Dear Mr. Denk; McMahon & Mann Consulting Engineers, PC (MMCE) as requested by Waste Management of New York, LLC (WMNY) has prepared a 6 NYCRR Part 360 Solid Waste Management Facility (SWMF) permit modification for the Chaffee Facility. The SWMF permit modification addresses the receipt, solidification and disposal of bulk liquid wastes. This letter describes the requirements for modifying the current permit in accordance with 6 NYCRR Part 360-1.9(g). In addition, attachments to the letter include the New York State Department of Environmental Conservation (NYSDEC) SWMF Permit Modification Application, Short Environmental Assessment Form (EAF) and revised pages and figures to be inserted into the Operations and Maintenance Manual. 6 NYCRR Part 360-1.9(g) requires that the permit modification application provide information regarding the nature and compliance capabilities of the proposed modification. This information is provided below. Part 360-1.9(c)(1) Description of Proposed Modification WMNY owns and operates the Chaffee Facility, which consists of an approximately 50-acre closed landfill (Closed Landfill) and a permitted 56-acre landfill expansion (Western Landfill Expansion). Supporting infrastructure includes: roads, buildings, tanks and soil borrow areas. The modification requests that the Chaffee Facility be permitted to receive non-hazardous bulk liquid wastes. As stated in 6 NYCRR Part 360 2.17 (k), (n) and Special

Condition 9 of WMNY’s current NYSDEC SWMF Permit, disposal of bulk liquids or waste streams with less than 20 percent solids and free liquid are prohibited. WMNY proposes to accept the liquid wastes and then perform a solidification process by mixing the liquids with an appropriate absorbent material so that the mixed waste will not contain free liquids and will conform to the requirement of 6 NYCRR Part 360 2.17 (n). The mixing will occur within the active landfill footprint so that it is contained. After solidification is complete, the waste will be disposed within the active disposal area. WMNY will continue to accept 600,000 tons of solid waste per year for the landfill, consistent with the current permit. In general, operation, oversight and support for the facility will continue in accordance with the programs and procedures currently approved. Part 360-1.9(c)(2) Reasons for Proposed Modification WMNY has identified a need to provide a disposal option for generators of non-hazardous wastes that contain free liquids. The planned liquid waste solidification process at the facility is intended to meet this need. Part 360-1.9(c)(3) Impacts of Modification Upon the Presently Permitted Facility In general, the landfill will continue to operate in accordance with the approved plans. Addition of the solidification process will not adversely affect the permitted facility. The most significant impact will be the addition of a mixing area within the active landfill and the operational procedures for mixing and disposing of the waste. Attachment C includes revised pages and figures for the Operations and Maintenance Manual, specifically, a new Section 20 discusses the liquid solidification process. Part 360-1.9(c)(4) Regulatory Compliance Capability This permit modification application has been prepared in accordance with the appropriate permit modification application requirements contained in 6 NYCRR Part 360-1 and the applicable requirements of the Environmental Conservation Law (ECL). The SWMF Permit Modification Application is included in Attachment A and the Short EAF is included in Attachment B of this letter.
