IEBC Background

WI IEBC History

• Replaces S&B Existing Building Guidelines, Wisconsin Historic Code (Comm ch. 70) and IBC ch. 34, which share similarities with IEBC.

• Provides a more predictable alternative than one or more petitions for variance

• Note that there is no distinction between buildings originally approved under ICC suite or pre-ICC Wisconsin codes

• Note that per s. 101.121, WI Stats, local ordinances may not be anymore restrictive for historic building projects approved per this code

IEBC Approach

New work intended by the owner is generally regulated by the IBC, IMC, etc., but additional upgrades maybe triggered by the IEBC depending on the type and extent of the intended work.

• Also requires that initial tenant spaces plans following shell approval shall meet new construction requirements of IBC

s. Comm 61.30 Plan Submittal

• Required for new buildings, additions and alterations• Change of Use - There is NO requirement that a plan

has to be submitted to gain an approval for a change in use. Submittal requirements exist only for the plans of the alteration work that is often desired or required with a change a use.

• 61.30(4) Minor Alterations - If the code official can understand the proposed project and agree that compliance can be achieved without having plans to work from, no submittal of plans is necessary - Document the decision!

Fair Housing LawRemodeling Scenarios

1. > 50% of the interior square footage of the housing is remodeled, the entire housing shall conform to the standards

2. If 25% to 50% is remodeled, that part of the housing that is remodeled shall conform to the standards

3. If < 25% is remodeled, the remodeling is not subject to the standards unless the alteration involves work on doors, entrances, exits or toilet rooms, in which case those elements shall conform to the standards

• Disproportionality may limit expense to 20% of the project

IEBC 912.4 Means of Egress

• 912.4.1 Where the means of egress for change of use is to a higher hazard occupancy classification then the means of egress shall comply with the requirements of chapter 10 of the IBC.Exceptions:– Stairways can instead be enclosed in accordance with the

applicable requirements of IEBC section 803.1– Existing stairways including handrails and guards

complying with IEBC chapter 8 are permitted for continued use subject to approval of the code official

– Stairways replacing existing where the slope cannot be reduced because of existing construction are not required to comply with riser height or tread depths of IBC

• 912.4.2 Where the means of egress for change of use is to an equal or lower hazard occupancy classification then the means of egress shall comply with the requirements of IEBC section 805 for the new occupancy classification. Exception:EXCEPTION STATES: Type B dwelling or sleeping units required by section 1107 of the IBC are not required to be provided in existing buildings and facilities.

Note: If there is a change of occupancy from say R-1 to R-2, this exception to not provide type B dwelling units would stand. If remodeling accompanies the change of occupancy then the IEBC chs. 6-8 applies, as well as the statutory provisions for remodeling, and some type B units may then be required.

• An addition is defined as the extension or increase in the floor area (including mezzanines), number of stories or height of a building.

• 1001.1 additions to a building shall comply with the IBC for new construction

• Where an addition impacts the existing building that portion shall comply with the requirements of IEBC.

• An addition shall not create or extend any nonconformity in the existing building, as may occur without a firewall separation
