Applicant – any individual or organisation that makes anapplication for a design approval
Approver – CASA or an authorised person who approves the design
Approval holder – the individual or organisation to whom a design approval has been issued under the provisions of Subpart 21.M
Proposed Subpart 21.M Stakeholders

Proposed Subpart 21.MApplicants will be responsible for:
- applying for a design approval- developing a design compliant with theairworthiness standards
- carrying out necessary inspections and tests
- showing compliance and submitting technical data

Design approvers will be responsible for:- specifying the certification basis- specifying acceptable means of compliance- observing or carrying out tests and inspections- making findings of compliance- ensuring the designs are safe- issuing approvals

Design approval holders will be responsible for:- providing instructions for continuing airworthiness, flight manual supplement, as required
- retaining design data and records
- reporting defects as required under CASR 21.003
Design approval holders will be responsible for continuing airworthiness of the design not the approvers

Modifications and repairs will be taken to be approved by CASA if they are:
- contained in any AD or direction issued by CASA - approved by EASA or the NAA of a recognised country
- published by the foreign TC holder or the manufacturer of the appliance under a system approved by the recognised NAA of the State of Design

Transfer of modification/repair design approvals:
- The design approval holder may transfer the approval to another person without CASA’s involvement
- An approval may be transferred only with the written agreement of the transferee
- The transferor must, within 1 month after the transfer, notify CASA, in writing, of the transfer

Transitional provisionsCARs 35,36,36A and CAO 100.6 will be repealed when Subpart 21.M commences
A CAR 35,36, and 36A approval will continue to be in force and will have the same effect as the original approval
Any variation of a CAR 35/36/36A approval will be subject to Subpart 21.M requirements

Transitional provisionsThe holder of an IoA for CAR 35/36/36A will continue to exercise his/her powers until the earlier of:- the expiry date of the IoA, or- 3 years after the commencement of Subpart21.M
IoA holders would be able to approve technical data or issue modification/repair design approvals under Subpart 21.M iaw the conditions and limitations in their IoA.

Approval of technical data is necessary before the issue of a design approval
- Approval is issued on CASA Form 979 – similar to FAA Form 8110-3

The settled draft of proposed Subpart 21.M is being forwarded to the Department of Infrastructure, Transport and Regional Development for clearance

Current legislation for engineering approvalsCASA can appoint individuals as authorisedpersons/ delegates to carry out design/engineering approvals:
CAR 35, 36, 36A, 37 CASR 21.031, 21.033(3), 21.095/098, 21.303(4) etc
Any person can apply for a CAR 30 Design Organisation
no requirement to be an ADO - ADO has no privilegesno legislative link between APs/delegates and ADOsmust have a system of quality control rather than a design assurance system

Approved Design Organisations (ADO) Proposed Subpart 21.J
Provides rules for certification and operation of ADOs
Replaces current administrative rules for:- certification of CAR 30 organisations - CAR 35/36/36A & 37 authorised persons
ADO concept is based on licensing /certification scheme
ADO will be a right - not a privilegeCan be one design consultant or a large design organisation

Provides clearer role and accountabilities for applicant/ certificate holder and CASACASA will set standards and perform project and system oversight
Recognises an organisation’s technical capabilityand design assurance system
An ADO’s privileges will depend on its capability and systemMay have delegation for issuing design certificates –e.g STCs, APMA design approvals etc.

Individuals and organisations who will meet the criteria in Subpart 21.J shall be granted an ADO certificate
Holders of an ADO certificate will have the privileges to perform design approval functions in accordance with the ADO certificate

An individual or an organisation having legal entity can apply for an ADO certificate
The applicant must have:Suitable organisation, personnel and facilitiesHead of Design ApprovalReady access to the equipment, tools, and design reference data Design assurance systemDesign organisation’s exposition acceptable to CASA

Privileges
The ADO certificate holder will be entitled, within its terms of approval to:approve minor changes to a type design under Subpart 21.Dapprove technical data under Part 21approve changes to the aircraft flight manualapprove the design of modifications or repairs to an aircraft or aeronautical product under Subpart 21.Mapprove materials, parts, processes and appliancesmake conformity determinations of prototype or test articles evaluate unrepaired damagesissue experimental certificates

Continued Privileges
CASA may accept without further verification, compliance documents, submitted by the ADO for the purpose of obtaining following approvals:- a type certificate or approval of a major change to a type design- a supplemental type certificate- an ATSO authorisation under regulation 21.605(4)- an APMA approval
CASA may delegate any other Part 21 function, such as:- to approve major changes to type designs - to issue STCs

Obligations
The holder of a certificate of approval for an ADO shall be responsible for:√ determining that the design comply with applicable
airworthiness requirements and have no unsafe feature √ maintaining the design organisation’s exposition in
conformity with the design assurance system√ providing to CASA information or instructions related to
required actions by regulations 21.003 of CASRs√ safekeeping of certain documents and records

The holder of an IoA for CASR Part 21 will continue to exercise his/her powers until 3 years after the commencement of Subpart 21.J
All CAR 30 certificate of approvals for design organisations will expire 3 years after the commencement of Subpart 21.J
