written notice describing particulars of the inability including
but not limited to the nature of occurrence with its accepted duration and
the steps which the non-performing parties is taking to fulfill its obligation.
Upon receipt of such notice the other party shall discuss the matter with the
non-performing party with a view to helping the non-performing party to
fulfill its obligations. This clause does not envisage financial assistance. If
any event the Force Majeure situation continues for a period of three
weeks, both parties shall meet again and discuss whether the Contract can
be amended to overcome the Force Majeure situation so that function can
be proceeded further. Notwithstanding anything contained to the contrary,
it is clarified that economic hardship, non-availability of material, labour
and transport shall not constitute Force Majeure. The overall
responsibilities and obligations of the parties shall not be excused by
reasons of Force Majeure situation. Notwithstanding the above, if the Force
Majuro continues for a period of three weeks in that event without prejudice
to the rights and the contentions of the parties the Owner shall have the
right forthwith to terminate this agreement.
19. Acceptance / execution of this order shall be deemed to be (a) a
confirmation by you that no benefit either in cash or in kind, has been
provided by you to any officer or employee, or any relative / associate of
any office or employee, of the Company or of any of its associate
companies, in order to secure this contract, and (b) an undertaking by you
not to provide any benefit, either in Cash or kind, to any such officer /
employee/ relative/ associate as reward or consideration either for securing
this contract or any other matter relating to this contract.
20. No e-mail communications will be accepted as a legal notice/ legal
claim served on the company. Such communication must be served at the
appropriate address only by registered post. "The Pal Heights”, Odisha.
21. Whilst on company premises, comply with health and safety
legislation and company environment, health and safety regulations in force
time to time and ensure that all equipment and tools brought on to the
premises will be in a safe condition, have recently been checked and that all
personnel using the equipment and tools have been trained in their safe
operation, and ensure that training has been given in the safe operation of
the work to be carried out on the premises. Guest will be solely responsible
for all accidents which may happen during the execution of the work from
whatsoever cause they may arise.
22. Guest will indemnify and keep the Company indemnified against all
losses, claims and/or proceedings against the Company, directly or
indirectly consequential to guest's failure to comply with the terms and
conditions of the Agreement Whilst in the premises due to any reasons
whatsoever, if Hotel property is, in any way, damaged, destroyed or
mutilated by guest, guest shall be held to be responsible for the same and
compensate the Company for the loss.
23. Bedis or any flammable items for functions are not allowed inside the
hall as management policy.
24. No 0utsider will be permitted to do floral decoration or tent age or
lighting without prior permission by which will be provided by The Pal
Heights Mantra, if necessary.
25. No communication through any media to public which mentions the
Hotel's name or logo should be done until the matter of such media
communication is approved in writing by the undersigned.
26. No food item will be permitted from outside in the hotel. Non -
Compliance of the clause shall be at the guest's own risk and in which event
the guest waives of all claims against the hotel management and
indemnifies the Hotel from all costs and consequence, third party claims,
including settlement costs, arising due to such non compliance
27. Guest will not move to other area of the hotel and remain in function
area to avoid disturbance to other hotel guest.
28. Service of any eatable like paan or paan-masala and gutka in guest
rooms or hotel public area is not permitted.
29. No food preparation in the hotel is permitted & all the services have
to be availed from the hotel.
30. Guest will abide themselves with hotel rules, regulations and maintain
hotel decorum.
31. During booking price and availability may vary as per local market
supply.
